HomeMy WebLinkAbout1954-06-07 Board of Selectmen Minutes weekly meeting of the Boa~d of Selectmen was held at 7:00 P.M.
Fith all members present. Weekly bills and payrolls were approved.
AR~UR A. THOMSON:
Attorney Arthur A. Thomson was present and Chairman John J. Willis presented
Mr. Thomson with a framed scroll signed by the three members of the board,in
appreciation of the faithful service given to the town over a period of 18 years.
Mr. Thomson responded very graciously and said he would not have had the privilege
of serving the town feral8 years had it not been for the consideration of the
towns people. Ne said he had enjoyed his association with so many colleagues
who had served with him and that the latter part of his association with the
present had been very enjoyable. Mr. Thomson congratulated the board on the
manner in which they are performing their duties and felt that North Andover
would alway~ be capably represented by the present board.
FIRE DEPARTMENT:~
Acting Chief Donuld T~omson came before the board to discuss a transfer of some
money from cae appropriation to another. He said he must have a new forest fire
pump which would cost approximately $350. Mr. Willis told him te ~ake this matter
up with the AdVisory Board and if~they agreed with-him onthe transfer to be made,
the Board of Selectmen would approve it. Mrs' Kirk ~mde a motion that the Board
of Selectmen approve the necessary forms for a transfer of $227 from the l~eserve
. Fund to the Fores~ Fire Dept. ~and refer them to the Advisory Board lor their
approval. ~he vote was unanimous.
UNITA~ CHURCH:
Ira D. carry requested permission to block the road from Salem to Stevens Street,
for the annual fair to be held by the church. The Board voted unanimously to
grant permission to block Great Pond Road from Salem to Stevens Street.
HEARING ON TREE REMOVALz
A hearing was held at 7:30 P.M. on the petition of Alfred Zappala, 3 Pembrook
Road, for the removal of a. tree. Mr. Conners reported that this tree is in the
middle of the sidewalk and should be removed. Mr. Oarty is planning to build
a new sidewalk at this location and the tree will have to be removed. ~he
Board v. oted .unanimously to {-,truer the tree warden to remove the tree in question.
HEARING ON PETITION OF N~i ENGLAND T & T CO:
A hearing was held at 7z45 P.M. on the petition of this company for permission
to locate a line of wires, cables, poles and fixtures on Chickering Road, northerly
from a point approx. 179 feet north of Dufton Court, 5 .poles. (remove 4 poles)
Abutters were notified and there was no opposition. Mr. Flanagan was present and
stated that the company is running new cables to take careof Nerrimack College
and they have to take out four poles and .put in the five requested. The board
voted unanimously to grant this petition.
JOINT ~IYNG- MKFFLIN PARK DRAINAGE:

the drainage problem on Mass. Ave.
.Mr. ~illis informed those present that the town is having considerable trouble at
the lower end of Mass. Ave. with the sewerage system and that individuals are dumping
drainage wa~er into the sewer system and this must be corrected. Ne said that we
are presently planning to spend some $26,000 in the Mifflin Park area and that this
project should be planned so that the drainage will be set up properly.
Mr. Duffy explained that they generally go down seven feet with the sewer pipes
and that the drain pipes should go down as far as possible so that the homes can
enter the drains. He said he expected to put the sewer in on w/F flirt Drive for
the entire distance this year. He read Chapter 83, Section 5 of the general laws
which he said is very specific. He felt that now that we have a chance to force
people to put drains in they should ~ake advantage of it.
Rslph Brasseur stated that they go down about five feet, counting the bottom of
the pipe but sometimes they hit the sewer pipes and have to raise the drain in
order ~o clear it.
Mr. Willis asked why a policy couldn't be established right now to put the drains
down five feet and Mr.. Brasseur said that had been the. policy for over. twenty
years bat as he stated before, somstlmas they have to raise the pipes in order
to get past the sewer pipes.
Thoro was further discussion relative to various types of houses and how the
drains should be laid. ~hey discussed culling for bids for the Mifflin Park
work and Mr. Duffy felt that they would find some contractors who would be
very willing to do this work for the money available.. He also suggested that
if a little closer attention was given to design when the work is being done
that things would be much better. Mr. Brasseur said he would continue to
design as low as possible~ and that he would check on the work as it is being
done,
Mr. Willis suggested that when there is a new developmgnt
should contract Mr. Duffy and find out where the sewer is aha wor~ accoramngmy.
discussion ended with all feeling that by working together there will be a much
better understanding.

