King on January 10, 19~0 to discuss this matmer. LAND COURT: Arty King inquired as to wha~ ~he land cour~ procedure is and if the treasurer is appointed each year by the Selectmen. Mr. Thomson suggested that Mrs. Deardan check the record and give Mr. King the desired information. POLICE DEPARTMENT: Officers Farnham and ~illis and Sgt. Hilton came before the board to discuss the forty hours for the police department. Mr. Farham explained that the ~rend through- out the county is forty hours and they presented a schedule for the board w~ich is subject to change if necessary. They explained that Haverhill, Andover, Lawrence and Methuen (this year) are on forty hours. They simply wanted the Selecumen to approve the addition of sufficient money to the regular appropriation so that if this goes through they will have. money to take care of the extra men needed for the balance of the year. Mr. Thomson inquired if it is practical to have two men in the cruiser and Mr. Farnham re.plied that they need two men on the early shift aa that' is the time ~hen more infractions take place and that later in the 1evening they do notI need two men as they could, if necessary, take the second man from the station for a short period of time. He stated'that it is pretty tough for an officer to '~ stop even an auto alone at night. ' ' Mr. Willis explained that this schedule is not u~changeable and can be changed. · at any tine. He said the purpose of the ..~isitlto the board is to have the~Town Meeting vote.on money and' the new men would s tar% in Aprill Sgt. Hilton stated that all the men are in favor of this move and the chief has also indicated his idea as being satisfied with it. We were picked ss delegates. Officer Willis stated that it is the ~eneral rule to have one man for every 1000 people and this town has been a little backward'. Ne st~ed that one quarter of the state is on forty hours~ Officer Farnham' stated that leaving out the forty hours, mwo men is a necessity for' the cruiser. Mr. Coffin felt that that was one of the weaknesses of the deparmment and there should be two men. Member Coffin s~atad that his feeling was hard mo express. The thoughts in his mind were the incompatibility of the department. He agrees that two officers should be in the cruiser but under certain conditions the. Selec~msn should tske a.smand. Because of his~el~ngidno'b~h~rmmst~sr~,Mr. Coffin stated that he would not take any stand. ~fficer Willis stated tha ~ he felt that they knew what he meant. The other members agreed to nave the appropriation readjusted on all c~pies' and the Advisory Board notified. Mr. Murphy came before the board and discussed the matter of Constables being elected or appointed and asked if they were to be on the ballot ~his year. ~ He s~a~ed that they;do no police work and the to~n could a~oint'them. Mr.m Thomson stated that there would have to be a vote of the toe to have this removed from . the ballo~ ~and to have them appointed by the Selectmen. Mr. Murphy stated that he had investigated Town Managership further and there is no information available am the State House. He said tham thir~y town are studying this ma~er-and only two have it, Saugus and Danvers. · A group of residents from'Hamiltonand Holbrook Roads came before the board and Mrs. Edwin Reinhold was spokesman for the group. She stated tha~ the Selectmen h~d approved Faulkner Road and it ~as accepted at the last 'to~n meeting and it is nothing but a bed of ashes and is no better :thanthe ~wo roads menmioned. There is no hard ~urface and no drains. Mr. Albert Greenfield stated tha~ this group was no~ opposed to the acceptance of Faulkner Road-but they would like to have ,their s~ee~s acceptedalso. ' Mrs. Reinhold went on to s ay that they had been told over and over by the Selectmen that the Developer had mot complied with the rules and reuglations and then Mr. Thomson cams up with the suggestion that the Selectmen-adjudicate these streets. Mr. Thomson said he would like to correct that statement~ that he did say. that one or two S~reets be picked out for adjudication and reaction of the Town Meeting. If we ammempt toa~Judicate all these smreems, said Mr. Thomson, that w~uld be a fatal mo~e. He further stated that they could nom legally get into the Town Meeting without an adjudication and the onlyway is to take a sample smreet or two and p~se'nt the problem. Mrs. Reinhold stated that they were Just as much a part of the ~own as anybody ~lse and there are eleven houses on each street, Hamilton and Holbrook Roads. Mr. Russell Dow said he would like to change Mr. Coffin.s mind with respect to Ralph Brasseur. He inquired ~ho paid Mr. Brasseur and if Mr. Carry can't do his Job, then someone else should be paid to do it. Mr. Brasseur is always here. JANUARy 9,1950-continued; Mr. Thomson stated that it might well be that the U'own v~uld vote a conditional acceptance of these streets. Re said he was in favor of following the ~Statutory procedure but would make an exception of these two streets for the specific purposetheir problem.Cf allc.