' 4O4 JOSEPH P. MCGARRY ET ALS VERSUS TOWN OF 'NORTH ANDOVER ?he Board discussed this matter with Mr. El~yn King since th~ ~abter had been referred to him in January 1953. Mr. King did not wish to take this case over and Mr. Willis made amotion that the matter be referred to Charles Trembly, Atty. for an answer. Mr. Thomson made a notion that the matter be referred to Atty.~ Arnold H. Salisbury which was seconded by Mr. Kirk and declared to be a majority vote with Mr. Willis not voting. TREE REMOVAL REQUESTS: Fred Hilton, 284 Middlesex St. requested the removal of a .-tree in front of his property. The roots have pushed up the retaining wall and. the ~tree .causes dampness. Mr. Coanors recommends that the tree.be removed. A hearing will be held on February. 1, 1954 on this petition. refer this petition to the tree warden for posting and hearing.. Gordon T~mmons, 203 Dale Street requested a tree to be removed from tnsfront of his property and states that he is building a 'house and the tree interferes with the excavating. Mr. Conners -recommends that it .be removed. 'Mr. ~homson made 'a motion that the matter be referred to 'the tree warden for'posting and a hearing and the vote was unanimous. · A hearing will be held on February 1, at '7:30. P:M. .... DEPARTMENT OF PUBLIC WORKS A,carbon copy of an order for work done ~nder Chapter 90 of the General 'Laws was received. GENERAL RELEASES: Releases were received from William Nelson, 16 Longwood Ave. in consideration of a settlement in the amoun~ of $9.50 for damage to his car caused by a hole in the road and from Herbert Vickery, 400 Great Pond Road ~ in the amount of $28.59 for damage to his car caused from the same hole in Mass. Ave.
