~ly meeting of the Board of Selectmen was held at 7:30 P.N.
with all members present. Weekly bills and payrolls were approved.
NEH ENGLAND TEL. & TEL. CO:
A hearing was held at ?:30 P.M. on the petition of this company for permission
to locate a line cf wires, poles, cables, etc. on Niddlesex Street, opposite
Mifflin Drive, 1 pole. All abutters were notified and there was no opposition.
Mr. Flanagan represented the company and · xplained that this pole was necessary
in order to give service in this vicintty.~ He 'felt that eventually the pole which
is located in the middle of Mifflin Drive would have to be removed.
The Board voted unanimously to grant this petition.
LAND TAEING DANAGE~:
ELwyn King met with the board to discuss the land taking damages on Great Pond
Road as proposed by the County Commissioners.
Mr. Willis in,mired of Mr. King as to his meaning of cases being settled by
the County Commissioners.~ He.didn't feel that they had this authority. He
· also.wanted to be.sure who Mr. King represented. He understood that it was the
Countyo,Commissioners and not the town.and if this is so, he felt that Mr. King's
first.,~uty was-to the commissioners, He,.mentioned that when this matter was on
the docket it was supposed to come up in November but the cases were no~ heard.
Mr. King stated that he represented the County Commissioners and the County
~easurer in the suit. Ne said that out of the six cases, only five are being
settled.
Mr. Willis said he had some feeling about the figures as presented lastyear and
· ~those presented now. He checked?on Chapter 46,, sec. t4 on the damages to be
applied and he understood that this land was taken, under Eminent Domain. He
is particularly disturbed at the change in the figures and he would like to discuss
this matter ~with the County Commissioners.and he invited,,Mr. King to meet with
them.
Mr.~ King stated that he knew that' the County Commissioners have a right to assess
the damages-and there had been conferences with Mr.~ $,,11iv~and Mr~King had
.~ suggested to the Commissioners that all be treated alike. 'He computed more figures~
and gave them to the Commissioners ~aftcr. that had ,said. that it was~ proper to treat
these cases separately. He said they,,had accepted the formula for Sullivan's
- cases and agreed to the ~basis of~ arriving at these figures. - .......
Mr. ~Willis said that Mr. King had.convinced himthat the figure was right last
year but he wont~go along with these new ~ones., There was further discussion
as to the figures used .and also to figures .that. could be, used.which~would be an
absurd figure.
· He ~hen' asked Mr. King to return on next Monday evening with answers to the
following .questions:
~ Spell out under,what authority the County Commissioners can make takings.
.Spell out under what authority~ the Commissioners can assess damages under Chap.90.
Under ~hat authority do they make the town liable for damages arising out of the
takings.

~e board received an invitation to attend.the reception on Tuesday, February 22,
1955 at the Hall of Flags, State House by Governor and Mrs. Herter.'No action
taken.
,REVOLVER~PERMITAPPLICATION:
Anapplicatton for permission to get,a license ~o carry a.revolver.was received
from Albert C. l~ite, 21 BaldwinStreet. He is employed as a~guard for the
Burns Detective Agency. ~he application was approved by Chief Mcgee'and the board
voted unanimously ~o grant this license.
CHIEF MCKEE'S REPO~:
A report was received from Chief McKee on the speed ,limit on Route 125 on the
matter,of,a complaint made by Mrs. John Griffin of 841 Chick, ring Road.~ The
chief had two representatives from the Department of Public Safety meet~ith him
and they had maps and figures showing that the average speed had been 46 MPR.
They mentioned that there were no houses from Pleasant Street to Prescott Street &
for a quarter of a mile beyond Prescott Street gn~ng towards Haverhill there is
only one house. There have only ~een two accidents in the past five years and
n~ither one caused as a result of speeding. These men will come out later when
there is more traffic. The chief recommended that there should be no change
in the speed limit at this time since there are so few houses and no small children.
The board voted to accep~ the report and also the chief's recommendation.

