HomeMy WebLinkAbout1948-05-03378 APRIL 26, 1948: -continued APP.~.LBOAND: Ailengthy letter was received from the Board of Appeals relative ~o a complaint made ~o the Board of Selectmen by Albert Mistreats of 29 InglewoodAve. in regard to the storage of septic tanks and other plumbing materials on property owned by Domenic Mangano of 205 Mass. Ave.. The letter stated that ~wo questions were involved in this situation: 1- is non-con~orming use of land, as in this case, in violation of the Zoning By-Laws of North Andover? 2- if it is in violation, who has the authority to enforce the law? ~he letter contained the ~pinion of the board relative to these questions and ended..,by stating that in ~iew of their opinion, it is .the thought of this Appeal Board that the Building Inspector should prohibit the further use of the vacant lot on I~glewood Street for the storage of septic tanks or other plumbing materials. The board Voted to refer this matter to Mr. Lawlor, Building Inspector. REQUEST FORREMOVALOFTREE: A request for the removal of a tree in fron~ of the property of Harry Bar~ett 0f49 TollaBd Road was received. Mr. Connors had pre~iously looked at this ~ree end agreed that it would be advantageous to have it removed. The board voted to have the tree posted and set a hearing for May 10, 1948 a~ 7:30 P.M. REQUEST TO CLOSE DUDLEY sTREET: The board voted to grant theDonald Por~er Fellowship of Trinitarian Church the use of Dudley Street on June 5, 1948 from 2;~0 P.M. through l0 o'clock P.M. to hold their annual street fair. Mr. Prank Wallwork, Tax Collector came before the board and asked that they be given Police and Fire protection and the cos~ will be peidby the Fellowship. Mr. Wallwork stated that all residents on Dudley Street will be contacted to see if they are agreeable to closing the street for the above hours. STEVENS HALL: The board granted permission to the V. F. W. for the use of Stevens Hall on May 28, 1948 to hold a Whist Party, if the hall is available that night. Mr. Hayes will be contacted. RESERVE FJND TRANSFER: Approval for the transfer.~f'$~24.50 from the Reserve Fund was received from the Advisory Board. This amount isto pay for the cost of 2525 Advisory Board reports for AprilttO~' town meeting, and is ~o be paid to the Bee Publishing Co. MEETING ADJOURNED: The regular weekly meeting of the Board of Selectmen was held at 7:00 P,M. on this day withall members present. Weekly bills and payrolls approved. TP~J~SFERFROM RESERVE REQUEST~ Timothy2j J. McCarthy, Commander of~the American Legion and Martin ~. Lawlor,Jr. Commander of the V.F.W. Post 2104,. came before the board and informed ~the board that they would no~ have sufficient money to take care of the expense-for the Memorial Daz Program. They stated that prices had increased for.the bands and as they were planning a large parade they should have two bands. The appropriation of $450 would not be sufficient for everything. Mr. Coffin made s motion to request a~rsnsfer from the Reserve Fund of $100 for this expense and motion, was seconded by Mr. Finneran and vote was unanimous, ACCEPTANCE OF STREET REQUEST: ~Mr. Gaetano Midolo of Glenwood Street before the board and his son-in-law was also present. The son-in-law talked for Mr. M~dolo as he could not be understood. He stated.that he felt that this street should be accepted at this time. Mr. Thomson explained very thoroughly what the requirements are before a street can be.adjud- icated by the Selectmen and before it can be inserted as an article in the ~own warrant. The matter will be taken up with Mr. Carty to see if he can help them in decideing what should be done. EAWRENCE GAS & ELECTRIC COMPANY: Permission was granted to this company to excavate to install gas-service for Ernest J. Forti~ on Linden Ave. 27 feet onstreet and for Arthur FoFtin, Linden Ave. 27 feet on the street. DEPARTMENT OF PUBLIC U~ILITIES: Notice received that a public hearing will be held on May 4, 1948 at 11:00 o'clock A.M. at 166 State House upon the petition of the Lawrence Gas & Electric Company for authority to issue evidences of indebtedness in a principal amount not $0 exceed $1,000,000 for the purpose of financing extensions, additions and improvements to the plant and properties of the petitioner. 