HomeMy WebLinkAbout1955-09-12150 ~continued The board received several complaints from residents of Riverview Street with respect ~o burning refuse by Suttons Mills at the end'of~each weeK. They under- stand that no permit has been granted to Sut~ons Mills and they'voted ~o send a letter to this effect. INSURANCE: &letter was .received from Mr. Whipple informing him that there is a deficit in the insurance appropriation of approximately $2470 and asked that they make the proper arrangements to raise this money. ~he matter was discussed by the board and Mr. Hanson of the idvisory Board was contacted to see if the amount requested had been approved by them. They approved the amount of $14970 which was an increase over last year of $400. It was then determined that Mr. Whipple had submitted a figure of $16,600 in duplicate and tha~ Mrs. Deardendid not give the Advisory Board this figure but filed the fo~ms in the Selectmen's file. It wil! be necessary to hold a special to~n meeting to raise the amoun~ necessary for these bills as there is not a sufficien~ sum in the Reserve Fund. SEP~E~BER 12, 1955 : 'ihe regular meeting of the Board of Selecmmen was held am 7:00 P.M. with all members present. Neekly bills and payrolls were apprqved. T~EE REMOVAL HEARING: At a hearing held on the petition of Frank Quaglietta, 748 ;¥averley ~6ad and Mrs. Alice Walkup, 738 ¥~averley I~ad for removal of two trees, ~,he board voted unanimously to request the tree warden ~oremove the two ~rees. Mr. Conn0rs had checked these ~rees and agreed that they should be removed. RALPH BRASSEU~RE: TO~NRECOPDS: Ralph Brasseur, C.E. met with the board ~o discuss'maps, plans and records he hss of the ~c~n of North Andover. He informed the board that he had a~collection of maps made a~ various'times and when the assessors survey was made he worked on that and collected all available information and records. He informed the board that the assessors had the original plans and that during ~.P.A. Mr. Duffy had a numbering~proJect and an assessors project was~in progress~and between the two the maps were ruined. He said he would do al~ he could to set up a file for the town but it would entail time and expense. He said that various departments re- ceived piths at different times and since there was no filing cabinet"thsy were placed in a vault, cabinet or otherplaces'and now they cannot be~found~ ~he board voted to discuss this'matter further and see wha~ could be done about se~ing up a complete file so that the ~owawouldhave all records and they wi!l contact Mr. Brasseur later. ~PPOINT~ENT 0FSCHOOL COMNIT~E ME~ER: Charles ~. Trembly, DrJ~.F.C. Atkinson, ~rs. C. Ingram and Wm. ~ock, met.With the three Selectmen to fill the'vacancy in the School Committee. Applications were 'received 'fromMrs. 'Frances McKee, ~.N., Carl D. Miller, John F. Stantcn Fred P. 0akes, John Clarke, and Frank D. Ashbur~, George Chesel and R. Ashton Smith. Mr. Trembly made a motion that the group accept ail 'applicants as nominees and proceed with the voting.~ This was a unanimous vo~e. Mrs. Lillian B. Dearden collected the ballo~s and counted the v6tes which were as follows: Frank O. Ashburn, 4 and John Clarke, 3, andFrank ~. Ashburnwas appointed as a member of the school committee to fill the vacancy until March, 1956. LAND-COURT: Notice received that the North Parish of North Andover has petitioned for the re- gistration of land in North Andover on Great Pond and Academy Roads, under ~eg. no. 25729 and has ~o do with the parcel of land formerly known as Essex Street, in North Andover Center. No action taken. ATTY: ARNOLD H. SALISBURY: - ~he board voted unanimousl~y .to go along with the suggestion' in ~r. Salisbury&s letter ~o pay the sum of $150.00 to settle all of the claims in the above matter, "McOarry v. Town of North Andover" as instructed by the Selectmen in th~i~ letter of July 6, 1955, check to be payable to Joseph Kalikow, Atty. for ~oseph P. McOarry, Leebird A. McGarry and Sandra Jo. McGarry. A check with be sent to Mr. Salisbury, made payable to Joseph Kalikow, together with a general release to