LEXINGTON STREET:
Mr. Willis discussed the local draining problem at this location and informed
Mr. Brasseur that he had discussed this matter with the state engineer from
Boston and he had found that most draiaage water was coming from the new High
School. Recanmly a new 21" drain had been installed from Lexington Street to
the town drain and Mr. Willis felt that this should be checked to see if it is
blocked up. Mr. Brasseur agreed to check the pipe at the location mentioned
and he will report back to Mr. Willis.
WATER- MASS. AVE. & WAVERLEY RD.
J. P. Musumarra, 46 Narsden Street, Lawrence. came before the board to discuss
water which is being drained onto his land at this corner. He came before the
board several months ago and the water is still being drained onto his Iand.
Mr. Willis said he felt quite sure that the state has easemants~ on this land
and that Mr. Berry, en~eer for 'the state department, had looked at this
situation existing here. Ralph Brasseur said this is a. natural, waterway and that
there was nothing that could be done about it. ~he s~ate has been.draining
in there for years..Mr. M~sumarra said he probably Just got stuck with the
land although he didn't see why the town should .put drains in there .too. Mr.
Brasseur said he knew of no drains inst~lled there, during the past.six months.
.No further action~ms .taken.
JURY DUTYt
Mildred H. Strobel, 31 Middlesex Street, was considered for. Jury duty and she
will be requested to make out the required application and perhaps .the board
will put her on the new list when it is compiled in the near.future.
RENT CON~ROL ACT,. ....
A copy of Chapter 496, Acts of 19S4, relative to the continuation .of rent
control was received by the board. No action taken.
ERECTION OF BII2,BOAED:
A copy of an application for the .erection of a~ billboard on Route ~1/4
· near the old Farnum School was received from the Out~cor Advertising Authority
for approval. ~he Board voted unanimously to refer this application to the
Building Inspector for his cmusideration and request and that .he. send his
report to the Advertising Authority withia the specified time The sign is
to be 7'10" long and 3'10" high and will read, North Andover, ~.~. ~XACO
LAWRENCE ELEC~IC. CO:
Notice received that 1GOO lumen incandescent lights have been LustaLled
on Turnpike Street on poles 1~32, 1%33,~1%3~, 3813, 3815, 3817, 3818 and
3~1~. These light'were installed on Nay 18, 1954.
The Board voted unanimously~ to grant permission to excavate ~o install
gas service for Frank Dushame, Osgood Street, I1 fee~ in street. Mr. Catty
will, be notified of~ this. permission. .
C~AS50F.1929-.JOHNSON HIGH S~OOL:
T~e Board received a letter from Mrs. Lois Gill relative mo their proJec~
for a memorial for Miss. Annie 21. Sargent and hoping that there may be a
possibility of having the. library dedicated ~o her as well as a space in
the library~for a portrait ~Z~Miss Sargent. Mrs. Gill requested that the
Board of Selectmen act favorably on this project. The Board voted unanimously
to endorse this project and wish the class success in,their movement for such
a good cause. . .
LU~ERMENS MUIUAL CASUALTY COMPANYt
.Suggestions were received which apply to the Highway Department and the. Board
voted..unanimously to refer these suggestions to Mr. Carry for completion.
A copy of the suggestions with a letter will be s en~ to the Highway Surveyor.
CER'A'A~'ICATE OF CHARAC'I~: :
The Board approved an application for a Hawker and Pedlar license (State) for
Daniel O'Lanie, Osgood Street, for character only.
C1WIL D~'~:NSE~
· Notice .received that there will' be a public participation practice alert
beginning at 10~00 A.M. and ending at 10:10 A.M. on Jume lhth in each city
and town in Mass. ~11 local Civil Defense directors to make a special and ccourate
check of their local warning device systems during this exercise. The local
director will report to the selectman after the attack warning coverage. No
action was taken other than to see the~ the local director had* received a copy
of this memo.

