Mrs. George Sutton of 19 Perry St. requested that a tree be removed from in
front of her property. The tree is small but the roots are causing trouble in
the sewer pipes and she has spent $17.60 in the past two years. The board voted
to refer this matter to the tree warden end if on town property to post it for
a hearing on November 7, 1949 at 7:30 P.M.
STREET SIGNS:
Mr. Carry contacted Mr. Coffin and informed him that he had been requested to
post s sign at the corner of Bay State Road and Mass. Ave. He stated that this
part of Bay State Road is not an accepted road and he could not install the sign.
STEVENS HALL:
The Mariners and Seascouts have requested the use of Stevens Hall for November 15
so that they might hold a dress rehearsal. They have also been permitted to use
the hall on November 16 and 17. The board voted unanimously to grant this request
and check with Mr. Hayes on the evening for availability.
AUCTIONEER:
The Board voted to grant Mr. Milton Howard a permit to act as auctioneer at the
Congregational Church at the auction to be held by the boy Bcouts. Th&re will
be no fee charged for this permit for one evening.
VFW-~ERICAN LEGION:
Leo Murphy came before the board and discussed a previous statement whfch had
been in the local newspaper and which he stated 'was something he did not say,
and he stated that when he talked about the Legion, it stated that if his
talk included profit then that applies to the Legion. He stated howeveN that
there was not much profit made et the Legion since they have purchased their
building so that his talk applied only to the V.F.W.. Hr stated that Club
2104 In. was separate and although he hsd never !ookedatthe books, he felt
that it was making profits which were not turned over to the veterans' organiza-
tion. Ne further stated that the town gave the building and no taxes are paid on
it.
Mr. Murphy then discussed the by-laws and offered several suggestions for changes
to be made. The first change was tha$ of the Town Clerk changing articles and
hefelt that the Selectmen should be the board to make the changes, not the
townclerk, who is n~t available at all times.
He brought up the matter of the by-law with ~espect tothe North Andover Center
end he said that there is nc recc~endatio~A~"tb th~ exact location where
liquor sales shall not be permitted and felt that it should be made clear so
that there would be no doubt about it.
He mentioned the article 6, relative to the appointment of the Advisory Board
stating that it isn't clear and thet'he believes that there is a difference
in expiration and vacancy. It should be made. clear who makes the appointment
for the future. We all know now that the Moderator appoints but it is not clear
in the article.
He mentioned Section 3, page 212 and he_did not.think that the Selectmen should
have the right.to waive this provision.
Mr. Thomson felt that this was a good provisio~ but Mr, ~urphywsnted
of this sectionl
The Zoning and Building laws should be voted on separately and he felt that this
should also be brought out.
Mr. Thomson thanked Mr. Murphy for his criticism which the board considered good.
A letter was received from the Recreational'C~uncil and four articles Were
suggested for the nest annual town meeting. They were discussed by the board
and William Smith, chairman o£ the council was a~so present.
Mr. Coffin stated that he felt that these things ~ould be accomplished from
year to year and suggested that the Planning, ahd Recreational Council meet
with the Selectmen and discuss the playground area.
Mr. Coffin made s motion that the above boards meet with the Selectmen on
October 31, 1949 at 8:00 o'clock P.M. if convenient and Mr. Thomson also
suggested that perhaps Mr. Salisbury or o~her members of the AdvlaoryBoard
might wish to sit in on this meeting. Board wilI be contacted and if convenient
a meeting will be held on October 31, 1949 at 8:00 o'clock
A~STICE DAY: C0~IITTEE:
~ohn Harris came before the.board to discuss the appointment of the chairma~
for Armistice Day program. He stated that ~ appointed as cbairm&n of the
committee by~ohn Donovan, Commander of Post 219 but they want to be sure that
this is the right procedure.
Mr. Coffin made a motion that the Commander of the American'~.gion. Post 219
be empowered and authorized to execute and carry.out ~heobservance of the
Armistice Day program and be empowered to expend the funds appropriated by
the town. Such action of this board to be confirmed by the Town Moderator.

