The meeting was called to order at 7:25 p.m.
Members Present
Richard Nardella, Chairman, Joseph Mahoney, Vice Chairman, Richard
Rowen, Clerk and John Daghlian. John Simons arrived at 8:15 p.m.
Also present were Kathleen Bradley Colwell, Town Planner and Karen
Nelson, Director of Planning and Community Development.

Ms. Colwell to copy everything in Coventry bond file regarding the
electric bill and send it to Ms. Cheryl Banks at Kopelman and
Paige, per Mr. Nardella's discussion.
Mr. Nardellaquestioned as to why Mezza Luna did not need to appear
before the Planning Board for Site Plan Review.
Mr. Robert Nicetta stated that as Code Enforcement officer, he made
a determination that it did not need to go before the Planning
Board for Site Plan Review because it did not fall under any of the
elements of Site Plan Review. One commercial use is replacing
another. Suggests Planning Board clarify bylaw. The applicant
went before the Technical Review Committee.
Mr. Nardella stated that the TRC is not the Planning Board.
Mr. Rowen suggested that the Building Inspector write a note to the
Planning Board stating why no Site Plan Review was required.
Boat ROAD
Ms. Colwell asked the Board how it wants to proceed on the boat
ramp issue. The Board directed staff to write a letter requesting
steps the Town Manager will take to build the boat ramp.
Woodchuck ~rove
Ms. Colwell stated that Mr. Thomas Laudani submitted a letter
requesting that the subdivision be extended for 90 days.
Mr. Nardella stated that the owner of record must request the
extension.
Mr. Rowen would like to see what revised plan looks like before
extending anything.
Discussion continued to the June 21 meeting.
8ohedule 81t~ Visits
The Planning Board will attend joint site visits with the
Conservation Commission on Monday June 13 at 6:00 p.m. to Meadowood
III, Nadine Lane and Osco Drug.
on Saturday, June 11, 1994, at 8:00 a.m., the Planning Board will
visit the Leyland Property on Marbleridge Road.
On Saturday, June 18, 1994, at 8:00 a.m., the Planning Board will
visit Foxwood and Jerad Place III.
Villaoe NaY - Bond Reduotio-
Mr. Rowen read a letter from D.P.W. recommending that all but
$2,000 be released for work remaining in the subdivision.
On a motion by Mr. Rowen, seconded by Mr. Daghlian, the Board voted
to accept D.P.W. recommendation to reduce bond to $2,000. Upon
receipt of $2,000 check to be deposited in an interest bearing
account, the surety bond will be canceled.

Ms. Colwell stated that Mr. Thomas Laudani requested that all
remaining bond money be released. ($1,000 for trees, $15,000 for
roadway). Mr. Nardella asked if all easements were in place.
Ms. Colwell told the Board that all easements were not in place.
Mr. Nardella stated that prior to any money being released, all
easements must be in place.
The Board took no action.
North l~dovsr Estates - Bond Reductio-
Mr. Rowen read a letter from D.P.W. recommending that $12,000 be
released for work completed, leaving $177,350 total for the roadway
bond.
Mr. Nardella stated that by the end of the week, the Planning Board
must give concerns regarding North Andover Estates to Ms. Colwell.
Ms. Colwell will then draft a letter to D.P.W. outlining concerns
and asking D.P.W. to address the Planning Board concerns.
Mr. Rowen submitted list of concerns with dollar amounts attached.
The Planning Board discussed adding 10% to $177,350 D.P.W. number.
On a motion by Mr. Mahoney, seconded by Mr. Rowen, the Board voted
to release all but $195,000 ($177,350 + 10%) of the roadway bond.
The $66,000 for erosion is to remain.

Mr. Rowen read the legal notice to open the public hearing.
Mr. Phil Christiansen, of christiansen & Sergi, spoke to the Board
on the proposed project.
The project is located on the corner of Route 125 and Willow
Street. The following is proposed:
3 1/2 acre parcel
20 lots
single road, looped through
570' pavement
sewer installed
drainage with catch basins
road 2 to 4 ft above existing grade
houses 2 to 5 ft. above existing grade
wetland line confirmed by the Conservation Commission
6% grade on Willow Street, 1% grade on new road
tie into existing water and sewer on Willow Street

discussion regarding water easement to Meadowood III with
pedestrian easement across water easement
Mr. Simons stated that applicant should work with Meadowood III to
provide a plan showing Meadowood I, Meadowood II, Meadowood III and
NadineLane, need to show entire R-6 Zone, what is built and is not
built.
Mr. Christiansen will do a 1"=100' plan showing the R-6 Zone with
tope.