3.'79 ~~contfnued GROUNDKEEPER,S FE~: , James Murphy, Chairma~ of the American Legion Junior Baseball committee caem ~efo~e the board and stated that the' Legion would not be able ~o pay any fee for Mr. Rivet as groundkeeper. He wgnted it known that he believed.that Mr. Rivet should be reimbursed for bis.work and time but he didn't know where the money w6uld come f~om. Raymond'B=gadhea~ was ~lso presen%..and represented the North Andover A. A. baseball team but since,Mr.'Rivet did not attend the meeting no further action was taken. Later the mamter was discussed by the board and Mr. Coffin felt that we should call for s repor~ from the Board of PublicWorks and ask what they think of remuneration ~oor Mr..~ivet, ~i~ employment reco~d, his duties and also that if the.board.is consmcer angl~s of hours it should consider what the Board of Public Works has to do. They control and employ Nr. Rivet. Mr. Coffin suggested %hat we call for further information from the Board of Public Works. NORTH PARISH ROAD-COUNTY WAY: Leonard Oates came before the board and suggested that the selectmen 4o something about having the Couhty Commissioners work on the matter of having the C§unty Road made passable under Chapter 90 work. ~r. 0ates stated that this road could be used asa short cut to Lawrence but that it is almost' impassable. He said that the town is growing in that section and he felt that something should be done about it. The board agreed to take the matter up with the CountyCommissioners. 'PARKED CAR: Chief: McKee reported that the automobile that has been parked in'Railroad Square belonged ~to Edward Mcffnnis and that he would see that it is not parked there~again. SURFACE DP~IN- MOODY STREET: Dewey Dyer came before' the board and asked that they sponsor an article' for the special to~n meeting to ha~e a~surface drain put in on Moody Street. He stated that the water had undermined a cellar and had flooded o~her cellars and.something should~ be~.done about. He stated that he had spent a considerable sum~of money up there and he can't pay out any more. Mr. ~Thoms0n explained that the Selectmen would not sponsor~ an article which should come under the Highway Surveyor.' Mr~ Dyer then went to see Mr.'Carry who refused to sponsor the article at this time. ' ' BUILDING~ ~NSPECTOR: Ralph Brasseur came ~oefore the board $o inform them~ that' he had come across several buildings, which had been erected without ~a building permit. Re thought that these, people did not know that they require a permit.~ He said the houses a remote area of the ~0wn. Mr. Thomson informed him that he should send a copy o~ 'these~buildings to Mr. Lawlor and that the Selectmen:.should also be notified. Mr. B~sseur stated that he has some things in mind which would be a great help to the ~own land he was also advised to send these -to the building inspector and a copy to the ~,Selectmen. . . PLANNING' B0~D - APPEAL BOARD 'REQUEST USE OF COURT ROOM: Mr'.. Ritchie came before the board and stated that the two boards Would like to use the court room and have their master map hung .in there where it would be easily accessible to all parties. Mr. Thomson informed him that he should consult Mr. ~nunoan.~ ASSOO AT 0 : Notice received that the application from the Selectmen for s reinspection of this tow~'has~be~en~acknowledged and this matter will be taken care of as soon as they have someone available for this work. RICHARD G. WHIPPLE - BROKER 0FRECORDS: Mr. Thoms6n appointed Richard G. Whipple of 13~ Salem Street, North andover as Broker of Records for the Insurance Association and a letter will be sent th the New Fmgland Fire Insurance Rating Association asking, that they accept this appoint- ment which is to become effective on May 17, 1948. TREE REMOVALREQUEST: A request for the removal of two trees on Greene Street wa~ received from George O'Keefe of 132 Greene Street. The board voted to refer this matter to John J. Connor tree warden and to have them posted and a hearing set. Hearing was set for May 17, 1948 at 7:30 P.M. in the Selectmen's Office. 