PLANNING BOARD- RE ZONING.
Mr. Willis informed Ralph Finck and Nicholas Nicetta, members of the Planning
Board that the map of the town is an abbreviated one and the Planning Board should
take steps at once to provide for further zoning. Otherwise, anyone could come
in and start any kind of a business in that area of the town and nothing could
be doneabout it.
D~PARTMENT OF PUBLIC UTILITIES:
Notice received that this dspartmen~, determines that the proposed line as listed
in the petition of the New England Power Company is necessary and for the purposes
alleged and will serve the public convenience and is consistent with-the public
interest. No action required.
I~70LVER PERMIT APPLICATION$~
Applica~isns for licenses to carry a revolver were received from Ernest. A. Roberts,
400 Winter Street, Reserve Police Officer and 'froml~chard L. Crowe,. 99 Second
Street for target practice only.. The Board voted unanimously to grant both
licenses upon payment of the usual fee.

members Kirk and Fianeran presen=. Chairman Willis is seriously ill at the Bon
Secours hospital. Weekly~llls and payrolls were approved.
I~OLVER PEPJ~IT APPLICATIONt
Application 'for a license to carry a revolver was received from John E. Spires,
123 Main Street. He is a restaurant' manager and .carries large .sums of money. He
has had a license in Graftun for soma time. The Board voted unenim6uely to approve '
the application pending the approval of Chief McKee. Chief .McKee approved the
application and license will be granted. .....
~ECREATIONAL COUNCIL.
Philip Sutcliffe and Domenic Bonnano came before the; board.and submitted ,the new
members for the coming year. Philip. Sutcliffe is the chairman. ~hey also submitted
a copy of a letter sent to Chief Mcmee relative to a new tYPe~ of stickers to be issued
this. yoar as well as a change in the houss for police at the beach, ~hey suggested
that on rainy days no officer will be needsd and in that-way they will be able to
spread ou~ the appropriation and create a saving of money. -'-

Tee following names were submitted for approval by the Selectman,
Mrs.' Elizabeth Elliot, Supervisor and Louis Brederick, Noranse Mahomey, Elsie
Thomas, Dorothy Sutcliffe, ~ichard Kennedy and Mrs. Anna Donchue with Oor~2ns
Smith as a substitute also Martha Cavallero.
Mr. Kirk did not feel that he could approve Mrs. Donohue's name. He felt she
was very well qualified but that it would Be starting a preced~ntt Ne said he
has no personal animosity but he thought the young people in~ High school.:shOuld
have a chance. He said he had called up members about one psr-~un hut that was
not why he. objected to Mrs. Dunohue.
Mr; B0nnanO said they had tried to give .the work to needy people who were qualified
and.they thought it a~goed thing to have a married woman on the Job who is ~,4ed ~o
handling children and Mrs. Donohus has a,great deal of ,experience.
Mr. Sutcliffe went along with Mr. Bonnano and said he thought it a good thing to
have someone qualified who could step in~ and be the supervisor if the need arose.
He said Mrs. Donohue had played Volley Ball and was very good in sports.
Mr. Kirk said this argument did. not affect him and he thought that if~necessary
they could take Mrs. Donchus and put her in as supervisor an~ time. He. still .felt
the kids should get a.break.
Mr. Finnsran inquired if the prime reason was to have young people take over 'this
work and Mr. Sutcliffe said they have always had high school students but that
Mrs. Donohus was very capable.
Mr. Kirk said he would approve the list with the exception of Mrs. Donchus.
Mr. Finseran then mede a motion that Corrine. Smith replaceMre.-Donohue un.the
list.of instructors. Corrine Smith is the first substitute on the list
RE~T CONTROL BOARDt :
APPLICATION FOR RE-APPOInTMENT:
A letter of application .for re-appointment to the Rent Control Board to' represent
the taxpayors was received from William Bamford. The board willnot re-appoint
but will assume that the same. members will continue on the board as iong: as ,it
is in e xistance unless they wish to resign.
RESIGNATION ~
A let%er of resignation as a member of the Rent Control Board was received from
Raymond B~oadhsad. The bo, rd voted to accept his resignation with regret and %o
so notify him. The resignation will become effective 'at once.
