The meeting adjourned at 5:30 p.m. upon vote of Mr. Finneran, seconded by Mr. S~tcliffe,
and voted unanimously.
PRECINCT WORKERS:
Upon motion of Mr. Sutcliffe, seconded by Mr. Finneran, the Salecmnen's meeting was
reopened to discuss pay rates for precinct workers. After discussion, Mr. Finnaran
made a motion that the workers who are on duty from 7:00 a.m. to 7:00 p.m. receive
the existing rate of $15.00, Clerks will receive $17.00, and the Warden, $35.00. The
counters who work from 7:00 p.m. on should receive the existing ra~e of $15.00, as
they still have to do the same amount of work as in the pas~. Mr. Sutcliffe seconded
the motion, and it was voted unanimously.
The meeting adjourned once again at 5:45 p.m.
September 19, 1960
The regular meeting of the Board of Selectmen was held at 7:30 p.m. with the ~ol-
lowing members present: Chairman Ralph E. Finck, William A. Finneran, and Philip
Sutcliffe. No meeting was held last week due to the hurricane, although the
selectmen came in to sign the warrant.
HEARING: Tree Removal Petition
John J. Connors. Tree Warden. was present and recommended the removal of a tree,
on the petition of Elizabeth Doran, 20 Hedges Street. Tree had been duly posted.
Mr. Finneran motioned that the tree be removed, seconded by Mr. Sutcliffe, and
voted unanimously.
CONPLAINT:
Mr. Connors said that a resident of Woodstock Street had requested two pine rmees
be removed, but said ~rees cannot be removed by the Town unless it is an accepted
street. The Board recommended Mr. Connors speak to the Planning Board.
COMPLAINT:
Mr. William Reddy, Park Street, appeared to complain that because of a broken pipe
and improper repair of a basis, his driveway wes being undermined. Ira Carry,
Highway Surveyor, was present and said that the Board of PublicWorks was responsi-
ble for the situation, not having pu~ the street back in repair when a pike was
installed. The Board requested Mr. Car~y remedy the situation, and they were
assured that he would.
tANTERN COP3. BONDS:
A letter was received from Town Counsel Salisbury commen~ing on the return of the
Lantern Corporation bonds which he said could be returned to the Lantern Corporation.
A letter stating same was sent on September 13, 1960, by this Board to the Planning
Board. Mr. Ashton Smith is now owner of property and he would be liable for any
nuisance or damage that might arise. '
HOUSING AU~HORITy:
A copy of an "Amendment to Contract for Financial Assistance" was received from the
No. Andover Housing Authority. Said copy was placed on file.
JOINT POLE LOCATION:
A Joint Pole Location petition was unanimously voted upon, motioned by Mr. Finneran
and seconded by Mr. Sutcliffe. Location is Pleasant Street, from Davis S~eet,
westerly, 1 pole and remove 1 pole. No public hearing is necessary.
NE~YFLAG:
Town Clerk John J. Lyons appeared before the Board requesting permission ~o pur-
chase a new 50-star American Flag for Memorial Park behind the library, a~ a
price of $25.00 and the Selectmen were unanimous!yin favor of said purchase.