Mr. Willis informed the board that he had talked with Mr. Worcester recently
and we will hear from him within a few days but he felt that Mr. Kent should
be contacted and discuss this matter further. The board agreed and a letter will

Leo ~&rphy came before the board to inform them that he had talked with the
Assessors in Boxford and he will also contact the assessors in Middleton
relative to the markers on the boundary line and he believes that there should
be an Act of Legislature to clear this mat%er up. The board agreed to go along
with Leo's suggestion and ~ill be glad ~o meet with the other officials at the
proper time.
ESSEX COUNTY TUBERCULOSIS HOSPITAL:
Notice received that the County Commissioners, in accordance with Chapter 11~
Sectio~ 8%26f the General Laws, assess upon the To~n of North Andover its portion
of said amount ($926,862.62) of which North Andover,s share is $9,~63.90 and
they are required to pay. or to issure your warrant requiring the ~reasurer of
the ~o~n ~o pay into the treasury of the County of Essex on or before March 25,
195% the said sum of $9,663.90. No action required by the Selectmen. This
will be taKan care of on the Cherry Sheet.
LAWRENCE GAS COMPANT~
A request for permission to excavate to install gas main, 16 feet in street on.
Sutton Street was granted umanimously by the Board and Mr. Carry so notified.
~A request for permission to excavate 16 feet in stree~ on S~ton Street~ to install
gas main on Wright Avenue was approved by unanimous vo~e of the board.
LAWRENCE ELECTRIC COMPANY: ~: -'~,~ '
A letter~ advising the board that they have found out what the ~rouble is on
Pleasan~ Street was received. Mr. Frost has suggested that a 2500 lumen light'
be installed on pole 572 at 143. Pleasant Street to correct the condition.
He explained that the light at the corner of Lincoln Street (2500) has inter-
ference from a ~ree and this light was installed.so that the light is directed
on Lincoln Street instead of Pleasant.
The Board vote to advise Mr. Frost that the board feels that a 1000 lumen
light on pole 572 will be sufficient mo take care of this complaint.
TIDE?~ATER ASSOCIATED OIL COMPANY:
A letter was received from the ~Lde Water Associated Oil Company stating that in
view of the proceedings of the pas~ several weeks, culminating in the final with-
drawal of the appeal of Judge Fairhurst's decision ~o the State. Supreme Court,
they believe that it is now in order.~to-resume construction at their location
on the corner of Mass. Avenue and Perry Street. ~hey asked that the board'arrange
~o have a new building permit.covering their construction at this location issued at
the e~rliest convenience and forwarded ~o the writer, D. E. Cooper, Construction
Engineer. ~,
Mr. Willis .had discussed this with Mr. Lawlor who explained that they could use the
same permit if he lifted the revocation. He got in touch with Mr. Cooper and he
will send him a photostatic copy of the permit, sinceMr. Lawlor,s was ~sent ~o the
court, and Martin r.awlor will issue a new permit and send it directly to M~. Cooper.
PLANNING BOARD APPROVALS: ·
Notice .received that the Planning Board had a~proved the petition of Domenick
Mangano, to change the classification of a parcel of property from~a~ General
residential to a business District on Chickering ~oad.
Also approval by the Planning Board on the petition of Regina and Ethel, Donovan
for a special permit for the erection and operation of a gasoline station at 77-81
Main Street.
OFFICE OF THE SECRETA~:
Notice received that an application for a certificate of insorporation as provided
for in Chapter l§O of the General La~s, trader the name of the Mass. Bankers Asso. Inc
has been filed and Nildreth Auer, Bruin Hill Farm is listed. Other are not f~om North
Andover. ~he location is the city of Boston. The board referred this to the Police
Chief for investigation.
APPLICATTON FOR ABATEMENT:
The board approved the application of William and Miriam Andrewm for an abatement
of this assessment under .Chapter 80 on Beacon Hill Boulevard in the amount of
$43.80.