380 M~Y 3, 1948-continued; BONUS INCREASE APPROVED BY CIVIL SERVICE: A notice was received that the increase of a $3.00 weekly bonus for all regular police officers, sergeant, and chief had been approved by Thomas J. Greehan, Director of Civil Service. BOARD OF APPEAL HEARING: Notice received that a hearing will be held on May 10, 1948 in the Town Building at 8 o'clock on the appeal of James J, and Cecilia M. Sh~ehan requesting a variation of the Zoning Ordinance so as to permit the erection'of a single family residence on Pleasant Street 167 from the corner of Clarendon Street. No action.was taken by the board, as Mr. Thomson felt that the Board of Appeals will act in the interest of the town. VOTE ON SCHOOLS UNDER ARTICLE 58 DISCUSSED: The board discussed this vote to decided whether or not it should be inserted in the warrant for the special :own meeting to change the wording. Mr. Thomson talked with Mr. Arthur Sunderland, chairman of the Advisory Board and later they voted to contact Mr. Herman Dine at the State House and get his opinion as to the correct worHing and inform the board as to the procedure for rescindifig the former article and vote if necessary. PERMISSISION TO HOLD "POPPY DAY" The board voted unanimously zo grant permission mo the Veterans cf'ForeSgn Wars to hold a "Poppy Day" on May 27, 1948 in North Andover. LETTER T0 ME. CArnEY, ALDE~,t~NA~ DIRECTOR 0FHEALTH AND CHARITIES: The board agreed to send a letter to Joseph E. Carney, Alderman of Lawrence acknowledging his letter of April 23, with reference to the Dump situation in Lawrence and ~o ask.for further information about the dump on Perry Street which he stated had been reported mo him as a nuisance. ARTICLE FOR SPECIAL TOWN ~,~ETING: A petition was presented to the Board wSicb contained 200 signatures and Mr. Thomson stated that this becomes mandatory upon the Selectmen to call s Special Town Meeting. There were several other articles' ko be inserted at this time. The board'did' not set a definite date for this meeting as they are uncertain when they will hear from Mr. Dine relative to an article to be inserted to change a vote which was incorrectly worded in the Annual Town Warrant of March 13, 1948. RIDGWOOD CEMETERY REPORT: The matter of the report from the State Department of Health in regard to a hearing which was held some' time ago in regard to the dumping situation at the Ridgwood Cemetery 'and the board suggested that the local of Board of Health be contacted and if they have s report to have a copy made for this board. ~ECREATIONAL COUNCIL: A letter oD thanks was received from William Smith who had recently been appointed as chairmen of this council. He s~ated that he would do all he could ~o 'try to emulate his predecessor who was so capable. ~&~ET ING ADJOURNED: MAY 4, 1948: JUROR DRA~N: A special meeting was held with Mr. Finneran and Mr. Coffin present, to draw a juror who was required to serve on. May 6, 1948 at Superior Court, Salem. Mr. Finneran ~rew the name of Thomas F Smith, 36 Chapin Road, Overseer. M~Y 10,1948: The regular weekly meeting of the Board of Selectmen was held at 7:00 P.M. with all members present. Weekly bills and payrolls were approved. DAMAGE COMPLAINT.: Isaac S. Hart camebefore the board and presented a bill for repairs to his car which was damaged when involved in an accident with the police cruiser, driven by Officer Daniel Shine, on January 27, 1948. A copy of Officer Shine's report was read by the board and Mr. ~art ~ave his version of the accident. After careful consideration the board voted to inform I~r. Hart that they did no~ feel that the town of North Andover had any legal responsibility ralative to the payment of this bill. SCHOOL BUILDING COMMITTEE: Mr. ~rancis Kittredge came before the board and informed them that the above committee gave their full,and entire approval to the contemplated action of the Board of Selectmen in amending the vote taken at the annual town meeting with regard to school buildings.
