WAGON: ~ame in to the Board to inform them that she was Hostess of the Welcome Wagon which is a non-profit organization and they call on. all new families in the town and new babies, receive gifts from merchants and they carry free service of all the churches, organizations, library, public schools, e~c. and she wanted to get some kind of a greeting from the Selectmen. The Board voted unanimously to send her a letter. APPOINTMENT-AUCTIONEER: -; _ney '--a was appo -ed auctioneer for one night, October 5, 1951, a~ the North Andover Grange. No fee. RESOLUTION RE SAUL'S PROPERTY: Mr. Saul, cane in with reference to a resolution from the Board of Selectmen relative to his share of the old road known as Turnpike Road which abuts his property, and for which he has paid taxes. The Board voted unanimously to give Mr. Saul a resolution to the effect that this road has not be used for twenty years or m~re and~ the assessors, and tax collector,s records show that one half of .this parcel of land was assessed to Edward W. Saul and that he has paid taxes thereon for 1950 and. 1951. This resolution was adopted and spread on the records of the Board of Selec~m~n on October 1, 1951. DOG HEARING: A dog hearing was held at 7:4~ P.M. on the written complaint from John Dolan, Dog Officer, relative'to ~wo male dogs, owned by 'Mrs. Nellie Serdoski and Miss. Mary Serdoski. The complaint states that the dogs are vicious and chase people walking along, the sidewalk, bark at and chase automobiles and co~plaints have been received from several people using this street. Written notice was .sent to the Serdoskis who failed to "appear at ~the hear- ing. As required under Chapter l~?,cSection 140 of the General Laws, Mr1; .ihomsun ad- ministered the oath to the .complainants. Mrs. Evsrson then. stated tha~. the dogs run behind her and bark amd she is afraid they migh.t bite her and she is very nervous. The dogs bark all .the time and are nearly always on the street. She stated that one dog was taken away yester$ay, September 30. The last occasion she was bothered by the dogs was Friday or Saturday of the past week. Mrs. McKnight, 14 Ashland Street, stated that about a week ago, she called at Mrs.'~ Counors house and one dog was in front of her and one in back and they kept going after her and she was very nervous. "Puppy" kept after her. She is hard of hearing and isnot disturbed by the barking. She said,they~chane hand cars on. the tracks. "Puppy". is really not a puppy, he is over a year. old and the other one is called "Dukie." Mrs. Sipsey stated tha~ she was speaking for Mrs. Coenors who was unable to be here. and "they have.some sheeting at- their property~which has been torn off by the dogs. She said the dogs did bark quite, a bit at night but Eva Cole took one dog awmy. Mr. Thomson inquired if she were. bothered by the dogs but she stated that they knew her and. did not bother her but they are half starved and are not fed properly. They have been brought up wild.and they. dun:t'get the right care. They do bark at automobiles, children on bicycles and hand cars. Mr. Theodore Pelczar of 12 Ferry Street stated that his mother-in-law cane to visit and she.was nipped by the dog but the.re were no complications. Ne has two daughters, .age-? and 6, who are afraid of the dogs and have to go all the way around Ashland Street in order .to play with their friends. He didn't 'know which dog bit his mother-in-law bu.t onseveral occasions, .,Pupl~j~.,- growled" and' fo1.1 owed. them but. did. not bite. Mr.-Dolan stated. 'that this type .of.dog-.ia-~ll~-.right. if'it is alone 'out the question is if someone is hurt, what are we going to do' about it? He said the dog chased his son 'but 'did.not bit him.but some. elderly person or.-child could-bo hurt. ~ He said the dogs are out all night and chase automobiles; Mr. 'Thomson asked'if he thought it was,more .humanitarian to dispose of the dogs since you 'can.t tadk with. anyone 'there. Mr. Dolan said he went down but couldn.t get anyshere with them and he thinks the dogs will end up in the gas box. Zt is his.opiniou that these dogs will get worse. He said one dog-is away and we don't wan~ it brought back. However, there is no proof .of~ this. He :said neither · dog is licensed and some action should be taken. Mr. Finneran suggested that it be taken under advisement and Mr. Dolan'will be notified as to the action taken. Later, the ,BCard 'discussed this complaint and Mr. Thomson stated that the purport ..... of the order should be the viciousness of the dogs and. have ,them restrained to the premises. If the dogs are not restrained,- action will be taken. Mr. Finneran sta.ted. that John Dolan"very, seldom 'makes a complaint about'a dog and he-must be concerned about this .one.. Mr.' Coffin. agreed that the dogs should be .restrained; Mr.: Coffin then made a motion that these '~wo male doge of mixed 'breed, black- and white, unlicensed, known as "Puppy, and "Dukie" kept or owned by Nellie and Mary Serdoski of 40~Ashland Street, be declared a nuisance because of their vicious disposition, barking and other disturbances. After hearing held because of the written complaint by John Dolan, the Selectmen hereby order these dogs permanently restrained on their premises by the owners or keepers. The Serdoskis will be notified of their right to appeal to. the District Court within ten days. OCTORERI,' Ig~I' ('continued)' T~EE RENO?AL REQUEST: Roger Wentworth 'requested the remsval~ 'of a tree in front of his property at 57 Second Street. This is a large~ old Swamp ~agle which is in the middle of his driveway. The Board voted to refer this to the Tree Warden for investigation, posting and hearing. Mr. Conners .che. cked this location and advised that tho tree should be removed and a hearing was set for October 1%, 1951 at 7.:25 P.M. ~MP~'INT BY EJI~DI~G INspEO~R: Wllllam F.-Wood, ~Mass. Avenue, came before the Board to say that he had .been advised. by the B,,~lding Inspector, that a complaint had been received about the greenhouse on Bay State P~ad and he wo, l~ like to knew more about it. Mr. Thomson stated that several days ago, he had r. eceived a telephone call to the effect that' a b~,~l~ing had been erected j n Bay State Road and 'no permit' had been issued and. he advised the person to take. it ~aint wf~,~ : g ture there. The nature .of the com- ~ that it was to be-a greenhouse not a tool shed and Mr. Thomson talked with Mr. Wood and ~told him to see the Board of Appeals. Mr. Uood presented the permit which def~tely,~tated that it'was for a shed and a greenhouse.~ Mr. ~fomd said there is · no greenhouse there new, Just the 'building which could easily be turned into a two- room cottage. He,said at 'the present time the greenhouse is a' hobby but if he de- .cides to make it into a business, he will go to the Board of Appeals. He said tha~ accsrding to the map, it is strictly residential area but inasmuch, as he has a permit to build, he presumes it. is okay for him .to goI ahead amd[put up ,the building. He said if he plans to go ahead, he will go before the Board of Appeals.' Mr. Thomson stated that there was nothing.to restrict the building, of 1 a greenhouse. Mr..Wood then stated that all abutters were in agreement with-the contents of .the, 'building. permit', but apparently'th~ complainant is.worried-about it.