Mr. Nardella stated that he will want curbing.

Mr. Rowen asked how many driveways from Route 125. Mr.
Christiansen stated that one lot would need to come off of Route
125, would be willing to move driveway off of Nadine Lane with an
easement across another lot. The applicant would seek a Special
Permit to do this.
Mr. Nardella to review plan to see if any lots can be moved away
from center.
Mr. Simons asked which house style will go on which lot? Mr.
Christiansen stated that it was driven by what fits on each lot,
driven by lot size.
Mr. Simons asked how it differs from existing homes? Mr, James
Grifoni, developer, told the Board they would be similar to
existing styles in Meadowood I.
Mr. Nardella wants all zoning information on front sheet. Asked if
any variances required?
Mr. Christiansen stated that no variances required.
Mr. Mahoney stated the need to delineate between road and grass
strip with curbing.
Mr. Daghlian asked how drainage is controlled. Mr. Christiansen
answered by catch basins in road drain to swale, no detention
proposed, steady slope to wetlands currently, finished grade is
flatter, water will be slowed down by grass and street. Houses
will have sprinkler systems. The existing structures will be
demolished.
Mr. Nardella stated that site screening will need to be discussed
on site.
Mr. James Towle, Andover By-pass asked what happens to wetlands in
Meadowood I when Willow Street is raised. Mr. Christiansen
answered work on road stays in existing right-of-way and will not
effect Meadowood I wetland. (Ms. Colwell to make sure Conservation
Commission reviews this).
Mr. Christiansen stated that granite curb will be provided to
channel water on 6% slope.
Mr. Nardella wants to review how Meadowood II drainage and Nadine
Lane interact.
Mr. Rowen stated that there may be a need for independent review of
drainage for al! projects combined.
Mr. Ray Parker, Meadowood Road, concerned about traffic.
Jim Towle, Willow Street, questioned if anything could be done to
address traffic issues on Route 125.
Mr. Nardella questioned why Hillside Road was closed off. Mr.
Thomas Laudani stated that there was a fatal accident at the
intersection, the State put a barrier across Hillside Road.
Mr. Nardella stated that traffic issues need to be addressed.
Ms. Bea Fink, Turnpike Street, questioned the impact on sewer and
water pipes. Mr. Nardella said that D.P.W. will review loading
capabilities.
On a motion by Mr. Simons, seconded byMr. Mahoney, the Board voted
to continue the public hearing to June 21, 1994.
Meadowoo~ III - Definitive Subdivision & special Permit
Distriot
Mr. Rowen read the legal notice to open the public hearings.
Mr. Steve Stapinski, Merrimack Engineering, and Mr. Thomas Laudani,
developer were present. The following information was given to the
Planning Board.
project site located off of Route 125 and Hillside Road,
adjacent to Meadowood II
Lot 13 of Meadowood II is included in Meadowood III
Annaloro and Peterson Property also included
Peterson house will remain
extend Bucklin Road through to Hillside Road, Peterson
Road and Benson Circle added as new roads
Town water and sewer provided
change slope of site to slope back from wetlands to
Hillside Road, detention area on Lots 9 & 10, then drain
to grassy swale, then to wetlands
all lots 5,000 sq.ft, with 5,000 sq. ft. upland.