BALLOT BOX QUESTION:
Mr. Lyons asked the selectmen if they would support him and the Board of
Registrars in~ voting for the repeal of the Ballot Box question. Mr. Finneran
made a motion that they would, seconded by Mr. Sutcliffe, and voted unanimously.
OUTDOOR ADVERTISING SIGN:
An Application for Permit to locate an outdoor advertising sign from the Communi-
cation Workers of America, A.F. of L., C.I.O., on Osgood Street adjacent tonew
Holt Road, was referred to the Building Inspector on September 13, 1960. No
bond is required for said sign.
BOARD OF APPFALSNOTICE - MOTEL HEARING:
A notice from the Board of Appeals was received regarding a hearing on the varia-
tion of Sec. 4, Pera. 4.5 of the Zoning By Law so as to permit the erection of
a motel at theSoutheast ~fde of Peters Street by Arthur Corey. ~
CHAPTER go CONTRACT:
Contract No. 19391, covering work to be done on Dale Street. was received from
the Mass. Department of Public Works. ·
ESTIMATES - cEAPTER90:
Three estimates to be paid to contractor E.V. DelDuca Construction Co. were
received as follows: #18779 for $1,000.00; #18272 for $1,300.00; and #17560 for
$1,000.O0. Mr. Sutcliffe agreed with the other members that the bills should be
paid to Mr. DelDuca but believed that the dangerous corner at Appleton and Dale
Streets should be properly marked as a danger spot. Mr. Finck is meeting~with
Mr. Wilkins and Mr. De!Duca on September 21, 1960, at 1:30 p.m. with reference
to straightening out that particular corner. Mr. Sutcliffe suggested that
temporary warning signals be installed until the corner 'is fixed before something
does occur. Mr. Finneran stated that he had seen Mr. MacWilliams on the Dale
Street job. He stated that the $14,000.00 left in Chapter 90 could not be
legally spent on Appleton Street but suggested that a $30,000.00 grant be asked
for in November and incorporate it in Appleton end Dale Street. Chairman Finck
said that Mr. DelDuca is not under obligation to ge any farther than the c.orner
this year. Mr. Finneran suggested the Board organize its request for next year
in the meantime. Mr. S~tcliffe made a motion that the invoices be paid, seconded
byMr. Finneran, end voted unanimously.
WOODSTOCK STREET:
Residents of Woodstock Street appeared with reference to the resurfacing of.the
upper part of Woodstock Street. It is the jurisdiction of the Planning Board
in instructing the Town Counsel to take the available money in the mnount of
$2,;,42.00 to use 'in resurfaning the road. Woodstock Street has been taken care
of by Town Counsel and the money can be used to resurface that street. Bids'for
resurfacimg the upper part of Woodstock Street are due to be called for in the
near f~ture.
PRECINCT WORKERS:
Messrs. Raymond Broadhead and Leonard Wtndle appeared requesting lists of Precinct
Workers be sent to John Willis and Leonard Windle.
DINER PROBLEM - SUTTON STREET:
Charles Foster, Robert Burke and Chairman Daniel O'Learyof the Board of Appeals,
William Chepulis and Norman Hughes appeared before theBuard about Keeler's
Restaurant at the corner of Osgood Street and Old Clarke Road not being built
according to the approval of theBoard of Appeals. Robert Burke thought it was
under the jurisdiction of the selectmen. Chairman Finck said he had contacted
the Building Inspector and requested the work stopped until the situation was
cleared up. A meeting was held and To~m Counsel, the Contractor, opposing counsel
and Chairman Finck were present. The plan submitted to the Board of Appeals
conformed to the ByLaws as set forth, and the new structure was to be 40' x 60'
at an approximate cost of $4~,O00.O0. Now it seems that the old diner is to
be put in as a kitchen only. Chairman Finck assumed that after consultation with
~the Planning Board that the matter was straightened out. Mr. O'Leary said that
no percolation tests have been taken an6 that the Board of Health issued no
.permit. Mr. Chepulis believed there have bean two violations--excavation beyond
·the lot 'line and no permit from the Board of Health. Mr. Foster pointed ou~
that the dimensions now are different and contrary to the site plan preview, and
that the old diner was not mentioned previously. Chairman Finck also thought the
matter had been discussed between Town Counsel and Mr. O'Leary. The Board of
Selectmen can only enforce the by law in Equity in the 'Sup~i6~ Cou~t." .~-
In the initial stage where the building permit is granted or revoked, the Board
of Selectmen has no Jurisdiction. The Board can turn'it over to the Town Counsel

to take whatever action necessary. Mr. Chepulis wanted to know if Town Counsel's
opinion was in writing. If work is not stopped by the Building Inspector again,
the matter will have to be put in Town Counsel's hands to get a bill in equity.
Messrs. O'Leary, Burke and Foster agreed that there is a violation if building is
not in accordance with the plans. It was agreed that a meeting should be held
whereby Town Counsel, Building Inspector~ Board of Appeals, Board of Health
Chairman, and the selectmen would discuss the situation, September 26, 1960.
D.P.W. CONFERENCE - MASS~ AVE. DRAINAGE:
State Engineer Herrick appeared before the Board, as did Ralph Brasseur, C.g., and
the purpose of Mr. Herrick's visit was to discuss the proposed drainage on Mass.
Avenue down to Mr. Dubois' and Mr. Giard's property, taking $ 300-foot strip, 25
feet wide, drainage to be absorbed by the ground. There would be no problem to
Woodstock Street, Wood Lane, e~c. Mr. Herrick said that for some years, this
drainage problem on Mass. Avenue has been considered by the State. It has resulted
from a number of complaints from residents along Mass. Avenue as there is inadequate
drainage ~he entire t~ngth of Mass. Avenue. There are no catch basins with the
exception of two on the right. Funds are not available to do the entire area, but
at the moment, the State could go approximately 1,500 feet bringing them down past
Woodstock Street. The State Engineer said that the only place to dispose of the
water was in the pasture land of Mr. Giard, off Mass. Avenue. He stated that where
there is no adequate disposal area, such as a brook or river, that such procedure
iS taken such as draining into pasture land. At first the State believed the land .
would not be too expensive, but with the possibility of the pasture land being
developed into house lots, it woulc~ be too expensive for the State to purchase.
Thus, for the time being until further funds are available to extend the drains,
the system w'zll have to be sealed. The State Engineer hoped that next year more
funds would be available and in larger quantities. Chairman Finck said that an
overall plan has never been ~submitted to the Town and would like the State to do
so. Chairmen Finck said that if it had n~t been for the proposed taking, the Town
would not have known about the situation. Mr. Herrtck agreed that it would probably
have been better if the State had consulted with the Town first. Howave~, he said
that the 9ork done in said area will not be wasted. The District Engineer will
recommend to the State that they abandon this area as it will be too costly. Atty.
Fernen~ A. Bernardin, representing Nazaire Giard, appeared but did no~ presen~ his
argument about the lend taking as thB State Engineer had stated it would probably
no~ take place. The following residents were present: Anthony Dubois, Morton Panish,
Mr. end Mrs. William B. Drisco!l, Augustive Hit!se, Mr. and Mrs. Raymond B. Zahn, Jr.,
Mr. and Mrs. Joseph Giard, Emile Giard, Philip DeMarco, Nazaire Giard, James Roche,
Clara Kypriotis, Mrs. William Hibbits and Andrew Donohue.
LAWP~NCE GAS COMPANY:
A letter from the Gas Company was read by the Chairmen whereby it acknowledged our
recen~ letter regarding Mr. William Duffy's Recommendations on future petitions
for gas excavations. The Lawrence Gas Company will conform to said recommendations
in the future.
BLUE CROSS -BLUE SHIELD:
Approval was given by the Advisory Board for a transfer of $300.00 from the Reserve
Account ko the Group Insurance Account to make up the difference needed for the new
increased coverage plan from $14.00 to $20.00 a day, effective November 1, 1960.
On September 16. 1960, an emergency vote was taken whereby the selectmen unanimously
approved the increase in coverage and a letter stating same was sent to the Town
Treasurer.
TWO - WAY RADIO: Highway Department
A co~m,,,nication ~ms received from Civil Defense stating that a mobile two-way radio
~-as available to be installed in a Highway Department pick-up truck. Board was
informed that the radio has already been inst~led in said truck.
MF~O - CIVIL DEFENSE:
A memo was received from Civil Defense regarding the reorganization of the
Auxiliary Police.
V.F.W. - Bathing Beach:
An invitation was received from the V.F.W. asking the Selectmen to attend a meeting
to be held Thursday, September 22nd for the purpose of discussing plans for the
improvement of the North Andover bathing beach. Chairmen Finck will attend end
Mr. Sutcliffe said he would make every effort to attend.

