HomeMy WebLinkAbout1954-11-22 Board of Selectmen MinutesNO~EMBER 22, 1954 A hearing~as held on the ~etition of this company for per~mlssion to locate poles wires and fixtures on the westerly side of Chickering Road, at a point approximately 310 feet southerly from ~in Street, 1 pole. Abutters were notified and no opposition was presented. The Board voted unanimously to grant this request. TREE REMOVAL HEARING: A hearing was held on the petition of Mary Stewart, 62 Elm Street for the removal of a tree in front of her property. Mr. Conners was present and recommended that the tree be removed. The Board voted unanimously ~o accept the recommendation of the tree,arden and instructed him to remove the tree. REQUESTS FOR R~OVAL OF TE~ES: Benjamin Buya, 459 'gaverley .Road requests the removal of a large treein~ont of his property which is in bad condition and he believes it should be removed. Mr. Oounors said this tree'~s damaged by the hurricane and should come down. No hearing is required. · Celia Donovan requests the ~removal of a tree a~ .~2 Sargent Street, which is split end,is dangerous~ln its present condition. Mr..,Connors has checked this,tree and recommends that it come down. No hearing required. Er. Kohl, 349 Waverley Road .requesvm removal of a large elm in front 'o~ ,h~'s home. This t~ee has been cabled but has been wea~ed by the hurricane and is split at the base. of thet~se. Mr. Conners also recommended that this be .taken dewn. No bearing required. The Bo~rd v~ted ~unanimously to accept Er. Conners recommendation and instructed him to remove them when it convenient for him to do,so. REVOLVER PERMI'T REN~¥ALS- ~he Board approved all persons eligible for renewal of revolver permits for the month of November. LAWRENCE GAS COMPANY: ~he .Board voted unanimonslytto grant permission ire the Lawrence Gas Oo~pany to excavate 15 feet on Sutton Street at the oorner of Wood Ave'. ~o install gas main on Wood Avenue. Betition for permission ~o construct underground conduits from .the 'existing pole j~ .on .the easterly side of Main .Street, a~ .a point approximately 40 ~eet 'southerly from ~econd ~Street, westerly a distance of approxinmtely 55 feet~ to the westerly line of Main Street, 1 duct, and the board set it down for a hearing on December 6~ at 7:30 P.M. DEPARTMENT OF PUBLIC WORKS- MARTIN MAILET: Notice received that the sum of $2,654.72 is to be paid ~o Martin Mailer under the terms of contract No. 15362. The Board discussed this work-and voted unanimously to request Mr. Mailer to moat with .the board to discuss the disposal, of the fill on Great Pond Read,before approving this bill. ~he Board will meet with Mr. MaLlet on November 29, 1954 at~8:00 p~ DAMAGE CLAIM: A letter was received from Arthur J. DeFusco, relative ~o the claim of Michael Perrotta of 63 Chestnut St. Lawrence advising the board tha~ he is ~represanting Mr. Perrot~a. Mr. DeFusco stated.that he felt that the claim of Mr. Perrotta is a~ reasonable one and asked that the board reconsider the claim. The Board vo~ed unanimously mo gran~ the full amount of $26.00 to Mr. Perrotta. O.U~DOOR ADVERTiSING APPLICATTO~;: Martin Lawlor repor~ted to the board that in regard to Albert Sh~llnu~s application for an outdoor advertising sing, that this is a sta~e road and that the state calls for thirty 'feet fr, om the street. After some discussion the board voted unanimously to ad.vise the Outdoor Advertising Authority that they had no objections to the proposed sign. The application will be sent back ~o them. NOVEMBER 22, 1954: continued INSURANCE: Mr. Willis informed the members that he had talked with Thomas McGrail about Mr. John Leary, s application to become a member of the Agent's Association and they had scheduled a meeting for November 11, not realizing it. was a holid~ and later Mrs. Bullock was on vacation and they wouldn,t take any action unless all members were present. The. meeting will be held in the very near future and the action taken will be forwarded ~o the Selectmen at their next meeting. CIVIL DEFENSE AGENCY: t memorandum received from John J. Maginnis, Director lis%lng as the subject Planning Assumptions for. the coming year. ~he Board voted ~o refer~ this to the Civil Defense Director, Dewey Dyer. However, he has already, received one and this one will be filed in the Selec:men,s Office. . M. T. STEVENS CO.