Mr. Connors was presen: and informed the board that they were undesirable trees and should be removed. 3he Board voted unanimously to instruct the tree warden to remove the ~reee. LAWRENCE ELECTRIC CO: Notice received .that 1000 lumen lights have been installed on poles 1578, 1582 and 2237 on Turnpike Street, on October 14, 1954. GENERAL REE~_ASE: A general release was received from Michael Perro~ta in full settlement of a damage claim in the amoun: of $26.00. Mr. Perrotta,s car was damaged on November 3, 1954 in North Andover.: DAMAGE CLAIMS: £ letter was sent to Mr. E. J. ~yan of 333 Haverhill St. Lawrence informing him that after examining the circums~ances surrounding the cause of the alleged damage, the board felt tha~ there was certainly some negligence on his par% in causing the damage and for this reason the board cannot Justify any payment on his claim. A letter was sen~ ~o Harvey J. Lebow, 231 '~averley Road, informing him tha~ after considering all the facts and circuma:ances surrounding..the, acciden~ from which he allegedly received damage ~o his car, the .board was of the unanimous opinion that no paymen: could be Justified under these circumstances. The let:er.further informed him that he is, therefore,'left to his legal rights and remedies if he s till feels that paymen~ should be made o .. NOTICE OF APPLICATION ~?I'~DRAWN: John E. Leary of Harold Street came before the board and informed them that h6 wished to withdraw his application for membership into the North Andover Insurance Agents Association. Mr. Leary gava no explanation but made the, statement tha~ he thought this was dipping pretty low into the bag. Mr. Willis then presented a letter received from Taomas J. McGrail, Jr. Secretary of the Association s~ating that they had vo~ed unanimously ~o deny the application for membership of .Mr. John E. Leary. ~It stated further tha~ the amended Constitution became effective on July l, 1953 and that Mr. Leary,s application for membership of October 20, 1953 became subject 'to this amendment to our Constitution. Mr. Marphy asked for a copy of the letter.bu: Mr. ~rzllis informed him that he would prefer that he ask the Agent,s associationmembers to release this letter as he considers it confidential ~o the Board. If they are willing to release it, then Mr. Willis has no objection. Mr. Finnsran said he had. no objections to giving Mr. Murphy the lotto{-. ~hen the members of the association came before the board they were quite willing. that he should have the letter. Mr. Kirk then informed the members present that it had been called to his attention a: a time when he wasn,t looking for information that Mr. McGrsil told him that his .personal interpretation %was that Roger Dehullu was not a member of the association. When he signed the policy he believed that Mr. De- .hullu was a member. Mr. McGrail then told him that the association had held no meeting. He felt that after the meeting held with Mr. Whipple, that'some action would be taken but apparently Mr. Whipple didn': call a meeting of the association. Mr. Kirk s~a~ed tha~ the board was put in a very embarrassing position by Mr. Whipple,s action. First, M~. Leafy came in and discussed the letters sen~ to Mr. Whipple but which apparently were no% shown to the members of the association. Mr. Kirk felt that Mr. Dehullu should be in this association. He said he thought Mr. Whipple was slip-shod in this ma~er and that he couldn,~ expect to be this way when he is a public official. The ma~er of an inventory was discussed and Mr. Kirk made the Suggestion that the Association request an inven:ory from e ach department head. He- also asked that the Selectmen receive afcopy of the d.strmbu~on~ ' ' shee~ each year. Mr. McGrail explained, that when an agent receives a commission it is reported to Mr. Whipple and a~ the end of the year, all commissions are totaled and redistri- ~ buted among the agents. There was a discussion abou~ the standard coverage including personal liability and the associatien will presen~ figures for coverage of $50,000 to $100,000 and for $t00,000 to $300,000. It was Suggested that changes be made in the budget for insurance and that a separate article be submitted for the extra costs. DECEMBER 6, 1954- continued i~SURANCE AGENTS