Heggarty, P~serve Police Officer, approved by Chief McKee. The Board voted unanimously to grant this license. BOOSTERS CLUB: A letter was received from Harold W. Trombty thanking the board for their kindness and coo~era'~ion while he was presiden~ of this Club. He hoped that they would continue to give the same cooperation to the new Pre. siden% William McEvoy. DAMAGE CLAIM: A claim for damages to a car owned by Herbert Vickery w.as received by ~the board. Mr. Vickery claimed that. onNB~ember.~r 2, he was travellmng o.n Mass~ ~' at 9:45 [] A.M. and there was a ditch about 9 inches deep and 18 inches wide and when he struckw the ditch his car was damaged and he had to take itto Arsenault,~ Garage. He said there ,were n'o'lig~ts or other warnihg and he immediately reported this to the police as it could cause a very serious accident. Mr. Vickery asked that he 'be reimbursed for the cost of repairing his car. The amount had not been stated andtthis will be checked with Mr. Arsenault. Mr.' ~homson suggested that,the claimant be referred ~o the Depa=tment 'o£ Public Works as this is a s~ame highway. Mr. ~illieh~n reported that he had talked with 'Mr."Morris at the Lawrence Gas Co. about these excavations which are not properly filled in. Mr. Norris.1 assured him . - that h.e will tek~e care of t ~his.in the future and.m~e a point 0f.'.repairing the road:. proper.y. He will also check v~ith the State about Mass. POLICE RELIEF A$SOCIATZON- POLICE VACATIONS: ' ~ ' In' reply/~o.a,letter t o the Chief of Polic'e and' ~o th~ Po~.li~; Relief Associ.ation · under' date of'10/27/1953, a letter was~received :from>'th~ .olice Eelief Assoczation, · relative to vacations for' newly appointed officers. Tn Substamce, the .Police Relief ~ Association s~ated that it was the considered opinion of the membership that, an officer who is appointed as a regular full time member' of our Department, should be granted a seven day vacation with pay in. the fiscal year of his appointment. ~hey further stated that a Reserve Officer who. is full time employed an a substitute for a Regular .Officer who is on leave of absence, due to a sicknessof:protracted duration, injuries received in line of duty, or a temporary leave of absence granted by the Selectmen, or for a Re~mlar Officer who has been called into themilitary service should be granted the same duration of vacation with pay, as is allowed annually to.a Regular Officer. ' .387' NOVEMBER. 30, 1953- continued POLICE VACATIONS FOR N~LY APPOINTED OFFICERS: Chief McKee sent a letter along with the letter from the Police Relief Associa- tion and he stated that he was inclined to .go along with the policy presented ~by the Selectmen by which policy each man would be treated fairly. He stated that the month of appointment cannon be determined by anyone .in advance and would depend on circumstances effecting the appointment of a new officer. Chief McKee further stated that he did not feel that a Reserve Officer should be considered for a vacation even though he is employed as'& substitute..until he has worked one full year and special consideration could be given to him at that time. · Mr. Thomson stated that he felt it was impractical to consider seven day vacation due to appropriations, and whether a Reserve officer is serving a long time is of no consequence at this moment.. He said he would be a little inclined to go along with the plan of the Selectmen and Chief McKee. He said that he would make ~ motion' that Article 26 of the Police ]~les and Regulations be' amended so as to read: Every officer may be allowed fourteen days vacation in each f~nan- cial year without loss of pay except that he shall not receive a vacation in the year in which he is appointed. Mr. Kirk. seconded this motion and the -vote was .declared to be unanimous. HEARING; CHAPTER llSA Notice received that a public' hearing will be' held on December 18, 1953 at. 2:00 · P.M. at the State house, Room 480, with respec~ ~o the supervision of the~program of Old Age Assistance administered by the cities and towns of the Commonwealth. Copies of.~ the current rule 3. of the Department for supervising the program of Old Age Assistance and the proposed rule 3 of the Department are enclosedJ. With the adoption of the proposed rule, the cur~en~ rule 3 will be revoked. ~he board that Mrs. Dearden should attend this hearing. GAS RANGE-CENTER SCHOOL: .Mr. %'[illis s teted that Calvin Snsll had requested a gas range which is in the Center School and could be used in the fire station. Mr. Kirk'made am0tion " that the request be granted and that Mri~ SneLl be allowed to take the old gas , range from the Center School for use in ~tbe Fire Station. Mr. Thomson seconded the motion and vote. wms unanimous. ,*L~_WR~NCE GAS .CO~ANY: ' - ' . · .:, ' ' ' ~: · With .further reference tO requests made for permission to-excavate by this company a~d after discussion relative to' various complaints, about':the excavations 'not properly filled, in, Mr. Thomson made a motion that in 'the .future.when permission is granted %o excavate on any public way in · North Andover, subject to' approval of the Board of Selectmen, approval may be granted subject to the ~condition that the petitioner~ wiLl" hold the town harmless from any and alt Claims for'damages resulting from such excavations. Mr. Kirk seconded, this 'motion and vote was ~.~ unanimous.. Letter will be sent to the Lawrence Gas Co. to'this'effect. DECEMBER 7, 1953: : · ~y meeting of the Board of Selectmen was held at 7:30 .p.M..~with' all members present. Weekly bills and payrolls were approved. · HEARING- LAWRENCE G & E CO: N~N ENGLAND TEL.-& 2EL.CO: A hearing was held at 7:35 P.M. on the petition of the above companies fo~' to locate poles, wires,~ cables and fixtures on Osgood Street, opposite Harkaway Road, 1 pole. ~Abut~ers were notified and no opposition .was presented. Mr. Barry and' Mr. Flanagan representatives of the above companies were present. Mr. Kirk ~made a motion that the petition be granted and the board voted unanimously to do this · BOARD OF APPEALS-MO~EL CASE' Due to the illness of Attorney Elwyn King, the Board of Selectmen voted unanimously that Attorney Arnold Salisbury be engaged to continue the matter of the Motel Case for the Board of Appeals, this vote made with the accord of the Board of Appeals. APPOINT ~&ECTRICAL ZNSPECTOR: Due to the absence of ~homas Lebel who is on vacation, the board appointed John J. Thompson, Appleton Str.ee~ as Wiring Inspector pro ~em at $10.00 weekly until the Wiring Inspector re~urns. This money will be paid from the expense appropriation. OLD SEWING NACHINES: FIRE STATION: ~he board voted unanimously %o authorize the fireman to dispose of the old sewing machines stored in the fire station as they are of no use and the firemen would like.to have the space for their own use. INVITATION: The board received an invitation ~o attend the Dedication and Open House of the Lawrence Experiment Station on December 15, a~ 2:30 P.N.
