Mr. Finneran thought they should hear from the Chief in regard to this ma~ter and Mr. Thomson felt they should cer- tainly hear from the Chief. Mr. Coffin then went back to the proposed by-laws and there was a discussion about by-laws and benefactors. Mr. Coffin wondered about paragraph 3 and said, "A person will ps~ money to an association to build up their fund to enable the association to pay death benefits cr disability benefits"...and Mr. Coffin wondered about benefactors. Mr. Willis said they had had a bid discussion on this subject and it was agreed that no cards were to be issued but every association had a provisLon for honorary members. There was further discussion about benefactors and honorary members and Mr. Thomson felt that the word "benefactor" should be stricken out. Mr. Coffin, "You are a free and independent orgm~ization and we are not to act in an official capacity on these proposed by-laws. Mr. Coffin felt that it might be a good idea if the members submitted a list of benefactors every six months. Mr. Willis then stated that the records would be public when they incorporated. It was decided that the Selectmen would confer with the Chief in regard to this matter of a raise for the Reserve Police Officers. ~. -HARGREAVES--Union School: ~. Hargreaves came before the Board to state that the Uhion School was a fire hazard and said he had talked with Mr. Musichuck's son and though he-should be here as there probably will nora be enough police to watch it all night. Mr. Musichuck said they expect to tear it down in about a week. Mr. Hargreaves said they intend to have someone here and it is definitely an invitation for a bonfire. The Board felt it would be wise to ask the police to pay particular attention to it on~, the night before the Fourth and they might also do the s~me at the Center School. ' ' VM';--REQUFST FOR CA~/~ITAL A~) TAG DAY: VFW requested permission to have a 'carnival at Sutton's Field the we~k of July 30 t.hrbugh Au=~ust 4. They also requested permission to have a "Tag.~Day" on August 4. T~e Board voted unanimously that these two requests be granted. COMPLAINT- ~ILEE: 'P~ilip Roche, 15~90sgood St., complained about a trailer that has been pure up. on the~ land across from his proper~y. This .land is owned by a Mr. Blackadar who lives in ward. Hill. Mr.~ Roche is rather upse~ about this matter as he has heard that eventually this land is going ~o be used as a trailer'park; Mr. Thomson has talked with-various people about trailers and this seems to be the consemsus of opinion: As long as a. trailer has wheels on and is in portable condition, the only regulation concerning itcan come from the Board of Health, relative to sewer and water. But when the wheels are detached, the building laws would apply. Once there is a question of a ~rsiler camp, then this becomes a business. 'Mr. Thomson felt that at present, the zoning l~aws and' building laws cover the situation. Mr. Coffin' asked if we might have ame~o on' this but Mr. Finnerancsaid we slready have something on this. The Board voted to ask the'Building Inspector to mske a report on this' trailer to find cum if the trailer was Stationery, and if so, if the trailer met with the zoning laws in respec~ to side lots, size of building, etc. COM?LAINT-Speeding on Saunders Street: Mrs._ John WilLis asked the Board if a sign co,~1~ be put up somewhere on Saunders Street · as the trucks and automobiles traveled quite fast along that Street. The Board voted -to'have the police investigaze and .check on 'the. advisability of having a VStow" 'sign placed in that vicinity. C0k~PLAINT-Use of Memorial Park back of Public Library as a Playground: - ~etter re~6~ved from Mr. R61and B. Hammond in regard to the above mat{er. Mr. Thomson read the letter and stated that this was not a new proposition. ' He said that this .was given to the ~own on the condition'that' the dedicated area sb,]l never be made use 'of for athletic sports or contests but shall be forever devoted to sedentary rest and recrea- tion. In connection with this letter, Mr. Thomson stated mhat he has had a' ringside sea~ for two years and he enjoys the park very much and he objects to its becoming a play~round. However~ having intense interest in 'the welfare of young people, we sometimes want to dis- regard the feelings of young persons and perhaps that is one Of the troubles in the world today. I have seen children playing in the park on many occasions. It is a thrill for me on occasions to see a child who is crippled, have the opportunity of playing and no~ being obliged to go'to a park some distance away. It doesn't disturb me butis probably a technical violation' of the original gift. It may be that ~there have been older children playing there. In the past week or two, I have noticed changes but whether it is a' resul~ of older children or not, I don't