Mr. Rowen asked if on a master plan for R-6, did roadways tie in?
Mr. Stapinski answered that the roadway did tie in to all
properties, but at the time the plan was developed he did not have
an accurate wetland line, a connection would require wetland
filling of more than a quarter of an acre.
Mr. Simons stated that Mr. Stapinski is to provide copies of the
original R-6 Master Plan to the Planning Board.
Mr. Simons stated that a roadway connection to Nadine Lane must be
reviewed and analyzed.
Mr. Nardella stated that the developer must be able to prove to the
Board that no roadway connection is feasible.
Mr. Nardella expressed the following concerns:
grading of Meadowood III and Nadine Lane
upgrades to sewer and water
easements would be required for access
concern about lot from Meadowood II
Meadowood III
combined with
Ms. Colwell to bring Meadowood II Master Plan to next meeting.
Mr. Hamel, 591 Turnpike Street, concerned about traffic, wants a
traffic study done.
Mr. Mahoney stated that there was a need to have a Master Traffic
Plan Analysis done in this area. Ms. Colwell to solicit Police
information on traffic issues.
On a motion by Mr. Rowen, seconded by Mr. Mahoney, the Board voted
to continue the public hearing to June 21, 1994·

Road - Special Permit
Mr. Rowen read the legal notices to open the public hearings.
Mr. Steve Stapinski, Merrimack Engineering Services and Mr. Curt
Young, Wetland Preservation, were both present.
The following information was given to the Planning Board:
Project located on the Leland Farm at the corner of
Marbleridge Road and Great Pond Road.
· Town sewer on Great Pond Road, sewer main under power
easement, Town water on Great Pond Road and Marbleridge
Road
construct 5 single family homes
· construct sewer in Marbleridge
· land slopes from power easement to wetlands into a
culvert to a pond and eventually in to the lake.
· Work in Non-Disturbance Zone:
- Lot 4 sewer connection and common driveway
- Lot 5 driveway - common driveway
The Technical Review Committee requested Mr. Stapinski review
buffer zone distances from edge of the lake. Some work falls into
Non-disturbance Zone of the lake. These zones will be added to the
plan for staff and Board review.
Mr. Rowen asked where will run-off from Lot 3 go? Mr. Stapinski
stated that current plan is to have stormwater drain to lake, will
need to review this because it is located in Non-disturbance Zone
of the lake.
Mr. Young stated that a nutrientloading study was conducted based
on IEP Report.
Mr. Simons questioned what would outside review of nutrient study
show?
Mr. Young stated that conservative numbers used.

Mr. Nardella questioned how much grading on site?
answered, limited grading.
Mr. Young
Mr. Nardella questioned driveway width? Mr. Stapinski answered,
30' driveway and utility easement, 14' pavement.
Mr. Simons stated that this is an aggressive plan on the edge of
the lake, questioned subdivision v. Form A Plans.
Mr. Rowen, on Lot A, questioned why strange lot lines. Was CBA
requirement on issue? Mr. Stapinski replied, "no", there are 4
acres of upland.
Mr. Rowen questioned if Lot A was being created for future
subdivision. Mr. Stapinski answered, "yes", it could be further
subdivided.
Mr. Laudani stated that there was a 16 acre parcel. He purchased
11 acres. The Lelands wanted to keep 5 acres.
Mr. Simons commented that the driveway is close to being a road.
Mr. Young stated that the pond existing on site with outlet
structure, will replace the outlet structure.
Mr. Rowen asked why couldn't Lot A line be reconfigured to give
Lelands the 5 acres they want and eliminate strange lot lines.
Mr. Stapinski stated he needed CBA, area, width to create lots.
John Digaetano, 177 Great Pond Road, expressed concerns about
watershed issues and cumulative impacts of development.
Mr. Kenneth Peelle, 185 Great Pond Road, asked why a culvert under
the driveway at Lot 3 and not one at common driveway.
Mr. Stapinski stated that there was an existing gully on Lot 3,
therefore a culvert is required.
On a motion by Mr. Simons, seconded by Mr. Rowen, the Board voted
to continue the public hearing to June 21, 1994.
525 Turnpike Street - Site Plan Review
Mr. Rowen read the legal notice to open the public hearing. Mr.
Rowen read a letter from Merrimack Colleqe, with concerns about
drainage. A memo was read regarding a ~hone conversation with
Marian Drive neighbors, concerns about traffic, aesthetics -
gateway to North Andover.
Mr. Thomas Kennedy, president of Kennedy Development Group, Inc.,
was present.
Mr. William Scully, McDonough and Scully, was present to address
traffic issues.
· generating 1/2 traffic from what was initially proposed
because no Boston Chicken
· worked with Mass Highway in creating traffic plan
· 115 midway trip hours
· 130 afternoon peek hours
· 2 vehicles per minute
80% of traffic to Route 114/20% of traffic to Route 125
· not making traffic issues any worse than they currently
are
· two lane exit drive on Route 114 - 40% turn left onto
Route 114
· access onto Route 125 for left turn out only takes 40% of
traffic out from Route 114 to Route 125
· right turn lane constructed on Route 114
· need to change light timing and stripping at intersection
Mr. Kennedy expects full State approval within the next 30 days.
On landscaping, Mr. Kennedy has retained a landscape engineer.
Mr. Kenneth Hyszczak spoke on the building elevation.

