Giles informing them that he will keep in touch with the situation at this location and he is in accord with this board in opposing any. action towards eliminating the ga~ee. The board vo~ed to accept the letter. ARTHUR A. THO}~ON: A letter advising that Mr. Thomson will file his appearance for the defendent in the case of Fred J. Bonaccersi vs. the To~n of North Andover and will notify the insurance company having the coverahe for personal injuries on the town of No~th Andover. The board voted ~o accept the letter. . I~SURANCE :. An estimate of the insurance premiums which will be payable by the Town of No~th Andover for the year 1955 was received from Richard G. Whipple, chairman of the North Andover Agents Association. The total amount estimated is $16,~08.84. This amoun: will be used as a budget figure. BONDS- TREASURER AND TAX CO~LECTOR: ~he board signed the form certifying that'the 1955 amqunts of indemnity for the bond of the Treasurer and the bond for the Tax Collector as follows: T~easurer, James J~ Maker, $47:100- Tax Collector, John' J. Willis, $49,~00.. Form will be mailed to the Commissioner of Corporations an.d Taxation.. T~ANSFE~S FROM RESER-~E FUND: T~he reques~ for $900 :o pay for the' cost of moving offices, painting, bull.ding ~cou~ters, and re-painting, the offices re-assigned, also for covering th.e five floors with Koroseal was denied by the Advisory Board. They suggested that the renovating be h~ld o~er until the March town meeting. They also suggested that' a new set of forms be made out for the ces~ of moving, painting, etc. The ~equest from Chief McKee for' $288.99 to pay for the painting of the police" cars was approved. Th.e check for this amount has been turned over to the treasurer. ~. ~The ~equests for $500 each~ (total $i, OOb) from Bernard Bingham for expenses of department .for the remainder of t he year was approved. - - .~ · REQUE~TJ FOR TRANSFER FRO~ RESERVE FUND: A request for $39,6.40 to pay insurance premiums for th~ balance of the year/was {~ approved by the selectmen, an~ referred ~o the Advisory Board. A check for a return . premium of $900 has been turned over to the treasurer. · A request for $1oo from Chief McKee to ~ay~ reserve~ officers who fill~ d' in f~r regular men w~o attended school in Lowell and for office~s who have been cut sick was also referred to the A.dvisory Board. A reques~ from Lillian Dearden for $300' for paymen$ of moving offices and equipment, building counters, repainting five officess~s also referred ~o the Advisor~ Board. ~. APJ~OLD H. SALISBUPJ* BOARD OF APPEALS: letter' was rec~eived from Arnold H. Salisbury, also a copy of letter ~he ~anZi$odt~om Board of Appeals and a copy of the Superior Courm Decision referred '.{o~%herein. Mr. Salisbury sA~d..it seemed to him that some~ action should be taken to ..t~t Judge Fair- hurst,s ruling, which in his Judgment is erroneous but which throws doubt upon~ 'the · validity of Article ~II of the ~Zoning. By-Lsw of the Town. Mr. Willis stated tha~ this had been handled by the Board of Appeals ~ithout our knowledge and they engaged counsel to' represent the Board of Appeals. Originally the issue was taken by us when we received a letter from Mr. Hollins objecting to this station, due to the' building being too close to the residential property. We wrote' to Mr'. Hollins ~a~d advised h~m .that the abtion taken by this board was that~ the matter should be dealt v~lth by the Building Inspector and subsequently by the Board of Appeals. Mr. %¥illts then stated that the Board of Appeals denied an appeal and then engaged Mr. Hollins lawyer to represent them. He would be perfectly ~i~l~g to g~ on record as opposed to taking this mat~er further. Mr. Kirk would like more time ~o think about thais but suggested that the Board.,of Appeals be notified that we request that they make their recommendations to us~ and that they, !' ' be informed that the Board of Selectmen feel that no appointed board should engage :. counsel without, the approval of {his board. He then called the chairman of the Appeal Board and advised him of this' matter and a letter will be sent at a later date .... LA~ENCE GAS COMPANY: Mr. Kirk brought up the mat~er, of the eXcavation at the corner of Greene $~reet and Woodbridge Road. He had taiked with Mr. Storey about this as he had broken a spring on his car. Mr. ~uffy had also called this to Mrs. Dearden's attention and he said it,s the worst condition he had seen. 2he hole was about a foot deep and full of water and he felt that the Gas Company should be held responsible for any damage caused by this excavation. Mr. Finneran called attention tom~other excavation at Park Street and Chtckering Rd. at Dr. Larkin,s place. The Board voted unanimously to send a letter ~o the Lawrence Gas Company with respec~ to these excavations.
