Benedict Perrons, 11 Harwood Street came before the board, to inform them that he had recently 'called at the Dept. of Public "orks office in' Boston and talked with Mr. Pine, relative to having curbstones on Mass. Ave~ between Green Street and ~averlay Park district. Mr.' Pine informed him that he felt that; the s tats would pay half of this expense if the town would agree to plough the road, and pay the other half. Mr. Perroune went on to say that children use this road four times daily going to and from school and the road is high in .the middle and cars have a tendency to ~all off the road. He felt that there should be a line. there to show where the s~reet ends. Mr. Thomson stated that it is very necessary to have.'something done and.he.was under the impression that the State took care of this work on a state highway. If it is found'necessary for the town to contribute'half of this expense, it will be necessary to have an article inserted in the town warrant. He informed Mr. Perrons that this board would keep this in,mind and will check with Boston to get the necessary information.. RESOLVE REQUESTED F~OM SEL~CTMEE~ Mr. ~dward W, Saul, 2037 Turnpike Street-appeared before 'the board to discuss the matter of obtaining a release or Resolve from the Selectmen for a piece of land on Turnpike Street, in order to get a clear title te his property. Mr. Saul stated that he obtained a permit to erect a gas s ration on the TUrnpike and his building extends five feet onto the abandoned road and which '.at one time was the turnpike and was previously owned by the County. The records go back to 1807 when this road was put 'through by the Essex Turnpike Cooperation and operated as a toll road, when it was. taken over as a County A%ad until 1902. After relocation -in 1902 when' the Selectmen petitioned the' County Commissioners for a new road, it was abandenod for the present tu~npik'e but the petition doesn't certify that that it .was actually ab .andonod although the. owners'gave up .their share 'of :the old road andit did not go back to the owners or'abutters. Mr; Saul stated that the Judge informed him at Land' Court that-he must get a Resolve from the Selectmen to the effect that this is not a public way and that it has been re-assessed to Mr. Saul and he pays the taxes on this.land. '. Mr. Coffin inquired if the persons who released this land. in 1902 received any money.and Mr. Saul stated that there was nothing mentioned about money. He said there ars some people who feel that. thcys~ill have the right of way there but he talked with Mr. Rea and. Mr. Arthur Farnum. Mr~ Coffin said that going:back to 1807, it is definite, t~atvthe then owners were paid and Mr.. Saul said they'.were. Mr; Thomson then.said that the town must have recognized Mr. SAul's Ownership when they taxed him and. once ~h~s .is completed it is the'best deed he. can get. He said he would be willing %0 enter into a "Resolve" but would first' like to check with the ~ssessors. '-. .... Mr..'Finnsran said he.would like to have this checked~with the assessors and suggested that,it be held:ovar for one week; Mr. Saul agreed to do this. OLD~ BURYING Mr.'~iAbbot Stevens- came 'before the board'to make a request that the~ashes of Miss Kate Stevens be interred .in the Old. Burying Ground, opposite the Kittredge .house on Academy Road. Mr. J~n-~P. Stevens, Admin. of Miss Steven's. estate has made this request to Mr. Abbot. Stevens. She took care of the.cemetery and had a deep interest in .it. He said he didn't believe that %here'had been any burials there since 1840, ,and the family,s idea.was to simplylbury the urn and erect, a stone. Mr. Thomson said he would have no'hesitancy in granting~this request and he felt that certainly no one would object to this. The board then voted unanimously to approve this request and take up this matter with the Board of Public WorkS' who has charge of 'the burying, ground, at this time. SCHOOL BUILDING ASSISTANCE COMMISSIONt A letter received stating that this office stands ~eady ~o process the. first payment of thestate construction grant on the Eittredge School project as soon as the requirements forcertlfication ha~e beem completed, which must be completed and in the above office before November 1, 19%1. The board' voted to accept this letter and receive payment provided all evidence is in order and requested that 'James Maker, treasurer, complete the requirements. DEPARTMENT OF PUBLIC UTILITIES: Notification received that a continued public hearing will be held on the petition of the Boston' and Maine Railroad for p~rmtssion to files schedules on less than statutory notice provid~2~~ for an increase of 66 2/3% 'in 46 ride monthly commutation tickets, pupils' 4~ ride monthly tickets amd 60 ride monthly tickets. Nearing will be held on October 2, 19%1 at 10:00 A.M. in the State House. Letter from Sentaor. John 1~. Ooddaire, .Jr. informing the board of this continued hearing and's~cating that he will be very pleased to present to the Commission on that date ~the views of this board, provided they cannot attend. The board voted to write to the Senator and ask. that he do this. The Board voted by majority ~o definitely oppose the increase and Mr. Coffin s tared he would oppose the increase in fars but he would ask the D.P.U. not %o grant any increase unless all facts and figures are in order. .. Notice received that a hearing ~;tll be held on October 8, 1951 a~2'~l~ P.~. in the State House on the petition of the .~ester Union Telegraph Co. for authority to increase their rates. No action taken~ by this .board. OPEN CELLARS: Chief McEee reported that he had received a call about the open cellars on BeaconHill Blvd. and he investigated and there was no w~ter there but the snow fence was broken and was dangerous. He reported this to the hoard as there was *nothing else he could do a~ this time. Mr. Arthur Lafrance came to the office to say that his daughter-in-law would try ~o fill in the open cellar and was also trying to dispose of the property. He asked if the Highway department could *use the bulldozer there and fill it in'with the ~11 already there. He ~ talk with Mr. Catty abOUt this matter. Noaction was taken by the.board at this time. D00',Wk~J~21TI John Dolan, dog officer returned his warrant which had been sent 'out:by the Selectmen, witnessed and signed under'oath. NOR~t A~D~?EN POLICE RELIEF ASSOCIATION: A* letter was received signed by David Roche, Secretary, with respect to any · legislation-which might come 'up with reference to providing .two officers in a police cruiser after dark, and asked 'for any support that this b. oard mi'ght be able~t~ give. _ . - - Mr.'~ ~omson stated that he knew' of no legislation .at this time but 'he would check~che matter and call it 'to the attention of the board at a later date. DOG/COMPLAINT= -: · ,.. .. John. Dolan.came before the board .to. discuss complaints he has 'had* about two dogs owned By Mrs. Mary,and Mrs. Nellie. Serdoski, of Ashland Street, ne said · the:dogs are a. nuisance and are vicious but he can't get near them as they are lockad in the house w~en-he ge~s down therel He said they bark at-autos .and 'one~ woman~was' bitten by. one of .the' dogs~ and they are. unlicensed., Ne asked the board if they would'h~ld a hearing and have these We ·women' come to the office. The board suggested that Mr. Dolan.present ~is complaint .in writing and then the board would take action on the complaint. ~e'dogs ~are, a mixed breed and are'black And white and'-both aremale dogs. Office informed, Mr. ~homson that the time had been extended to June 1, 1952' and Mr. :Carry was so notified.