Mr. Simons had issues with the following:
design issues
traffic issues
conservation issues
considerations to representations made at Town Meeting
when area rezoned
Mr. Kennedy said State has jurisdiction over road, suggest review
with counsel regarding outside review of traffic. He will provide
traffic people to work with the Town.
Mr. Nardella stated that 48 lots are now proposed, these need to
taken into consideration in the traffic study. Mr. Nardella
questioned how far the deceleration lane was from intersection.
Mr. Scully answered, 400' from turn around to Route 114 to
deceleration lane, 100' turn lane, §0' transition lane.
Mr. Nardella asked what changes proposed to Route 125 intersection.
The reply was change lighting timingand striping.
Mr. Daghlian stated that a scale model of the building would be
helpful to clarify issues.
Mr. Kennedy stated that Osco will not put wood siding or shingles
on building.
Michael Coyne, 306 Hillside Road, expressed concerns with site as
it is a gate way to North Andover, first impression of Town based
on this site. Rezoning sold to citizens at Town Meeting that the
church would stay, small stores, wood structure.
Ms. Joan Redman, Meadowood I, commented on the following:
could not get to houses from Osco
problem with left hand turns onto Route 114
Mr. Towle, Route 125 Bypass, stated that the deceleration lane was
not sufficient. He asked if there was any way to have one access
through Chestnut Green to get to Osco.
Mr. Mahoney stated that a presentation was made at Town Meeting,
and that site is a gateway to the Community. Traffic problems need
to be addressed.
Mr. Kennedy has made changes based on comments made by the Town.
Mr. Simons asked Mr. Kennedy to look at Middleton Center for an
example of New England architecture.
On a motion by Mr. Simons, seconded by Mr. Rowen, the board voted
to continue the public hearing to June 21, 1994.
Jerad Place Iix
M~. Thomas Neve stated that D.P.W. has not yet reviewed the
drainage calculations.
Mr. Nardella concerned that when a lot in a 1 acre area is taken
out of that subdivision and put in a 2 acre subdivision that the 1
acre lots should lose their protection.
The Planning Board requested that Town Counsel review land
grandfathered or subdivision grandfathered and land grandfathered
under i acre taken out and put into new subdivision, what zoning?
There was a discussion of contribution to be made to the sidewalk
fund.
The Board may require cape cod berm.
Mr. Nardella stated that if Ms. Colwell can draft conditions by the
next meeting, she will do so.
Mr. David Sherman, 315 Candlestick Road, stated that Candlestick
Road does not need sidewalks currently but may in the future. What
is the time frame.
Mr. Neve stated that the road will be built with a few homes by the
end of the year. There is a three year build out proposed.
Traffic of construction vehicles, stones will be placed at entrance
to the subdivision to knock off silt and sand from tires.
Mr. Robert Janusz, developer, has reviewed ability to use wood road
off of Forest Street for construction access.
On a motion by Mr. Rowen, seconded by Mr. Simons, the Board voted
to continue the public hearing to June 21, 1994.
Sharmners Pond Road - Lot 6 & 7; Lot 8 & 9 - Co~on Driveway-
The Board reviewed the draft decision on Lot 6 & ?. Discussed
$2,000 bond.
On a motion by Mr. Simons. seconded by Mr. Rowen, the Board voted
to approve the Special Permit for Lot 6 & 7 as discussed. Mr.
Nardella also voted.
The Board reviewed draft decision for Lot 8 & 9. Discussed $2,000
bond. Wooden guard rail detail and conservation restriction to be
placed on Lot 9.
On a motion by Mr. Simons, seconded by Mr. Rowen, the Board voted
to approve the Special Permit for Lot 8 & 9 as discussed. Mr.
Nardella also voted.
