No action was taken on this matter. Meeting Adjourned. DECEMBER ll 1950: The regular weekly meeting of the Hoard of Selectmen was held at 7:00 P.M. with Mr. Thomson and Mr. Coffin present. Weekly bills and payrolls were approved. ~STERN MASS. ST. RY. CO.: Mr. Burke of the Eastern Mass. came in ~o advise that they had looked into the complaint of the residents on the Railroad Ave. line and had had a man check on the bus running on tha~ line. After checking for three dayS, it was found that the bus does no~ reach Lawrence until three or four minu~es before eight, which does not give the people enough time to reach their places of business by eight o'clock. Mr. Burke advised that effective Thursday, December 14, 1950, the Lowell bus will leave Railroad Avenue and Main St~a~ 7:35 E.M. instead of 7:40 A.M. The Eant~rn. Mass. will continue to cheek on this~situation for a few days and if neces- sary, they may have to have the Railroad and High bus start a little earlier. Mr. Robinson (who brought this ~atter to our attention) will be notified of this action. .ESSF~X COUNTY RETIREMENT: The Board of Selectmen will sponsor two articles for the Warrant, for an increase for those who qualify. We share in ail benefits and likewise all costs and expenses are shared proportionally. We make contribution to County Fund and paymentS are made from the actual fund. TRANSFER FROM RESERVE FUND: Forbes Rockwell, .Civil Defense Director, requested a transfer of $500 from the Reserve Fund, to establish a Civil Defense Dept., and to tame care of any preliminary expenses which may become, necessary. This was endorsed by the Selectmen and referred to the Adviscry~ Board for approval. LAWRENCE GAS & ELECTRIC CO.: By a unanimous vote of the board, permission was granted to the Lawrence Gas & Electric Co. ~to install gas services for the following: George Fielding, 35 Bixby Avenue, 35 fee% in street; and James W. Heron, 121 Presco:t Street, 27 feet in street. Mr. Carty ~Lll be notified of this action. REARING: i~averley Rd.-RailroadAve.) Notice received by the Selectmen from ~he~Dept. of Public Works advising ~hat a h~ar- ing will be held on Wednesday, December 2C, 1950, at 2:00 P..M. on the petition of at least 25 ~nhabitants of the town of North Andover, in which they appealfrom action taken by the Board of Selectmen changing the name of Railroad Ave. to '~averly Road. The motion was made and seconded that the Board attend the Hearing. (notice of this hearing has been published in the Tribune). LAWRENCE GAS&ELECTRIC CO. - Mr. George Frost advised this office that they would credit the December bill for the stree~ lights.that were out during the storm. KIMBALL DISTRICT ASSOCIATION:. Letter received from Charlotte M. Foster, secretary for the group, expressing appre- ciation for the street lights installed on Salem, Boxford and Foster Streets. JUROR DRAWN: A Grand Juror was draw~ to serve at Criminal Superior Court, Salem, on January 8, 1950. The name of Karl T. Wainwright, 22 Milton St., ~ireman, was drawn byMr. Coffin. MORRIS STREET: . At the request of Highway Surveyor, Mr. Carty, the number of feet on Morris Stree~ which meets with his approval is 188 feet instead of 180 feet. This figure was changed at his request and this will again be advertised for adjudication. The hearing has been changed from 12/18/50 to 1/8/51. GENERAL RELEASE: Mrs. Agnes Costello, who presented a damage claim in the amount of $32.45, as a result of a fall on 11/8/50, returned a signed general release to this office. REMOVAL OF TREE (~EQUEST PERMISSION) Letter received from Kenneth M. Britt requestingpermission to cut down a pin~ ~ree which is on his property and within 25 feet of the street. Permission of Selectmen nc~ required as this is on private property and Mr. Bre~ was so advised. DECEMBER 11, 1950 (continued) DEPT. OF PUBLIC UTILITIES: Notice received from this dept. relative .to a public hearing on Tuesday, December 26, 1950 at 10:00 o'.clock in the forenoon on a petition of Dump Truck Owner,s Association in the matter of