- CULVF~T The Hoard received a let:er from John F. Matthews, Manager of the Engineering Department advising that the roadbed over the culvert from Stevens Pond to the mill. pond continues to subside ~t a rate which they feel to be potentially hazardous. The letter Suggested that in their considered opinion it would be far cheaper .to do a proper job than to continue temporizing ~with a condition which is without question hazardous. Taey will be willing te. meet with the board and offer any advice or technical service they might require. Mr~ Matthews stated .in his letter that since it has been established that the road ~and mzlvert are the responsibility of. the town they can do no more than commenton the probleTM. Mr. ~illis expressed his exception to this s~atement and said that while George Nayi~r who is the attorney for .the company, had taken the same position at a Joint meeting held Some tine ago, the ~uestion is a legal one and he does notfeel that ..it has been !'established,, as yet. Ne also s~ated, that they had asked Attorney John Worcester of Boston ~o check on this matter and report back to the board but ;'no .rel~t.on his opinion has been received as yet. ~ Fred Kent representative of' Stevens Company and~ Henry Green met with to discuss Mr. Green's bill for ~42~ ~ ,o ..... . .the~board -~-~ ...... ~vzces renaereo after the hurricanes in. clearing ~out the calvert under Stevens. Street and allowing the water to run freely from Stevens Pond to the mill pond. Mr. Willis informed those present that Mr. Green had submitted his bill to Mr. Carry.and now the question is who is going to pay~Mr. Green,s_bill Mr. Willis said said he wen~ up to Stevens Street and Mr. Green was working ~d he, Mr. Willis ~ told him that he shouldn,t work for~.nothing. Mr. Kent said he h~ought that Mr. Green was finishing up the.~ob.and he assumed 'that the town had hired Mr. Green to go along with the.~ork. He had no thought of .Stevens Company paying any more than. the $75.00 already ~patd. Mr. Green said he went to the pond to check on: the culvert and see that itwas working properly and Mr.,Willis came up there and suggested that he make Some arrangements to have Someone pay him for the work he was doing. He said that Mr. · Kent came along and said he was the person who told him to go along with the work. There was no mention of payment but Mr. Green assumed that he had a contract with M. T. Stevens Co. and he went along and finished the work. Nesaid that .the culvert is now clear and he believes that he did a good job and he would like to be paid. Mr. Kent informed the board that M. T. Etevens & Sons Co. feels that there is no liability or respormibility with respect to the culvert maintenance and they agreed .to ,pay one half~ of the initial cost of $150. and Only because Mr..Kent had made this suggestion some time ago and they felt obligated~to pay their' share Mr. Willis said that the question of responsibility is not established but belief tha~ the matter before the board is the payment of $425 to Mr. Green. ~ade a motion that .this money be paid from the Hurricane funds. He then amended his motion to include the condition that Attorney Worcester be contactedand if he believes it will not prejudice them , the bill be paid. ~he .vote was unanimous. Mr. Willis will contact Mr. Worcester by phone. INSURANCE AGENCY: Mr. John Leary came before the beard to discuss the action of the North Andover Insurance Agents Association with ~espect to his application as well as the letter sent by the Board of Selectmen. He felt that it ~as an insult to the Selectmen by not replying to their letter of November 16. Mr. Willis said that .Mr. McGrail had informed him that they wanted all the members presan~ when action was taken on your application and he understood that they planned to meet this week. Mr. Willis said that he would ~do anything that Mr. Leary suggested to get this matter straightened out. Mr. Leary said they lost no time when he made an oral complaint and he doesn,t believe that the members could have forgotrmn tha~ November II was a holiday and had been for many years. Also the fact that a member of the assoeication went menaWaYnow.had no bearing on the matter. He believes that theyare ignoring the Select- Mr. Kirk said he thought the board should demand a letter in answer to our re- quest.
