Mr. Finneran made a motion to grant this request and Mr. Thomson seconded the motion and vote was unanimous. Meeting adjourned. FEBRUARY 18,1946 The regular weekly meeting of the Bard of Selectmen was held'at 7:00'P.M. with ,11 members present. Weekly b~lls and payrolls were received and approved for payment. · RESIGNATION OF HAROLD TYNING:-WARDEN-PRECINOT£0NE. The resignation of Harold Tyning of 271 Sutton Street, North Andover was received on this dayl Mr. Tyning has been warden of precinct one but will be unable to serv~ at this"time. The~board voted to accept the resignation with regret and so notify Mr. T~ing; FOREST WARDEN -APPROVAL The appointcent of James Hargreaves as Forest Warden of the town of North Andover was approved by the Direct of the Department of Oonservation, Division of Forestry. DUTGH FLAT~ Mr. Henry Barreh'who owns the property a~ 73-75 Harold Street has informed this board thathe is interested in caking a dutch flatat this property. He stated that there is a front and back Stairway and he could have a very nice four room flatthere. STREET LIGHT RE:UEST A request for a street light to be installed on pole #1513 at 880Turnpike. ~Street was received from Anthony DeLuca whostated thatthis is a'very dark section and that a light there would make it much safer. Mre Chase advised us that they have instr6cted the operstor to be on the watch for thtstrsin-but the driver has, advised Mr. Chase that he,very S~ldom sees it asit is usually late and sometimes doesn't getin until~ll:50. Since this trip. ~s usually heavy.they feel that they cannot hold thi~l~ad'0f passengers any length of time and often when the connections are made there are no passe~gers to take the bus. A hearing was set to'be held on March 4, 1946 at 7:30 P.M. in the Se!ectmen's Office. Abuttors will be notified. NEW ENGLAND TEL. & TEL. CO.: A public hearing was held in this office at 7:30 P.M. on the petition of the New England Tel. & Tel. Oompany to locate poles, wiros and fixtures on Beverly Street 250 feet southeast of Suffolk Street, 1 pole; Lyman Road between Little Road and Buckingham ~oad, 2 poles; 0sgood Street 115 feet east of Concord Street, ! pole. ~Mr. Finneran made a motion to grant this petition, seconded by Mr. Thomson and voted unanimously. On the second petition for permission to plaxe and maintain buried cable manholes, manholes, with wires and cables therein, markers and other fixtures under the' surface of the followin~ public way~ Sutton Street, 50feet of buried cable from Manhole 164 easterly and thence northerly across the street for 74 feet to Ashland Street. Ashland Street, 101 feet of buried cable~ from Sutton. Stree~ easterly to pole'#52/1. Mr. Thomson ma~e a motion to grant this permission and seconded by the vote was unanimousby Mr. Foster~ favoring same. REPORT ON D'UP~O'S DOG: Chief McKee received informationfrom M~. D'Urso that he would like to have .' three or fourm0re\days in which to get .the dog owned by his brother, out -of North Andover.'~\He said he could, not go by machine where he plans ~o place the ~og but will be~s~le to get rid'of it Within a few days. Mr. Thomson made a motiontha~ the Chief of Police be instructed to see that the order of the Board of Selectmen be complied with~ Mr. Finneran stste~'th~¥~hewoO!d~ like to give Mr. D'Urso .three or four more days in which to dispose of the dog. Mr. Thomson stated that he did not feel that he should have any-more itime and he is ofthe opinio~ thatthirty days is sufficient time to remove~.'~ .the dog from North Andoverl ~r. Foster .feelsthat he should comply with~the~! order of this board and he agrees with Mr. Thomson. Mr. Finneran felt that he wanted to be linient with Mr. D'Urso and he may have'ran into trouble. Mr. Foster then seconded the motion of Mr. Thomson which was ~ majority vote of'the board. Mr. Finneran did ~ot vo~e. ~PUBLIC HEARING~STREET ACCEPTANCE '~' public hearing was held at 7:45P.M, on the adjudication of Glenwood Stree~ ~'~ ~and Rosedale Avenue, petitions having been received, to ha~e both streets accepted' at the Town Meeting. Mr. Foster brought up RosedaleAvenue as the first street to be considered. Mr~ Leonard Firth appeared before th~ board and stated thatRosedale Avenue is about 1000 feet long and there 'is a two foot ditch on one side and the roadway is about 12 feet wide. He said that if it is accepted, the peop!~ will "holler.~ for a drain which will cost about $4,000. ~Mr. Thomson informed M~. Firth that one ~c'0ndition is tha~ the road surfac~ condition be satisfactory to the Highway. Thomson then saiS, "Mr. Long, One condition is thatthe Highway recommend that.the street is in condition and we will then accept it and if it is not in condition we cannot do'anything about it. GLENWOOD STREET: This street was ne[t to' be considered and Mr. Thomson stated that ~the same motion be applied to this street, and that it be continued until next week, February 25, 1946 at 7:30 P.M. when Mr. Carry ~would be present. FEBRUARY 18, 1946- continued RE:UEST FOR TREE R~IOVAL Request for removal of a tree a~ 52 Marblehead Street wase~edeived from Mr. & Mrs. George Reecho of this address. The limbs are always falling off the tree onto the porch and the lawn and causes quite a mess. Mr. Thomson made n motion to refer this matter to the Tree warden and if he felt that the ~ee should be removed e hearing would be set for March 4, 1946 at 7:45P.M. RESIGNATION 0FWARDEN-PRECINCT ONE A letter of resignation was received from Harold Tyning as warden in Prec,.ncr One mo become effective at once. The board voted to acceD~ the resigns%ion with regret and so notify Mr. Tyning. The matter of appointinganother warden was delayed for one week'on motion of Mr. Thomson which was a unanimous Tote. SELECTIVE SERVICE BT~LZ A bill for the dinners at Andover Innfor 12 people at $2.25 each was received from Mr. Hardy, Selectman of Andover and a check wil!be forwarded to Andover Inn to take care of this amount. AND GLENWOOD'STREET: -, The matter of Glenwood Street was taken up and Zra Carry, HighwaY Surveyor was present. Mr. Foster stated that he was with Mr. Carty to-day and hewent~down to G!enwood Street end.found that it was in very poor condition, at this time. He does not see how we would be 'Justified in approving this street for acceptance.'- Mr. Thomson addressed Mr. Carry and dek~sred: Mr. Carty, let's understand one another on these streets. It is up to you to approve or disapprovethese streets before the board takes action. Mr; Carry then inquired if the law'states that the highway survayer should have the say, or isn't it up to the board to recommend and up to the town meeting to accept?" Mr. Thomson read the regulations as adopted by the board of selectmen and told Mr. Cartythat th~ road surface and existing drains must be satisfactory to the Highway Surveyor.
