LEO MURPHY~ ' Mr. Murphy met with the board to discuss the boundary lines at Mtddleton and suggested that the Town should.have counsel to represen~ them and suggested also that Arthur Thomson be the personappointad since he is familiar with these matters.He has spent about $300 to try and ~traighten this matter out · and now feels that the town should do something. Mr. Finn,ran stated that the Board will hold a Joint meeting in August with the Selectmen of the surrounding towns and at this time will discuss this matter and try to get it straightened out. He invited Mr. Murphy to meet with them and if not, the board will give him the information obtained at that time. TREE REMOVA~ H~,A.~N~ A hearing was held on the petition o~ ~ames G. Johnstone, 287 V~averley~ Road for the removal of a tree. Mr. Conners agre. ad'that this tree should be re- moved and the Beard voted unanimously to instruct Mr. Connor. s to remove the tree. A hearing was held on the petition of Edward C. Gary,y, 182 Middlesex Street, for the removal of a tree. Mr. Conners agreed that this tree should be removed -~nd the board voted unanimously to instruct the tree warden.to remove the tree. Mr. Conners was not present but had left. the information with Mrs. Dearden. LAWRENCE ~.w~CT~IC COMPANY: A hearing was held on the petition of this compan~ for permission to locate poles, wires, etc. on the westerly side of Osgood Street, at a' point approximately 574 feet southerly from GreatPond Road, 1 pole. Abutters had :been notified and there was no opposition. ~The board voted unanimously.to grant this request. RECREATIONAL OOUNCIL: " · Mrs. -~lizabeth ELliot and Philip Sutcliffe met with the board to discuss the Appropriation for the coming year which hsd been left out of the annual budget. Mr. Sutcliffe read the letter sent to the Selectmen from'Mrs.-Elliot and he then discussed itin sections. It was felt by the board that~this discussion was not what had intended ~o be the discussion. Mr,: Sutcliffe stated~that Mrs. Elliot had not gotten in touch with him all. during the.last season and. she had not made the purchases early enough in the season. Mrs.' Elliot. stated that she was interested in keeping the program up for the children and she felt that there was need of $500 even though they had turned some back last. year. Mr; Finneran informed her that since this- money is to be~ansferred from the Reserve ,":Fund,- the Selectmen .have-made':a policy~f.~keeping the amounts as low as possible. · :":If: at':the :end cf the season, she needs more money, then another request can be made for A transfer from the Reserve Fund. Mr. Kirk~suggested' that in the future, any similar requests should come from the O0~ncil and not from any one member.. .~ ~he Selectmen will try-to hay, this appropriation approved as soon as possible since j'~",the playgrounds will.open-before very long-and the supplies and materials will be needed. ' DRAINAGE-PLEASANT.STREET AND CHICKE~ZNG ROAD= Steve~Helbrick 'came before the board to see what can be done about the' dratnAge~.. on his property. He said there is very bad condition' there and he has put large · branches of trees over the holes on his property to prevent children.from falling into 'the hole. ~e' Selectmen voted unanimously to contact'the new state engineer and' ask him to meet' ~ith the Selectmen at. his convenience and view this location and see if the State will participate, in the expense of correcting this-condition. A letter will be sent to Rassall E. Jenkins, District Highway Engineer. MARTIN MAILET- CONTRACT NO. 15362 '- Certificatibn that work to the value of $§,749.37 has been performed under this c~ntract to May 11, 1955 and recommends that the sun of $2,438.96 be paid to the contractor under the terms of the contract' and in' accordance with an'estimate bearing' Contract 15362, The hoard'accepted. the notice-and the bf~l-will be given tc the Highway Department for payment. DEPAR~W~TOF PUBLIC WO~S~ - The Commissioners have assigned under the provisions .of Section 34, Chapter 90 of the G. L., Ter. Ed. the sum of $15,000 for the improvement of Great Pond Road in North Andover, on condition that at least $7,500 be cm~ributed by the town and $7~ 500 by the county~ and that the cost to be borne by the Co~mmonwealth on account of said work shall not exceed the. amount assigned. Notice received that the Co~issicmers have assigned the sum of $1,000 for the maintenance of Chapter 90 roads in North Andover on condition that at least $2,000 shall be contributed by