STREET LI~TING SURVEYS:
Mr. Sutcliffe mede e motion that street lighting surveys be conducted at 58 Linden
Avenue and at the corner of Herrick and Buckingham Roads, seconded by Mr. Finneran
and voted unanimously.
WOODSTOCK STREET:
In a letter from Town Counsel Salisbury, it was stated that a check in the amount
of $2,442.00 has been sent to the Town Treasurer in order for the Highway Department
to resurface Woodstock Street. Also, a check has been sent to the Town Treasurer
for a bill submitted May 17, 1960, for capping catch basins and pumping cellar on
Woodstock Street.
JI~4Y FU~D:
Officer Lanni is to collect for the Jimmy F~nd this week from the Town Employees
and add the amount to a sum of about $30.00 which was collected during the
July 4th celebration.
A.B. SUTHERLAND OPeN HOUSE:
Invitations were received by the selectmen to attend an Open House Dedication at
A.B. S~therland's next Monday night, but the Board voted to send a letter express-
ing its regre~s at not being able to attend.
PRECINCT WORKER:
Mr. Satcliffe motioned that Evelyn A. Reilly, 17 Dana Street, be appointed a spare
worker in Precinct 3, seconded by Mr. Finneran and voted unamimously~
SPECIAL POLICE OFFICER:
Mr. Sutctiffe made a motion that the name of Palmer Long as s Special Police~Officer
be referred to the Police Chief for investigation: seconded by Mr. Finneran and
voted unanimously.
DALE STREET:
Mr. Sutcliffe suggested ~bat a guard rail be installed where the berm is located
on Dale Street and that Chairman Finck mention it to Mr. DelDuca, contractor, when
they hold a meeting on Wednesday, September 21st with Mr. Wilkins, county engineer.

September 26, 1960
The regular meeting of the Board of Selectmen was held on this date at 7:30 p.m.,
with all members present and Chairman Finck presiding.
Chairman of the North Andover Democratic Committee issued an invitation to the Board
to meet Sec. of State Joseph Ward, Democratic candidate for Governor, at the Lawrence
Airport about noontime on September 3Otb, giving the route over which the gubernatorial
candidate will travel, and requesting a police escort.
PROCLAMATION:
.Mr. Delehanty of Johnson & Johnson appeared before the Board explaining a proclamation
he wished endorsed by the Board regarding "Emergencies Don't Wait Week' during the
week of October 8, 1960. Said document wes endorsed by the Board and signed by
the Chairman.
JOINT POLE LOCATION:
Upon motion ofMr. Finneran, seconded by Mr. Sutcliffe, the petition ofthe
Merrimack-Essex Electric Company end New England Tel. & Tel. Co. was unanimously
approved for Joint Pole Relocation at Chadwick Street, approximately 263 feet east
of Moody Street. No public hearing is necessary.

Street lights have been installed on Chestnut Street, Middlesex Street, and Osgood
Street byMerrimack-Essex Electric Co.
