ECCIDENT REPORT:
A copy of an accident report in the Tree Department was received. .Bernard 2.
McGrath, who was struck in the mouth by a limb from a ~ruck. No action required.
APPLICATION FOR LICENSE TO CARRY A REVOLVER:
A~plicationswere approved unanimously by the board for licenses to carry revolvers
~o Charles Verda, 32~ Bradford St. for protection, and to Janes D. McCab~, 6 Water
St. for protection and target practice.

The Board unanimously approved the petition of these companies for nermission
to relocate poles, wires and fixtures on Middlesex Street, northwesterly from
Mifflin Drive, 2 poles (remove 2 poles). No hearing required.
OFFICE OF CLERK OF THE COURTS- RE: JURy LISTS:
Notice received calling attention to Chapter 38, Acts of 1955, effective as
of May 5, 1955 on and after that date, requiring additional information to be
included in the lists of Jurors. Especially, attention is d~i-ected to its
provisions by this office, as venires' for call of Jurors to the Superior Court,
beginning on said May 5, 1955 must co~tain this additional information.
Section 1. required the name of each Juror, his residence, exact description of his
business or occupation and name and address of his employer or of his business.
If a married woman, there shall be appended in addition, an exact description of the
business' or occupation of her husband and the name and address of his employer and/or
his business. If unemployed or retired, there shall be an exacm description of his
last business or occupation and the name and address of his last employer or his last
business. '
The Board voted unanimously torefer ~his to Mrs. Dearden and have her check on this
la,'and see that the informati$n'is listed as req~wed.
· .DUST COI~DITION- WESTERN ELECTRIC C0: "
A letter was received from the Board of Health replying to our letter of March 3,
1955 relative to the complaints received of dust being raised in the process of
construction and that said dust in a potential health hazard'if the' situation
c6ntinues, that a letter from my board may help to correct the situation. Dr.
Kay went on to say that the Board of Health' is ~illing to' cooperate with the
"Town' Fathers,, on any problem that has a ~-ect or remote bearing on the health
of the co,unity, but he canno~ corrolate this complaint with health. The
doctor explained about the component parts of dust and made comparisons, v~ith dust
in various places where no specific health hazard was precipitated.
The letter further stated that'after~diligent search into the health laws t~e
nearest he can come to giving a helping hand iM to quote from Chapter 11~, Section
122 of the General Laws.,In order to amount to a nuisance, it is no: necessary
that the corruption of the atmosphere should be such as ~o be dangerous to health,
it is sufficient that the effluvia are offensive ~o the senses and renderd habitation
uncomfortable. Since "effluvia" means an invisible ill-smelling Vapor, it is obvious
that ~ind-borne dust does not belong in this categSry. Taerefore- the Board of
Health respectfully declines ~o enter into the controversy of the %~estern Electric
dust hazard.
Jos.eph Perrotta, 1659 Osgood Street, requested that t~e board try to have something
done a ~bout this condition as the summer is coming and it is almost impossible to
keep sm~ ~ children ou~ in the yard and he has one small baby. Relfelt tha~ there
must be so~thing they can mix'in with the dirt to keep this dust down.
Mr. Finneram explained that we had sent two letters to Western Electric ~o. and had
received no reply and suggested that letters be senm to the new York Office and to
the contractor to see if this situation can be 6orrected.
VOTING IN FZRE STATION:
The Board of Fire engineers me~ with the board and Mr. Daw informed them that his
board had held a meeting and had voted unanimously to remove the voting from the
fire station. He stated that they have to move the trucks ou~ and tha~ a valve
was frozen and had to be replaced. He suggested that the voting be held in the
Court Room. The Selectmen went along'with this suggestion as did the Board of
Registrars and the special election will be held in the Court Room rather than
in the Fire Station. This wi~l be Precinct T~o.
JUROR DRAWN:
'Raymond Broadhead drew the name of Frank Elander :o serve as a JFror but he is
presently serving having been drawn in November 1954. His name was returned to
the box and Mr. Broadhead then drew the name of Louisa King, 46 Marblehead Street.
Assistant Librarian, to serve as a traverse Juror a: Superior Court for the trans-
action of civil business at Newburyport on the l§th day of April, 19~5.