WIRING INSPEOTOR:
Notification received requesting that the Selectmen appoint a Wiring Inspector
pursuant to the provisio~ of Chapter 529, Acta oF 1949 and notify the office
of Harrison C. Withere!l, Executive Secretary of the S~ate Examiners o£
Electricians. No action will be taken until the passing o£ an article in
the Annual Town meeting warrant authorizing the Selectmen ~o make such
appointment.
GYPSY MOTH SUPTS.
Notification received relative to Chapter 660, o£ the G. L. Acts of 1948 relative
to basic changes and new requirements on appropriations necessary'for these
departments to meet the requests o~ this law. Ail provisions of this law
will now be inforced and the letter stated that the Selectmen should beigiven
an eX~!aination so that there will be no misunderstanding in regard t~'the
difference between the amount requested by this office and the figures to be
submitted by the Moth Supt.
If an appropriation is to be requested for Dutch Elm Disease, it must be kept as a
separate item and not included in the general appropriation for Gypsy Moth and
other insect work.
The regular weekly meeting of the Board of Selectmen was held at 7:00 P.M.
with all members preseht. Weekly hills and payrolls were approved.
S~.~BATAR0 AGREEing:
Attorney C. J. Mahoney came before the board and informed them that he hsd been
over to Pembrook Road with the Sambet~ros and they have agreed to put in a hard
packed surface a~d ~rJ Cyr will do the work. Mr. Sambataro informed Mr. Mahoney
that he never agreed to put in the drain. There was a general dismussion on this'
matter.
Mr. Thomson inquired'what good the stree~ would be if the surfa,e had to be dug
~ a~ain. He said that has been or,r trouble'down there. '
. Mahohay stated that he felt that the town should do something'about Lymen
Eoad. Mr. Samhataro stated that he never agreed to put the surface drain i~.
Mr. Thomson then said that hawas violating.his agreement, and that'he'had heard
that thaywere planning to go to'Florida and that Mr.~Mahonay sh6uld bring"wuit
against him and that in the meantime we could have an article· in"the warrant to
take care of LymanRoad.
Mr. Mahonay them said that he has received no estimates of the'cost of putting
this road in condition and thatMr. Brasseur should be contacted and take Care
of' this matter. There was further discussion on thismatter.
Mr. Coffin felt that we should get in touch withRalphBrasseur and ge2 an
estimate of the cost and present same to Samhataro and then go ahead with'~he
suit. ·
The board agreed that there should be a discussion with the Advisory Board relative
to drainage on LymanRoad. By the time the suit reaches court, if 'the 'townspeople
can be convinced, wewill have drainage on Lyman Road.
Mr. Brasseur then came be$ore the board and Mr. Thomson inquired if he could
get figures for article 46 and 47 with respect to'putting this road in ~omdition
and present them to C. J. Mahoneyby Thursday. Mr. Brasseur agreed that he would
do'this. The Board decided to give Mr. Sambataro until November-14~ '1949 %0
take care of his agreement.
FIRE'DEPARTMENT:
Several members of the call firemen came before the hoard to discuss the dump
:situation. They informed the board that they have to lay the hose over 300 feet
in order to ~et to the fire and they want to be compensated for this extra work
or have it ~traightened out. They have been down to Perry Street dump six times
in the past two weeka.
Martin Lawlor was presented and he said that sometimes they have been down there twice
during the day and that they go down there al2 hours. He stated that some time
ago they wrote a letter to this board and they agreed that they would receive
$1.00 per hour during hours.
Another memSer stated that they have taken this matter up with the-engineers
and they have no money. Ne said that pretty soon they wont beable to get in
with the truck.
There was 'further discussion as to hours, number of hours down there and the number
of fires and Mr. Coffin stated that this was primarily a matter of a dump nuisance,
Mr. DeAdder asked that the board see what could be done about cleaingup t~e
place and if money is not available, cleahing it up amd pushing it bahk will help.
Leo Murphy was present and he felt that these men are on call a~d work hours after
hour and get $1.00 per hour while the regular drivers receive $65.00 weekly and are
not on call 24 hours per day.