ASSOCIATION Mr. Kirk inquired as no Roger Dehullu's s:anding at the present time in the Asso- ciation. ' Sr. McGrail said he was no longer a member and when he wrote up the policy last May Mr. McGrail a ss~med that the Board o~ Selectmen gave permission to Ds.hullu no writs up this policy for the fire~'department. On July 7, 1953 a special meeting of the association was called no change the constitution. Ail members agreed including Mr. Dehullu and Alison Ballanty~e, and the by-law were accepted. At the second me~ting they had a gentlemen's agreement and Ballantyne and Dehullu withdraw from the association. The motion was so voted and both gentlemen were in complete accord, according to Mr. McGrail. Mr. l~illis said it bothered him ~o thi~k that an association of intelli~.ent .men would make such by-laws. This association can become an association of only men. ALI of you can be vo~ed out. Mr. McGrail fal{ that ~lth respecn no these nwo members only, that the association was correcn. ~hsy were legitimate agents when they wen: into the association. He was partially in agrrement with Mr. Willis in tha~ all members 'could be voted Mr. ~illis said that these men will non .go ou~ voluntarily and it bothers this board tha~ men already ih the association should be excluded. One of the considera- tions of the association was that all agents would p.~rticipane in the commissions. Anyone who ~ent into the association gave up their chad%ce no narticipate in ~own business.He ~sked if it would help if the board talked ~o Deh~llu and see if he will leav~ the association on his o~n but if he doesn,t then they are stuck. Mr. 'Willis ask6d if it would help ff the board talked with Mr. Dehullu as they will be in a position to ask questions since they ars now familiar with the insurance. Mr. Whipple and Mr. McGrail both agreed that this would be very favorable and they will be notified of the result of the meshing which will be held on Monday evening, December 13, 1954. Mr. Willis said he would like no see 'the ~ssociation accept this new by-law 'but that it apply only to future members. MARBLEHEAD CROSSIN$ The board is still opposed no the elimination of the ga~e tender and the manually operated ganes at Marblehead Street and voted unanimously to contact the ~epresenna- tives with respect to this matter. PAP~-NG BAN: 2he Board voted unanimously ~o instrucn Chief McKee no enforce the ~arking of~ auto- mobiles on the S~ree~S as of December 15, 1954 and ~o continue no March 15, 1954. DECEMBER 13, 1954: ~ m~eting of the Board of Selectmen was held an 7:30 P.M. with all members present. Weekly bills and payrolls were approved. SPECIAL POLZCE OFFICER: · al~er Stamp requested that Joseph Bettencourt of Hewitn Avenue be appointed a special police officer for the Community Center for all occasions. ~he Board voted unanimously to refe'r this to the police chief for his recommendation. ACCIDENT REPORTED: Edward Lawlor reported that the new Mack Truck of the Highway Department slid. into the truck owned by the Casey T~ucking Company at the Essex Sand and Gravel Company in .Ballardvale. There is a dent in the front right fender of the Mack truck. ~he board voned unanimously to accept the report and place it on file. ~SURANCE AGENTS ASSOCIATION: ~-~¢"~"~ Roger Dehullu met with the board and Mr. ,Willis explained tha~ the reason he.w as called in at this time was to discuss the manner of the association regulations with him. Several discussions have been held and ~r. Willis felt tha~ the board was better informed since the las~ discussion with Mr. Dehullu. A~ that time the board felt it was impro~r to eliminame the people already in the association and when the board met with Mr. Whipple last Nay, he was requested no go back and call a meeting of the association. ~he board didn,t hear from Mr. Whipple and they didn,t hear from Mr. Dehullu. The Fire departmentpolicy was written up by Mr. Dehullu and then the board found out that hewas not a member then nor at the present time. Mr. Willis informed Er. Dehullu that the board had discussed this mat~er with the association and and they informed him that both De~ullu and Ballantine were no longer in the Insurance business and they felt that neither of themv~re entitled to share in the business.
