AIRPORT CC~ISSION REPORT:
A report from Thaddeus Zimny was received regarding the Airport Commission
meeting of September 26, 1960.
SPAREWORKER:
Upon motion of Mr. Finneran, seconded by Mr. Sutcliffe, and voted unanimously,
Charles McKinnon of 334 Osgood Street was appointed a Spare Worker in Precinct 4.
FIRE STATION STUDY COMNITTEE:
Upon motion of Mr. Sutcliffe, seconded by Mr. Pinneran, John Detora of 318 Turnpike
Street was appointed to the Fire Station Study Committee due to the resignation
of Fire Chief James P. Daw.
The meeting adjourned at 9:55 p.m. upon motion of~. Finnersn, seconded by
Mr. Sutcliffe, and voted unanimously.

October 17, 1960
The regular meeting of the Board of Selectmen was held October 17, 1960, at
7:30 p.m. with all mombers present and Chairman Finck presiding.
HEARING: Tree Removal Petition
A hearing was held on the Tree Removal Petition of Joseph DePasco, 412 Salem Street,
for removal of three trees. Tree Warden John J. Connors was present and said that
the trees had been properly posted and recommended removal of said trees. Mr.
Finneran motioned that said trees be removed, seconded by Mr. Sutcli~fe, and voted
unanimously.
HEARING: JointPole Location
It was unanimouslyvoted to approve the Joint Pole Petition of NewEngland Tel. &
Tel. 0o.~and Merrimack-Essex Electric Co., (location at New Clark Street, from
approximately 3430 feet hottest of Osgood Street, northwssterly 2 poles) upon
motion of Mr. Finneran, seconded byMr. SutcLiffe.
HEARING: Joint Pole Location
It was unanimously voted to approve the Joint Pole Petition of New England Tel. &
Tel. ¢o. and Merrimack-Essex Electric Co., (location at Andover Street, at corner
of 'Carty. Circle, 1 pole) upon motiom of Mr. Finneran and seconded by Mr. Suteliffe.
COMPLAINT:
Mr. and Mrs. Claude Howard of Johnson Street appeared, with others, to register
a complaint about the building of houses on Mark Street by John ~hields, Sherwood
Homes. They stated that no hearing was held and no abutters notified by the
Planning Board. They also said that the Planning Board had voted on the matter
on June 6, 1960, but that the plan was no~ filed until August 1, 1960. Upon
motion of Mr. Sutcliffe, seconded by Mr. Finnaran, it was voted to ask the Town
Counsel to submit a report in chronological order as to what has taken place in
said' proceedings since permission was given on June 6, 1960, by the Plaenihg Board.
Report from Town Counsel was requested by the next meeting of this Board.
HEAErNG: Aquatic Club
A group of No. Andover High School boys appeared and also Dewey Dyer, Civilian
Defense Director, Fire Chief James P. Daw, and Pole Chief Joseph W. Lawlor, to
discuss the formation of an Aquatic Club--i.e. Skin Diver's Club. Chief Daw said
that skin diving was the best method for recovering bodies. Ail agreed that skin
divers should be covered for liability. After discussion, Mr. Dyer suggested the
boys organize the group and appoint a chairman, after which he and the chairman
can work out the details and report back to this Board.
CO~.~LAINT:
Mr. William SomerviEe appeared before the Board with a complaint that building was
going on adjacent to his property and that the distance between houses was less

than 10 feet. Chairman Finck stated that on village residential, the distance
should be 15 feet, but that with s variance, it could be within 10 feet. The
Board referred Mr. Somerville to the Building Inspector about this problem.
INTERSECTION - Dale and Appleton Streets:
Mr. Ashton Smith perused the plans submitted by the Mass. D.P.W. for the inter-
section of Dale and Appleton Streets and stated th'.t he would not agree to the
proposed changes. Chairman Finck suggested that he meet on Wednesday, October
19, 1960, at 2:00 p.m. with him, Foreman Walter Stamp of the Highway Department,
Mr. Wilkins and Mr. Sears of the D.P .W., and Chief Lawlor to discuss same.
CONPLAINTS- Town Infirmary:
Mr. Orin Foster, Sup't. of the Town Infirmary, appeared with various problems
including the repairs needed on the t~uck, boiler, leaky toilet, etc. Chairman
Flnck suggested 'that Mr. Foster submit his requests and complaints to Mr. Guorge
Wilson, Welfare Agent.
LAWRenCE GAS C0~PANY:
An excavation petition submitted by the Lawrence Gas Company was approved upon
motion of Mr. Finneran, seconded By Mr. Sutcliffe, and voted unanimously upon
the condition that Police protection he afforded, as per recommendation of Chief
Lawlor.
MERRIMACK-ESSEX ELECTRIC COMPANY:
A letter was received from Merrimack-Essex Electric Company regarding the recant
installation of lumen mercury vapor street lights on Linden Avenue and at the
corner of Herrick and Buckingham Roads. Changes were made October 5, 1960.
ANTI-TRUST SDIT:
A letter was received from Town Counsel Salisbury, along with a form letter from
the Attorney 0eneral and a copy.of complaint filed by the Town of North Andover.
Letter was read by the Chairman who stated that it was actually a suit brought the
Federal Government against asphalt companies. If said suit had not been filed
by Monday morning, it would have been impossible for the Town to collect .damages
which could amount to three times the actual amount. ~e suit came about
through price fixing conspiracies and rigging of bids in the sale of asphalt,
tar and bituminous concrete to the Commonwealth and its political su~divisious
including cities and towns.
LIC~SE - Storage of Gasoline:
An applicatipn for the storage of 1,000 gallons of gasoline underground, has been
submitted by Davis a Furber Machine Co. A hearing was set for October 31, .r~,
at 7:30 p.m., and referred to Fire Chief Daw upon motion of Mr. Finneran, seconded
by Mr. Sutcliffe, and voted unanimously.
CER~CATE OF INSD~ANCE: .
Upon motion of Mr. Finneran, seconded by Mr. Sutcliffe, and voted unanimously, a
Certt~icata cf Insurance covering liability for a sign located at 18 Waverly Road,
North Andover for Robert Preston, d/b/a/ Seafood & Sandwich Shop was placed on.~file.
A letter of appreciation was received from the director of the "Jimmy" Fund,
thanking the Board for the check received recently. Collections had been handled'
by the Police Department.
LETTER OF APPRECIATION:
A letter of appreciation was received from John J. Willis, on behalf of the
No. Andover Democratic Town Committee thanking the Selectmen for the excellent
co-oPeration given to the Committee during the recent visit of gubernatorial
candidate Joseph D. Ward.
F.B.I. TRAINING SCHOOL:
A complimentary letter was received from the F.B.I. commending Patrolman E~ward T.
Sullivan upon his fine performance at the F.B.I. Firearms Instructors Training
School held September 19-23, 1960, at Camp Curtis Guild, Wakefield, Massachusetts.
JOINT POLE LOCATION:
A petition for Joint Pole Location at Longwoed Avenue, from appro~imat~y 846 feet
southwest of Chestnut Street, southwesterly, 1 pole, was submitted by the New Eng.
Tel. & Tel. Co. and Merrimack-Essex Electric Co. Upon motion of Mr. Sutcliffe,
seconded by Mr. Finneran, hearing was set for October 31~ 1960, at 7:30 p.m.