the town. No action required. MAY 23, 1955- continued ~ l~l' Atty. Charles W. Trembly sent a letter to the board and a phostatic copy of the release that was in the possession of Samuel F. Rockwell and rhich was recorded by Mr. Trembly on May 18, 1955 at the North Essex District Registry of Deeds. A bill for the services rendered by Mr. Trembly in connection with this deed and determininghthe status of Grogan's field was approved by the hoard, for $106. LAWRENCE ~C?RIC CO: Notice received tha~ lOGO lumen incandescent lights have been installed on pole 3450 BeaconHill Boulevard, poles 2359 and 2362 on Marbleridge Road, on May ll, 1955 as requested by the Selectmen. SCHOOL BUIEDING COMMITTEE: Notice received that after careful and ernest considsratinn the School Building Committee cannot approve or recommend the sale of any portion of' the present high- scho61 site- ~o anyone~ at any price. Mr. Louis McAloon had offered a price for a certain section of land on the high-school site and the Selectmen had inquired as to the action taken by the School Building C&mmlttee. .... A l~tter was received from the Town Treasurer request that the Selectmen inform '- the Hurricane Board whether or not the matter of ownership of the Culvert on Stevens Street' has been determined. ~ey are holding up the bill ~f $212,50 paid to Henry Greene, which was half' of his hill, the balance to have been' paid by M. T. ~tevens Company. ' ~he Board .voted to send a letter to the Hurricane Board advising them that this was a 'l'egal mat~er which had not been determined as yet but that they felt the town should be reimbursed for the bill paid to~'Mr. Greene. TRANSFER FROM RESERVE FUND REQUEST~ ~ C~ief James Daw presented a request for the transfer of $100 to the Forest Fire appro~riation to take'care of expenses'for the year. ~he appropriation has been practically depleted due to the large number of fires up to the present time. . The request was forwarded to the ~Advisory Board'for'action. CERTIFICATION OF CHARACTER: · - ~he Board appr~ed the certificate of character for Ralph F. ~icci, 332 Osgoed St. employed by the Hathaway Bakery. CULVERTS TEVENS: STP~E T: ~ .In discussing this matter further, the board voted to 'contact Mr. John $illis by telephone to see if ,he has any written agreement from 'Arty Worcester. Mr. ~illis had talked with Mr. Worcester several times by telephone but there is nothing about these calls on the record. Mr. ~illis later, informed .Mrs'. Dearden that he had no agreement and that' his last recollection was that they had made no agreement and that the investigation as to who was responsible for this culvert would be ~continued later. Mr. Willis felt 'that'.it was importan~ to continue this 'investigation 'so that the to~n'would have something definite for their records i~ years to come'. ~ SICK LEAVE: ~he Board discussed the article voted favorably on April 27~ 1955 accepting Chapter 41~ Section lllB which grants sick leave to formen, workmen, laborers and mechanics when entitled thereto, not more tha~ fifteen days in any year, exclusive of Sendays and holidays~ without loss of pay~ provided.that sick leave allowances not used in any particular year may be accumulated, the number of ymars to be determined by the Selectmen. ~he Board voted unanimous to allow this sick leave to~ accumulate to thirty working days or 6 weeks. ~hts section 'does not include the police or firemen or the clerks in the building and the board~ at the suggestion of James j. Naker~ treasurer~ voted to have an article inserted in the nsxt annual wa~Tant to' have the town accept a town by-law covering the police, firemen, and-clerks for sick leave. ~is would come under Chapter 40~ section 2lA. · Department heads will be notified of this vot,.with respac~ to sick leave in their department. L~CE ELECTRIC C0~ANY: Mr. Frost informed ~s. Dearden that his company had discontinued photO-electric controls and since we have seven in the town at $1.50 monthly~ we will save $10~0 each month. PERRY STREET DUMP: Mr. Flnneran brought up the matter of this dump and stated that 2100 cu. yds. of fill have been dumped there and he thinks it is sufficient. He inquired as to the status of the check for $100 which Mr. Maker is st~_ll holding and asked Mrs. Dearden to find out ar$, information she can from Mr. Maker. ST~F~T LIGHT: A request for a survey of the lighting at M'ddlesex Street and Mass. Ave. was voted by the board and also at Oak Avenue, where it has been reported quite dark and in need of a light.
