AIRPORT COMMISSION: I~ELOCATION OF SUTTON STREET: A letter was received from the Airport Commission signed'by Andrew A. Caffrey, relative to the relocation of Sutton Street. The letter states that the Selectmen wilt be given every c ossideration for any future meetings, held with respect to Sutton Street. ~he board.voted to send a reply to Mr. Caffrey and Mr. Finnerun will compose the letter. ~DCATION OF SUTTON S~EET Oscar ]tamey 66 Bright~ocd Ave., ~red Phelan and Mr. ~utter came before t~ hoard and presented a petition with 1%0 ~,m~s opposing the relocation of Sutton Street, all persons who signed the petition live in the area.~here was a general discussion about the procedure, for closing the street. Mr..~amey stated-that, there are many people in South 'Zawrence who are opposed to this change as they are disturbed no~ by the planes and it will be more annoying if they have a larger-runway and larger planes. He mentioned the Hemtngway Company and said that their 'trucks would probably have to use Chadwick. Street or Main Street and the noise of these trucks is bad enough now;, Mr; ~amey .said there are 15 children on Chadwick Street, 'all" under ten~, years old and all SuCtion Street traffic would prove dangerous to these, children.' He ~menticued the 'matter of the. removing of the ,trees some time ago and at that time, ~ayor Meehan assured the board that there would be no further requests of the. town of North Andover with respect to the airport.. . ._ S~veral other groups appeared before the board with the same thought in mind. Selectmen assured them that there weuld bee public heating'before ;anything~ is settled and that all would have a chance to voice their op~onJ ~e hcard"als~ stated that it was their thought that Sutton Street should not be relocated. HOWever, if the General Cour~ gives approval, there is nothing the-town can do. Mr. Kirk' felt that the Court would not take this action when.all 'the Opposition is presented by the Selectmen. They thanked the groups for.seining in and:'al-~o for the petition which they said would,be "am~,-ftion" for .them when .the.proper time to use them came up. - .- :. ~EP. FRANK GILES: ~he hoard, received a letter 'from Mr. G~les relative to their recent communi$[on with respect to,the relocation of Sutton Street and he stated that'he felt it of great importance ~o the town when this decision wins made and he w~uld do:ali he 'could to help them. He noted.with interest the usurping of the R presentatives State Senator and' the officials of North Andover by .tho~e seeking~publiC~ on · ~.Mr,. Finne~an informed those present~ '' that ~p. Slack and Rep: Longworth had in- formed him verbally that they woul~ go along with the Selectmen with respect to this matter. Dewey Dyer ~informad the board that the Board of Trade asked ~m to inquire-if the Selectmen had been ~nvited to any meetings .relative to this matter and if they would be. invited to future meetings as they were 'also _concerned ab6ut it. Ail the' members had received invitgtioma to an "informal"' meeting of ithe Airport! Commission but no reference was made to the relocation .of Sutton Street and~nome of the members were able. to attend. T~e meeting~was held' at Holihan's ~Brewe~. DEPARTmeNT OF ~he board received a letter from the Dept. of Public Norks informing them .that Martin Mailer had asked for an extension of time on his contract;~ dated Sept. 7, 19%4 covering work on Great Pond Road in North Andover. ~le Commissioners at their meeting directed ~heir secretary to-inform the board that they reco~nded that the Selectmen 8x~end to August 1, 19%5 the completion date on this contract;.: The board voted unanimously to grant this request and will notify Mr. Jenkins and the De~t. of.Public Jerks. ... ATTY. J6HN N~ WORCESTER A letter from Mr. Worcester informe~ the board that Mr. Naylor is on vacation and he will contact.him on his return with respect to the pa~,~mt by J. P. GERALD CHAPIN- Mrs. John Griffin and George Caron met with the board .to..discuss the complaint against Mrs. Griffin who is selling agricultural products in a general residential ' area and is keeping chickens and live stock there. Mrs. Griffin informed the board that Mrs. Chapin has three steers a~d about 200 chickens and she informed her that her property was listed as a farm'~ith the · Federal Government. She men.tioned that Dr. ~ay hhs got kept. hfsLap~oihtmente with Mr. Caron and 'so no action nas been taken by the Board bf health. ' Mr. Caron informed the board that his board could hire c'oancel and have some legal action taken regardless of ~rs. Chapin's condition(which is considered mental) Mrs. Griffin stated that she has been to all town officials and no' actinm has been ~aken' but'if the Selectmen refuse to ac~, she wilI gn to higher 'officials and see that something is done. · · Mr. Finneran informed those pre'sent that the seldctmefi had taken action last week iby directing the building inspector to inform Mrs.' Chapin that she is in violation and the Selectmen 'also sent' her a letter requesting'that she remove the shelter at once and stop selling these products or some drastic a'ction'would have to be &aken. He stated that to date they have beard nothing from Mrs. Chapin and at tonights meeting Shey planned to take action by having the building inspector and the chief o,f p~ice 'go to see Mr~. Chapin and take what action is necessary. .