know. I have been particularly careful not to let my children play there. I am %n accord with the writer's sentiments. not to wish this park to be reduced ~o a common playground. It is a ~ficult problem and the police have been contacted on many occasions, but they can't be ~here ~il the time. We owe it to the original donor .and the town as a whole to do what we can to see that it is preserved as a spot of beauty. I have always been of the impression that if the park is used by small children without objection of~the donor and used to the extent that it would no~ be damaged, we perhaps ought not ~o take it too seriously. Mr. Coffin felt that the three playground we have would be reasonably adequate for large playgrounds to have organized activity but in each separate neighborhood, there should be a sizable lot of land where children in that area could gather and play. He felt that the town should be considering, dis- d~se~msing and laying plans for the acquisition of more lots of land. 19Si Icontinued) Memorinl Park (cont'd) Mr. Coffin suggested that the police use a little diplomacy and suggest that the older boys go to another place to play (thc adjacent lot) and it seems as though this might relieve the situation. He thought they would have to go up there several times and it wouldn't do much good to Ju~st go there once. Nr. Taomson then stated that it was amazing what we are spending for recreation and he felt that it is a continuous problem. Mr. Coffin then said that with ~he three regular playgrounds, these other lots he proposed, would have no additional cost but the initial purchase cost. Mr. Coffin mentioned that he would like to sit do:'m with the Recreational Council eommtime and discuss this problem. PROPOSAL OF NAME FOR NE%V PLAYGROUND: A letter was received from Wm. Smith, Recreational Council Chairman, suggesting that the name of the playground on Marblehead St. and Mass. Ave. be called "%~averly Park Playground." Mr. Finneran stated' that he was willing to go along with this and Mr. Thomson mentioned that the Council had considered individual names. Mr. Coffin seconded Mr. Finneran's motion although he ~tated that he was not particularly keen about the name. The Board voted unanimously, that the playground bordaring on Marblehead Street and Mass. Avenue shall hereafter be known as %?averley Park Playgroand. CENTER SCHOOL: )Jouis Niller notified the Board that the cos% for boarding up three windows in the base- ment would be $26.90 and he will also check the doors and if they have to be boarded up, there will probably be an additional cos%. Ne will %ry to do this next Sunday. However, the Board contacted Mr. Miller by phone tonight to ask if he could do this work ~omarrow so that the School will be all boarded up by tomorrow night (Night before the Rourth). Mr. Miller said he would try %o do this. NORTH ANDOVER IMPROVEMENT SOCIETY-SIGNS: 'lhe above signs were placed at the following locations: Bradford Street (Coppola property), Barker Street (Barker property), Flats Bridge (Lake Cochickewick), Johnson Street, Hillside Road and %Vaverley Road. Waltar Stamp still has six signs to be placed but has nc definite location. COMPLAINT-DAMAGE CLAIM: Getter.received from~M. B. Langford who advised that on 6/16/51, their truck (Langford's Seafoods) hit a hole on Great Pond Rd. near the Country Club and broke a right front spring. · They contacted Mr. ¥falterStamp, who advised them ~o get the truck repaired and notify Mr. Thomson. The Cost was $18.00. The Board voted to send a release on this. POLICE DEPT.-Missin$ Orsan: fetter received from Chief McKee advising that as yet, they have been unable to find out where the organ is or ho~ it disappeared.' Chief McEee gave a list of the persons c6ntacted and all the officers in the department have been instructed to check on this matter and they will cpntinue ~o ~ry and locate the organ. BOARD OF APPEALS RE VERDA APPLICATION: Communication received from the Board of Appeals advising that the application of Steve Verda requesting a variance so as to permit the selling and storing of second-hand cars and the selling and storing of repair parts for same in the rear of property a~ 701 Salem Street, was denied for ~wo reasons: 1. This use would be a violation of Article 5, Sec- tion 1, paragraph (a) of the Zbnihg By-laws and 2. ~Vould prove detrimental and injurious to the neighborhood. ESSEX COUNTY RETIREMENT BOARD (Industrial Accident Leave) The ~oard ~eceived a copy' of Chapter 99 of the Acts of 1951 which becomes effective'on 6/1~51 and which provides that a member shall have credited :o him as creditable service the period during which he is receiving weekly payments or a lump sum settlement in lieu of .weekly payments for an industrial accident. The credit is applicable only for the period during which he is receiving ~the payments or