~ing these people to go to the Town Meeting to properly present Mr. Coffin said tha: the Town is supposed to go by rules and the first s~ep the Selectmen can ~ake must he certification in~lting by the highws~, surveyor that the roadw~ is in condition and then it is the duty of this board to: adjudicate the street. Mr. Coffin then wen: on to discuss the matter as dating back from 1945 '.when S developed Mifflin Park. In 1946 he applied, for installation of sewer and wazer and the Advisory recommended a condition.- In 1946 , Article 20, he aPplied for water and sewer on Hamilton and~ Holbrook and the Advisory board made the provision that proper aSSUrance be given to the Selectmen that .this street would be put into condition. Article 21, was for Holbrook Road, The Selectmen took his oral willingness to put the street into condition and the Board of Public %Vorks. He did not live up to his agreement. In 1946 there were more articles and the Advisory hoard again 'made'recommandations, and the Selectmen 'acdepted a written agreement. In 1948, a legal agreemen~ to run for one .year was accepted and Sambataro signed the agreement and water and sewer were installed. Sambataro did not comply and the Selectmen failed to receive financial ~Surety and' now a suit has been filed. ~ statement was that the Selectmen had failed because no proper guarantee was received. I .think. i~ is a business matter :o request a bond; The Planning Board approved' a layout of Mifflin Park without drainage. I have searched for plans' as there may have been extenuating circumstances. ~Mr.'.Sambataro is the real culprit You people bought from him and had good reason to believe that he would carry his agreemen~ through. You should bear one half of the cost., The principle of the-developer to put new layouts into condition was done by the Advisory Board, He,Samb~taro, should have added cost to the selling price of'house and if you had been charged $150 more, you would have paid it. I cannot accept~Mr. Thomson,s recommendation; it requires certification from the Highway.surveyor. The Town is going to do Just what they~a~d they wouldn't do. I want to do the .right thing and be honest abou~ the v~ole affair. Mr. Greenfield said it ~as nice to honest but this thing has ~one ~oo,far, - Mrs. Reinhold~.again asked whythis road-could not .be accepted when Faulkner Eoad was ac.cepted and she W~nt on to discuss Mr. Carry and what he didn't know and wouldn t do. ¢~-~in stated that he would not discuss any town official. He said that fill had been pus in on Faulkmer Road. He also said that we have Jnsver had satisfactory information from the sta~e on the drainage'Jnecessary on,these stree:s. He said the residents should form an ,or-ganization and get subscriptions jand ha~e a treasurer and discuss this matter with the Advisory Board. Once you have one half the cost .in --crow, then present the article to the town meeting and ask that the town vote to .~Astall underground drainage, the town not to .spend until, all money · ~ oneiS available, from the residents. It is .a complicated.procedure but is the correct Mr. Thomson inquired .if the ssme results migh~ not-come through his suggestions. Getting into the 'toe meeting is the most important and if we have been at then we should dbe most solicitous. These people can't get to the town meeting unless the streets are adjudicated. A to~n w-ill vote as it sees fit. Mrs. Reinhold stated, that they met~with the Advisory Board~with respect to Lyman Road for years and the Advisory Board agreed %hat in principle.a trunk line sewer could be installed half way up Lyman Road. The board suggested that this ma~ter be kept in mind for the articles for the warrant. The residents then asked that the selectmen help them with t~ei~' articles and / for the cost of drainage for two streets will be .obtained from Mr. Carty. tw6 .articles. were drawn up to be presented for insertion in the warrant and.a figure VOTING HOURS: . .. : · John J. Lyons came befor, e the board and asked if they would agree to change the voting hours from eight to eight or from seven ~o seven. After Some discussion the board felt that no change .mhould be made and the same hours will ~continue, 9:00 A.M. 