HomeMy WebLinkAbout1944-07-24 Mr. Brien had the work started on the property and he had no permit. He has been before the Board on one occasion asking for advice"which was given. He then presented some crude drawings of proposed work. There are ~o approximately eight apartments. Et was explained to him that plans must be ~ven ~o the Board. Attorney Michael Betel is Mr. Brien's lawyer. Nothing has been heard directly hut we understand that he has ~ented at least three or £obr apartments. He is Just going ahead violating the ordinance but he has not made any appeal as yet. Mr. Trombley stated that they have e numver of violations but the majority of people are living up to the rules. Mr. Trombley stated that the Appeal Board feels that the enforcement of this law is not being enacted. Mr. Thomson stated that the Police is enforcement of laws and this zoning law is our own by-~aw. ~he building inspector should make complaint~ to Chief of Police. He stated that under Article 13, Section 1, the penal~y is not more than $20.00. Mr. Trombley stated that he felt t~t Martin Lawlor 'is on the fence and he should receive orders from the Board of Selectmen~ Mr. Finneran asked what would happen if a person was brought in and fined $20.00. Mr. Trombley then stated that he felt that a.person should be restrained after the second instance. Mr. Alter stated thatMr. Brien should have a fire wall which is one- violation. Mr. Thomson stated'that the Board should bring Mr. Brien in on'one complaint and'have police sign complaint. Mr. Alter explained to Mr. Brien that he would have ~o furnish a plan to the Board in regard to la~d and boundary lines so that we can tell Just what can he approved. The safety of inhabitants must be considered. It is improper to have only one exit. Mr. Trombleyasked if the Board woul~ he in favor of sending A letter ~o Martin Lawlor stating that ,this Board had made complaints. Mr. Foster stated that we would do this. Mr. Thomson made a mo~ion that on recommendation of this Board that~i.~~' ' Mr. Lawlor inatitu~e a complaint against Mr. Brien on charges made. This was seconded by Mr. Finneran andvoted unanimously. M~.Thomson stated that in.fha .future, as a matter of policy~ if' called to attention of building inspector and,no action is taken, a letter, should be sent =o this board ask if some action can be taken. POISON IVY: A letter received from Mrs. Marion Lawton, owuer of the.~property at 351-353 Middlesex Street requesting.that the Selectmen do something,~if possible in regard to the poison ivy in the 10t adJe~har property. She claims that it is rapidly spreading over the sidewalk and she has written to the owner but has had no response. Mr. Thomson suggested that we turn this.mtter ever. to the Board of Health to see if they consider ~his a menace to children of that community.