the period which the lump sum covers. The Board voted to refer this to the Treasurer, Mr. Maker. ' PURCHASE OF LAND FROM DR. CEPLIKAS: Mr. Thomson asked th'at the Treasurer make ou~ a check for the purchase of the land from Dr. Ceplikas (as per letter'from'the School Building Committee). OFFICE OF PRICE STABILIZATION: Letter received from 0PS requesting that we send them a list of all the ~ommon victualers in the community, both with and without a liquor license. A list will be sen~ as soon as possible. DEPT. OF LABOR & INDUSTRIES: No%tfication received fram the above dept., showing the retail price index of specific goods and services in large Mass. cities from Mid-May 1951 to Mid-June 1951. OFFICE OF ~AYOR, BOSTON: yor ohn~ ~ ynes o Boston requested that notice of the enclosed ~nnouncsment b~ brought to the community, the announcement being the Music Festival by the Boston Pops Orchestra at Fenway Park on ~d., July ll. T~e Board gave this to the press for publication. PROCLANATION-INDEPENDENCE DAY: --Presi ent uman's Proclamation, together with the official Proclamation of the Commonwealth of Mass., were sent to the Board by J. John Fox, Chief Secretary to the Governor, Paul Dever. DENNIS-S~gDOSKI MATTER: The oard voted to send a letter to Mrs. John Cole to meet with the Board on Friday, ?/6/51 at 1:30 P.M. if this is convenient for her. COM3~UNITY CENTER: ~that the community Center asked the Public Works Dept. for the use of their tractor and platform trailer to use in the parade.on July 3 but although they are willing to provide this, they do not want to be responsible for children riding on it. Mr. Coffin said that contacts have been made and he feels Aetna can do something for us alang this line. They will contact Mr. Coffin regarding this matter amd the Board left it to Mr. Coffin's Judgment to decide if the price were reasonable or not. JULY 6 1951: The Board of Selectmen met this day at 1:30 P.M. and weekly bills and payrolls w~re approved. SERDOWSKI ~TTE~: ~ectmen met with Mrs. John Cole to discuss her mother, Mrs. Serdowski. A detailed account of the meeting is in the folder in the front of the book. Mrs. Cole felt that she is able to care for her mother, who, in Mrs. Cole's opinion, is perfectly alright and. would' not hurt anyone. The Board decided that nothing.definite should be done a~ this time as Mrs. Cole would not consent to having her mother examined by a physician. PO'~ERFAILURE: ~id that Ray Jensen had complained of power loss on Green Street and Mass. Avenue yesterday (7/5/51). He stated that the power was off for about one half hour and there have been occasional repeated occurrences. The Board voted to checkwith the Lawrence Gas & Electric Company to find the reason for this power loss in the ~eighborhood of Green St. JULY 16, 1951: ~ meeting of the Board of Selectmen was held a% ?:00 P.M. with all members present. Weekly bills and payrolls were approved. NE~ ENGLAND TEL. & TEL.CO- LAWRENCE G & E CO: A petition.requesting permission to erec~ poles on the southerly side of Andover Street, at a poin't approximately 150 feet easterly from Chickering Road, I pole and to abandon ~wo existing poles, J.O. locations, was received. A hearing was set for.July30, 1951 at 7:30 P.M. EAWRENCE G & E CO: A notice received.that a 1000 lumen street light was installed on pole 2810 on Johnson Street, Calzetta property ar~ was turned on Jane 29,~1951. REVOLVER PERk~T: Application for permission to carry a revolver was granted to Charles R. McCubbin, 148 High St. Mr. McCubbin is a member of the local police department. LAWRENCE G & Notice received tha: the power failure in the ~icinity of Greef Street, which'occurred on July 5, 1951 was caused by a ~ree being blown'dow~acroms their lines on R~ilroad Ave, corner of Dewey St. Every effort possible will be made to restore service in such a case as this. INSURANCE: FLOAT ~T BATHING BEACH: A letter was received from the Public ~orks, ~. William B. Du~fy, Supt. ~with a bill attached for $94.30 from J. ~Ernest ;~il2er forrepairing fire damage to the. float at the bathing beach to be paid from the Contingent Fund. Mr. Duffy stated that~there is no item in the playground budget to take care of fire losses although this claim has been presented ~o Richard G. Whipple, Cha~rm~n, NJA. Insurauce Agents Association. The fire was on June 5,1951. Mr. Coffin is s till of the opinion tha~ the ~oat is covered in the insurance policy and he suggested that this bill be held in abeyance until we receive some notification from Mr. Whipple. Mr. ~hipple will be con~ac~ed by Mrs. Dearden in the near future. LAND COURT: Notice received notifying the board of the pendency in this Court of the petition of Edward ~. Saul for the registration of land in North Andover on Salem Turnpike. A copy of the citation issued in this case was enclosed. No action was taken.