~. Mr. 'Sutcliffe talked-with Mr. Finneran about this ma%ruer and said' the' matter was closed as far as Mrs.'Hyley(whose chLid was hurt) was concerned. However, the board felt that they s.hould have a. report from Mrll SutcIiffe and Hr. Finneran get this. At a special-called meeting, the Board of Selectmen met this evening at 6:30 P.M. with all members present. Weekly bills and payrolls were approved and the following matters were acted upon: COMPLAINT-MNE. GERALD C~.~PIN: On motion"of ~.. Xirk, the Board unanimously voted to send a letter to Mrs. Gerald · Chapin compelling her to remove the sign from her front lawn, discontinue selling products and remove the shelter for which she has no permit. /bis action is to be completed by Monday, August 8, 1955 or legal action bythe town will follow. TORRISI: A letter was received by the ~oard from Attorney Joseph A. Miragliotta stating . that his office is representing Mrs. Santina M. Torrisi, 11 Orchard Street, Andover. ~heBoard had previously notified Mr. Thomas To~risi (June 14, 1955) that in view of the information contained in the report from Mr. William B. Duffy, they did not feel there was any responsibility on the part of'the Town of North Andover ~s to a settlement of this claim. The Board voted to send a letter to Attorney Miragliotta reaffirming the stand they have taken in regard to this mat~er. AUGUST_8~ 1955: . . ~he bi monthly meeting of the Boarder Selectmen was held at 7:30 P.M. with Mr. Finne~an and Mr. Broadhead present. Weekly bills and payrolls were approved. HEARING-PETITION OF LAWRENCE ELECTRIC COMPANY: ' ~ *hearing was held at 7:30 ~.M. on the' petition of the Lawrence Electric ComPany to locate poles, wires and fixtures on the easterly side of Silsbee Street, at a point approximately 116 feet southerly from Herrick Road,' 1 pole.. The Board voted Unani- mously to grant ~e'rmission for this. ~EC~EATION..AL COUNCil-Accident at~averle[Playground: A letter was received from ~ilip 5utcliffe, Chairman of the Recreational Council, stating that he investigated the accident at the Waverley Playground. A Susan Ryley was supposed to have fallen off a swing. Mr. Sutcliffe stated that he talked to the child's father, Mr. Robert Ryley, and the child was checked by a doctor 'and it was found that she was not hurt. Mr. Sutcliffe talked to one of the playgrou~nd instructors wh~ informed him that the accident was not reported by either the child or the parents. At the time of the accident, the child was not with the children who were under the supervision of the instructors at another part of the playground. The board voted unanimously ~o accept this letter. GENERAL RELEASE-Gertrude_Gillespie: ~ release was signed by Gertrude G~llespie, witnessed by Ira D. Carry, in consideration of the sum of $11.00 as the result of an accident which happened on the llth of July, .~1955. The Board accepted this release and the bill will be paid from the Contingent Fund. ACCIDENT REPORT:' ~cc~dentreport was received bythe Board from William B. Duffy, Supt. of Public Works,..on Louis J. Godin who sustained injuries to his left knee while performing his duties at the pumping station. NOTIFICATION F~OM DEPT. OF PUBLICWORKS: ~The Dept. cf ~bli6 Wor~s-notified the Board that under the contract between the town and Martin Mailet, work to the value of $21,1~8.05 has been performed to July 6, 1955 and recommended that the sum of $6,356.§9 be paid to the contractor in accordance with an estimate hearing Contract No. 15362, date of July 26, 1955. OF PUN~IO WORE~: ~'letterwas re~eive~ by the ~oard from the Depm. of Public #orks enclosing a Memorandum of Agreement for the maintenance of certain roads in the te~n under the provisions of Section 34, Chapter 90, ~emeralLaws: Boxford Street-9,550 feet; Salem Street-7,400 feet; Sutton Street-5,54~; Pleasant Street-2,120!...making a total of 24,610 feet. No action was taken at this time as the Board wished ~o discuss this with Mr. Carty first to determine on what part of Salem Street the work would be done. ESSEX C~UNT~RETI~EMENTS/BTEM: Notification was received from the Essex County Retirement System stating that ac- cording to their records, Christopher ~. Higginbottomwill attain age 65 on Sept. 19, 1955, which is the maximum age for Group B in which this employee is classified.