be made out for the protection of the t own. 151 SEPTEMBER 12, 1955- continued DEPT. OF CORPORATIONS AND TAXATION A letter ~as received from Herman B, Dine, Director of Accounts, relative to the request of the town treasurer seeking authority to spend $2,500 from available funds to orovide for s.u item which was omitted in t~he "insurance budget". There is no authority under the statutes for the use of available funds in the treasury without a vote of the %o~n meeting, but the ~riter sugEested that the treasurer was referring to Section 31 of Chapter 44 of the General Laws, which allows the selectmen in a case of extreme emergency in- volving the health or safety of persons or property to incur liabilities in excess of an existing appropriation. The board ~ill discuss this ma~ter further be£ore sending a reply to Mr. Dine. LA~RENCE GAS CO: The Board voted unanimously to grant permission to this company to excaVate 19 feet in street to install gas service for~al~er Hoyt, 31 Court Street; 14 feet in street to install gas service for Frank Rudis, Camden, corner Pleasant Street. ~r. Carry notified 9/lh/55. Approved by Board of Public ,orks. DEPT. OF PUBLIC Notice received from H. G. Gray, Chief Engineer that bids will be publicly ~ opened by the Commissioners of this office, 100 Nashua Street, Boston, Mass. un~il 2:00 P.M. Tuesday, September 13, 1955. Noaction taken. J. P. MUSIMARRA: Mr. Musi~arre ca~e before the board to discuss the plan he received relative to dreinage at the intersection of Mass. Ave. & ~¥averley Road. He wanted to know who would be responsible for the building of the catch basins. The board advised him to have his attorney contact Mr. Carry. Later, Mr. Brasseur ~iscussed this matter with the board and he informed them that the plans are inadequate because of the omission of a pipe which Mr. Brasse claims is there. The board will contact Mr. Jenkins again and a letter will be sent .to Mr.~ Mus~marra a~king hi.m ~o hold up on this work. . M~. onow zrom oept of .~blic' ,orks, Danvers ~came to the office on September 15 and he has suggested that Mr. Brasseur draw up a plan using a 48" pipe at least and since he is familiar with .the location, he would be able to do this in the immediate future. Mr. Brasseur was con~acted and he will take care o[' it at the first opportunity, possible the first of next week. NOTICE OF HEA~ING: Notice received that a public hearing will be held on September 19, 1955 at lO A. M. At the Outdoor Advertising Division of the Dept. of Public "orks, at 80 Boylston Street .on the application of the Kimball Co. to erect a sign on ChiCkering Road, near the old railroad. The Board is unanimously opposed to this sign and two of the members will a~tend the hearing. HFARING-PETITION OF LAWRENCE ELECTRIC CO: A hearing was held on the application of the Lawrence Electr-'-c Company for per- ~ission to locate poles, wires and fixtures on town of North Andover property off Great Pond Road, from a point approximately 791 feet easterly from the intersection of Great Pond Road and Osgood Street, easterly, 2 poles. On the northerly side of Great Pond '~oad, at a point approcimately 791 feet easterly from the ~ntersection of Great Pond Road and Osgood Street; 1 pole. ~here was no opposmtion and the board voted unanimously to grant this permission. NOTICE OF HEARING: ~ Notice of a public hearing to be held on October 4, 1955 at 10:00 A.M. in the Department's Hearing Room, 1~6 State House, Boston, was received by the board. The hearing is on the propriety of the rates and charges in the M.D.P.U. Nos. 10, ll and 12 filed by ~he Lawrence Gas Co. No action taken by the board. CIVIL SERVICE-~C~ICE DEPT. Notice received that the employment of Daniel M. Quinlan and James E. Fitzgerald has expired as of August 28, 1955 and requesting termination notices to be mailed in. These forms have been sent to Civil Service. DEPT. OF PU~IC %~O!~S-CONTRACT: The board received a copy of Contract No. 15921 covering work to be done in this town under Chaoter 90 and contract has been signed by the Commissioners and by the Board of-Selectmen.
