Comments
The North Andover Planning Board held a regular meeting on Tuesday evening, February 25,
1992 in the Town Building, Selectmen's Meeting Room. Themeeting was called to order at
by the Chairman, George Perna. Also present were Joseph Mahoney, Richard Rowen, John
Draper,
Karen Nelson, Director of Planning 7 Community Development was also present.
Bonds
Lot B Great Pond Road
Joseph Mahoney, Acting Clerk, read a letter from Daniel Depiano requesting the release of a
portion of a bond being held by the Planning Board. A letter from Christian Huntress was also
read recomvaending the release of $2,500.
A motion was made by Joseph Mahoney to release $2,500. The motion was seconded by
Richard Rowen and voted unanimously by those present.

The issue was tabled until a full Board was present.
A motion was made by John Draper to table the issue until a full Board was present. The
motion was seconded by Joseph Mahoney and voted unanimously by those present.
Transfer Si_p_nature - Robert Janusz
John Simons signature was needed on the foil,,, as he is the Clerk of the Planning Board. John
Simons was not present. Issue tabled.
First Calvery Baptist Church - Up~te
The applicant has sent a follow-up letter requesting a legal opinion on whether they have to
build a bridge, as stated in the conditional approval. The applicant is looking for an agreement
from the Town to build the bridge. The Town has already granted, them the use of the parking
area at the Atkinson School.
GeorgePerna said there was no question. Theeonditional approval says a bridge will be build.
He went on to say that there were concerns with safety along Mass. Avenue and as part of the
approval the bridge was required to address the safety factors. If the applicant had a problem
with that condition, he should have stated so during the approval process.
John Draper asked that the Town Planner respond in writing to the applicant. A request for
a legal opinion has been sent to Town Counsel. George Perna asked that a meeting be set up
once the opinion was received with the applicant, the Chahman, the Town Planner and the
Director, Karen Nelson,
585 Dale Street - S_rn~,ial Permit - Watershed District
Christian Huntress was told a the last meeting to prepare a draft decision. He presented that
draft to the Board.
Christian Huntress stated that at the last meeting there were questions whether portion of the
property were listed under Chapter 6lA. An affidavit signed by the Assistant Assessors states
that those lots in question are not covered under Chapter 6lA.
The D.P.W. has responded to questions on the elevation of the detention pond. Elevation on
the east side of the detention pond is 179 ft., plans show 181 ft. elevation. Condition 10e read:
'The applicant shall be required to bring the east side of the detention pond to an elevation of
181 ft. as shown on approved plans."
Condition #3 will have the specific file number from Conservation once issued. DEP has not
issued one at this time.
Condition # 14 - Copy of the deed shall be presented to the Planning Board and included in the
f'fle. George Perna asked specifically when that was required. Christian Huntress stated that
in general that was required prior to a Certificate of Occupancy being issued, this condition
will be placed under Condition #10.
John Draper questioned storage tanks. The Board agreed not to allow them at all.
Joseph Mahoney questioned Condition #3, endorsing the Conservation's Order of Conditions,
sight unseen. George Perna stated that the statement was redundant. Joseph Mahoney still
would like to see that Order of Conditions from Conservation. Joseph Mahoney asked that
his objection be noted.
Richard Rowen had questions on Condition 9b. Christian Huntress stated that if there was
substantial erosion, additional haybales would be required.
Condition #18, George Perna asked that "as described in Condition #15 be added."
