HomeMy WebLinkAbout1955-07-01JULY 1, 195%: The Board of Selectmen met on this day to approve hills and payrolls. The following business was brought before the board. ATT~. ARNOLD H. SALISBURY: The board received a letter from Atty. Arnold H. Salisbury relative so the matter of a suit against the ~o~n by. Joseph McGarry, of Newbury, his wife and minor all of whom claim to have received personal injuries as the result of skidding on mu icy section of Grea~ Pond Road on January 17, 1953. This action is pending in Superior Court in Essex County. Mr. Salisbury informed the board that the damages assessed against the town could amount to something in excess of $1,OO0. Mr. Salisbury's opinion is that the to~n is not legally liable for the injuries He further suggested that the town settle the claim of the plain- tiffs for one half of their claim which.would be $150 if ~he attorney would be willing to do so. M~. Saltsbury's charge will be $50.00 for work already performed but if there is a trial, and regardless of the outcome, his charges would run at the rate of $100 per day so that the bill would be~t least $150. The Board voted to go along' with Mr. Salisbury's suggestion ~o .settle ~as 'best he can but in no event to go higher than $300. TO'~N INFIRMARY ACCIDENT: Mr. Salisbury referred to the' ~a~ccident involving.the town infirmary ~ruck which was in collision with George Higginbotham df Lawrence which occurred at th~ inter- section of Loring and Salem Streets, Lawrence. The damage to the town truck was $1%4.67, paid bY ~he tow~ 'and tqHigginbotham's car $360. It is Mr. Salisbuyy~ recommendation ~hat this 'matter be considered a closed issue, in view of the fact that any recovery bM the town is problematical and because his charge for lcgal services would be out of proportion to the value of the case. He stated that Mr. Higginbotham once made a claim against the town for the damages to his ~car; but apparently no longer intends to pursue his remedies. The Board voted unanimously to accept Mr. Salisbury's suggestion to close his file on 'this matter. BOARD OF TRADE: The' Board received a letter from the Board of 'Trade in which they express mtrung opposition to a proposed proJec~ for the recons~ructio~ sf a bridge which crosses the Shawsheen River on North Parish Road, and Green Street. According ~o the letter, Dewey Dyer,. began an investigation into the desirability of such a project from the North Andover Point .of view. His report was submitted to the Board of Directors and they voted to inform the selectmen ~d other appropriate officials of their opposition on the grounds that such a bridge wouldbe highly detrimental to the public good and well-being of the =own as a whole. It would further~ create an unnatural flow of traffic in and 'through one of our best , residential districts and thereby greatly aggravating the public safety program and the peace and welfare of the persons residing therein. The Board of Trade urges the Selectmen to oppose such a project. The board voted to accep~ the letter and place on file at this time. LA¥6~ENCE GAS COMPANY: ' - .The Board voted unanimously to grant permission to this company to excavate 9 feet in street to instmll gas service for George Walkup, 738 ~averley'Rd, pending approvs2 by %Vm. B. Duffy. Mr. Carry will be notified of this excavation. ~Q~ST FOR EXAMINATION FOR SERGEANTS FOP. POLICE DEPT. Chief McKee request ~that the Selectmen requesz the Director 'of Civil Servic~ to hold · an examination for position of Sergeant in the Police Department for the newly · created position for two sergeants so that ithere will be one sergeant' on each shift in the department. The Board discussed this matter and voted unanimously to make this request.