PORT FROM'CHIEF NCKEE:
Chief McKee reported tha~ he investigated the condition which existed on
Route 133 near the Brooks School on February 22, 1955 with respect to the claim
for car damage.
2his condition was reported to the Police Department and Walter Stamp was notifie,
and he placed lights on the road where the hole was. 2he condition was such
that the car could have been damaged as claimed. ~he road has since been repaired
No action was taken by the board on this claim and it will be held over until
next week.
REPORT FROM IRA D. CAR'~/~
Replying to our letter relative to the complaint of Mr. Frank Richards, 33
Phillips Street, Andover,Mr. Catty stated that.~Llliam B. Duffy and Mr. Carry
viewed the conditions at 72-78 Sutton Street. 2hey found.no .break of any kind
in ~he culvert in question and one bf his men went through the culver to the
river and inspected it. The culvert is 12 feet deep and four feet below the
· cellar level and about fifteen feet from Mr. Richard,s property. Mr.: Car~y
believes that the trouble lies in the drain pipes on his .house which allows
the water to flow do~m.on the sidewalk.and this has caused the sidewalk to be-
come undermined.
The Board voted unanimously to forward .a copy of. Mr. Carty, s letter to Mr.
.Richards.
CIVIL' DEFENSE DIRECTOR:
Dewey A. Dyer, in a letter to this board,, requested 'that .they re-assign the
typewriter now used in the l~nt Control office to the office of Civil Defense
.-as he. understands that .the:Rent Control Board will pass'out of-sxistance in
March of 1955. Ne stated that there is an enormous amoun~ of paper work involved
in the proper administration and this typewriter would be of immeasurable assist-
. .ance.., ·
.~he Board voted.unanimously to. take~no action on this.reques~ until it is de-
cided that the Rent Control Board no longer exists but will place the request.., ·
on file.
DEPT. OF CORPORATIONS.& TAXATION-TAX'!COLLECTOR,S BOND:
A letter.received advising the board, that the bond of James Dewhirst~. Tax
Collector has been approved as of March-7, 1955 by William :Scham,'. Commissioner
and calling attention to the provisions of Chapter 308 of ~he Acts of 1941 which
amended .Section 13 of Chapter 60 of the General Laws. ~his.. s~a~ute requires
· a separate bond in the amount ~o be~ determined by the Commissioner, covering
the~ amount of recommitted uncollected ~axes and accounts. Upon receiving
from this board the total amount so recommitted we will be notified of the
,.. minimum amount of the bond required to. be filed and approved by Mr.~Schan in
accordance with the above mentioned statute.
· According ~o. the.. Accountant, Miss Finn, the .amount of recommitted: taxes is
$19,684.33 as committed to Miss Finn~by the Board of Assessors under,date of
March 16, 1955.
The Board voted to send a letter at once listing the above amount of recommitted
uncollected ~axes, and accounts

BOARD OF TRADE-ME~HUEN:
A letter was received from John P. Lane, general chair~n advising that the
United Sta~es Navy Bank, under the auspices of the Methaan Board of T~ade will
presen~ ~vo concer~s in the Central Catholic Auditorium, both matinee and ~vening
performances. ~hey reques~ that this board officially proclaim Monday~ April 2~,
1955 as "NAVY RAND DAY" in North Andover. They also sugges~ tha~ all merchants
and civic organizations display the American Flag on this day.
~oted unanimously ~o refer this 'letter to the North Andover Board of Trade,
for their recommendation as to proclaiming April 25, 1955 as Navy Band Day.
COUNCIL'FOB THE AGING:
A letter, was received from Daniel J. Boyle, Vice Chairman of the Council for
the Aging requesting that the board take early action, if only to appoint a
chairman so that communications may be sen~ to him and arrange further details.