increase in~the hourly rates for vehicles ~ransporting certain dump truck commodities. PERMISSION TO CHURCH COMMITTEE FOR XMAS PROGRAM: The Committee for the Xmas Carol Program to be held on December 23, 1950 at 7:30 P. ff. was granted permission to obstruct Jefferson Square and erect a small platform a day or two before. BOARD OF TRADE: Permission was granted a group cf citizens of the Board of Trade, Santo DiMauro, Louis H. McAloon and Joseph b,m-nelto, mo rope off and obstruc: a public way (Railroad Avenue and Main St. (Railroad Square) and Jefferson Square) by the erection of Xmas trees and lights during the Xmas season for a reasonable period of time. RAILROAD AVE.-WA~ERLEYROAD HEARING: Attorney Arnold H. Salisbury came before the board relative to changing this s~reet name. He stated.that the hearing is to be held as Boston on December 20,1950 and he asked permission ~o have the original two petitions which were presented ~o the Selectmen. Mr. Salisb6rywill represent the petitioners and he said he would be willing ~o represent this board withou~ cost. He felt that the principal respondent is the board~of Selectmen and there maybe reason ~o Justifythe action of this board. ~r said that Mr. Coffin has a duty to see tha~ the decision of this board is upheld even though he voted no on the ma~er. Mr. Coffin said he was-willing that Nr. Salisbury should represen~ the hoard as to the board's decision. He felt that he had a duty~o perform~by attending the hearing as he voted against it but this does notmean that he r~presents the board. Er. Thomson s~ated that if the board were to appear ~o uphold the vo~e of ~he board, they would present the ~ri~inal~petitions and that Mr. Salisbury should be allowed to have them. Miss Nary Cunio asked that the board give her a copy of the petition fo~ the change a~d that it be certified. The board agreed that she should have a copy and that Mr. Salisbury would have the originals of the two petition and if necessary he would presen~ them for either side. .~EE REMOVAL HEARING: Ahe~ring was held on the petition of Frederick Coffin fo~ removal cE a tree at 30 Sargen~ Street. There was no opposition and. Mr. John J. Conners, tree warde~, s~a~ed that the roots interfere with the sewer pipes.' The board voted ~o refer this to the ~ree warden and instruc~ him to remove this tree. Vote was majority, Mr. Coffin no~ voting. · .~.A. SHED TO BE SOLD: Ira~. Carty, Highway surveyor, came before the board and informed them that there was a shanty used.during ~.P.A. days, for storing tools and that i~ was now located on Forest Street, at Antonio Camasso.s property. He said the shed was re,ting away and that it was of no further use tolhe ~own~and Mr. Jackson would wtllingly pay $50~00 for the shed as he can use im a~'his taxi s ~and at the corner of Main and S~tton Streets. Mr. Finneran made a mo~ion that insofar as the Selectmen have the authority, they will convey the above mentioned tool shed ~o Mr. Jackson, owner of Jackson Taxi, for the sum c~ $50.00 to ~e paid ~o the ~reasurer. Mr. ~Finneran ~rew the name of John J. Cushing, 34 Johnson Street, Janitor, to serve as a criminal Juror at Superior Court, Salem, on January 15', 19~1. CHRISTMAS CAROL SERVICE: Mr.~ Coffin informed the board that this service would he'held on Saturday, Dec.23, at Jefferson Square and if weather is not permitting, it will be held in'Merrimack Hall. He asked tha~ we request Chief McKee to have five officers service from 7:15 to 8:15 P.M. to take charge of the~raffic as there will be about ~00 childr~en. ~he board vo~ed to refer this ~o Chief McKee and have him reques~ five officers to give their services as this time. COTUIT STREET: A letter was received from Ira D. Carry, Highway Surveyor, stating that. the sewer and wa~er has been installed on Cotuit Street for a distance of 160 feet and that the road has been pu~ into condition and meets with the approval cf the Highway Surveyor. The Board vo~ed unanimously to re~urn the bond of $212.00 to Stevens Nichols who had this bond with the