'to 8:O0.P.M. SPECIAL POLICE OFFICERS: Upon recommendation or. John J. Lyons, the board vo~ed to appoint 6harles S. Fowler, 1~18 'Gt~ Pond Road and Joseph Senia, same address as special police officers. TREE AND .MOTH .DEPARTMENT: Notice received from the Department of C~nservation that the following amounts are recommended by this department for appropriations to carry .on the work for 1950: Gypsy Moth work~ $3755; Pruning and destroying all existing dead wood in town elms, $750; and for other work for. protecting ~own trees, $1825,32. These figures will be referred to the Advisory Board by tree w arden, JOHN j. Connors. Cards for appointment of Moth S~pt. w~ll be held up until JANUARY 9,1950-continued FOREST WARDEN: Notification received that a forest fire warden should be appointed in January of each year. ARTICLE RECEIVED -VETERANS' HOUSING AUTHORITY An article was received and a request that the Selectmen adjudicate Gilbert Street which has been approved by Ira Carty, Highway Surveyor. The board accepted the anticle fox, the warrant and a hearing will be held on the adjudication of this stree%. CLAIM: A letter was received from Mrs. Malnia Giard, 238 Sutton Street asking that the town reimburse her for the cost of her glasses which were broken when.she fell. on the sidewalk at the corner of Cleveland and Nain~ Streets. The board voted to refer this to Mr. Carty~ and pay the cos% of the glasses when hill is'received. Albert Taylor sent a bill to the town for damages to his car when the spring broke going over a hole on Sutton 'Street. ~The board agreed to pay $20.00 for work necessary. This condition will be reported to Mr. Carty. Mrs. C. R. Barlow of 10 Woodw2y St. Lawrence presen%ed a claim of $34.00 for damage to her automobile when the ambulance sideswiped it on Sutton Street and the board voted to .nay this amount.. ~TREET LIGNT REOUKST: - - armeIlo G~oco,'I5 Hemlock St. requested a street light on Pole #1097_a~ the corner of Mass. Ave.and Hemlock Street. This is a dark area and there are lights az the corner of all the other streets in this section. The board voted to view this location before making a decision. TOWN REPORTS: The Board voted to instruct the Town Accountant to call for bids for the rprinting of the To~m Repor~ and to ask that a good grade of paper be used with a sample enclo'sed. Bids to be returned not later than January 23, 1950 at eight o'clock P.M. MEETING WITH ME ROCKW]~L: The Board will meet with S.F. R'ckwell a% the ~is & Furber Office at 7:30 P.M. on January 12, 1950 and Advisor~ Board members and Mr. ~illiam Smith and Gregory Mooradkanian will be asked to be present. PUBLIC HEARINGS: _. The Bo~d voted %0 hold a public hearing on the adjudication of Gilbert'Street, H~mtlton and Holbrook Roads at 7:30 P.M. and $:O0 P.M. respectively. All abutters to be notified to be .present if interested. MEETING 'NITH H. W. PUTNAM, ACTING MAINTENANCE.ENGINEER: The Selectmen will meet with H.W. Putnam-on Tuesday, January ~lO, 1950 at 9:30 A.M. at Nifflin Park, North Andover to discuss the possibility of removal of the barriers erected by the State Department. JANU .~,Y ,16 ~ 1950. · ~he regular weekly meeting of the Board of Selectmen was held at ?:00 P.M. with all members present..Weekly hills and payrolls were approved. BOARD OF HEALTH: A~etter w~s received from the Board of Health with respect to complaints which they have received regarding the town dump. The board would like'to know what can be done to alleviate this condition..The Board voted to notify the Board of Health that the Selectmen have a new location under consideration and ask zhat they make some arrangement to view this location at some time in the near future~ and notify this board when it is convenient for them to do this. EXCAVATING~ ACADEMYiq{OAD: Mm. Bone, contractor would like to have a permit to excavate on Academy Road for telephone and electric underground service at the David Brown residence~ He is aprivate contractor and is working P.'om the housr out but the pole is across the street and he will have to excavate to go across the~treet. Mr. .Garry is willing that they excav~a%e. The Board voted ~o grant permission provided he files a bond or has insurance coverage in case someone is hurt. Mr. Bone will come to the office on January 17, 1950 for his permit. STREET LIGHTS: Bernard Bingham request a street light on pole #2 on Faulkner Rd as this is a dark section and a light is needed badly. David Ritchie requested a street light to be installed on Morris Street on the only pole avaLlable there as it is very dark there.
