HomeMy WebLinkAbout1955-09-26SEPTEMBER 26, 1955: The regular weekly meeting of the Board of Selectmen was held at 7:30 P.M. with all members present. Weeklybills a6d payrolls were approved. ADVISORY BOARD APPROVALS-' The Advisory Board approved the transfers of $200 from the Reserve Fund to the ~ac Collector's appropriation, to cover expenses for the remainder of the year. The clerk was out sick for two weeks and a new clerk was hired. Approvalwas received for the transfer of $500 to the Board of Health to pay expenses of a Sanitarian. DEPT. OF PUBLIC WORKS~ Copy of contract , dated September 20, 11955 'between the town of North Andover and J. J. Donovan Construction Co. for highway work on Great Pond Road and Pond Street was ~ceived. T~o copies were returned .to Mr. Jenkins, at Danvers. OUTDOOR. ADVERTISING DIVISION: A letter received informing the. board that their Board had disapproved application No. 39041, Kimball System. Inc., Route 125, North Andover. 'This w~s the subject of a public h~aring on August 19, 1955, at which this board was represented. LAWRENCE ELECTRIC .CO: Petition for.permission to construct a line of underground electric conduits across a public way was received. The ~oard accepted the petition and set a hearing for October 10, 1955~at 7:30 P.M. LUMBERMEN'S MUTUAL CASUALTY CO:. Notice received that the boilers~ at the new High School, Bradsteeet~ School and the Town Infirmary have been inspected and require no. attention at this time. ' 'LAWreNCE GAS CO: ' Permissioq granted by unanimous vote of the board to excavate 27 feet in street to install gas service for John Damon, ~4OO Johnson St. LAWn, CE ELECTRIC COs Notice received that the various street lights requested over a period of time by this board have been installed .on Saunders St., Chickering Road, .Miffline Drive, Middlesex St. Oak ~Ave. Mass. Ave. corner of Middlesex St. Highland Ave.~and. Schcol · Street.. T~o lights were removed at Chickering Road and the corner of Mass.Ave~ and Middlesex St. Mr. Frost, ~f the Lawrence Electric Co. recommended that a 2500 lumen light be in-tzl stalled on pole 770 and that the present 10OO lumen light on pole 771 be removed. The cost will be $10.00 per year. On Edmands Road, he recommended that the light on pole 2801 be increased ~toL2500 lumen unit' and a new 2500 light be installed on pole 2762 at ~a cost of $38.00 per year. The Board voted' unanimously to go along with this recommendation. ~.~ & ~EYNOLDS-~E: HENRY G~.~N " A letter received informing the' board that a check for $212.50 has been sent to Henry Green as representing the J.': P. Stevens & Co. share of the total bill of $425 for cleaning and inspecting a culvert in North Andover. This payment is made without prejudice to any rights of the J. P. Stevens Co. Inc. to have the to~n of North Andover keep this culvert in repair. PC~ICE DEPARTMENT-CHIEF,S ~EPORT~ The Board receivmd a report from the Chief 'relative to speeding in various parts of the town. He informed the board that-he wt]] have a man patrolling ~ain Street from Maagan's Drug Store to Sutton Street, on foot and this will give him an 6pportunity 'to check carefully all stop signs and take action accordingly. Mr. Perry at the Registry will have one of his men check all stop signs and take the necessary action. The State Police have assured the chie~ that' they will check Chickering ~oad from Thomson's' Pmstaurant to the Haverh~l~ Line. Orders ~ave been issued to the night' shift that patrolmen will do foot patrol on varicu~s streets and a ~op~rof this order was attached. The Board voted ~nanimeusly to accept the report as progressive. PERAMBULATING: The Andover Selectmen will meet with the local board on October 8, 1955 at 9 A.M. at Peters Street hounds to perambulate the bounds as required. CIVIL DEFENSE: Mr. Dyer sent a letter to inform the board that he had purchased raincoats, hats, flashlights, batteries and similar equipment for minimum readiness in order for all men to be ready for any emergency. Ne commented upon the fine spirit of unsel- fishness and civic spirit represented by the members of the Civil Defense team, and suggested that the selectmen give a kind word of appreciation to these men The Board voted unanimously to take this action and Mr. Murohy will insert this in the North Andover column. SEPTEMBER 26, 1955- continued GENERAL .RELEASES: ~leases were received from Atty. Arnold H. Salisbury ~igned by Joseph P' NcGarry, Leebird and Sandra NcGarry and a check mill be maLled to Mr. Salisbury in the amount of $150.00 as the agreed settlement figure. Chech will be made out to Atty. Joseph Kalikow. 'ATT/. JOHN J. WILLIS: A letter received from Hr. WilIts informing them that he had been retained by Mrs. John Griffin of Chickering Road forreliefe~ from the selectmeh of a situation which he is certain the board is aware exists. Re has talked with the building inspector who informed him that in his opinion the violation is no~ a minor one but constitutes utter disregard of the zoning laws. Mr. Willis pointed out specific articles of the zoning law which have been violated. Mr. ~illis asked that the -board take 'the appro- priate action now that he has pointed out the violations of the specific sec~ious. The Board voted to write-a letter 'to Mr. Willis and also refer'this matter to Atty. Arthur A. Thomson. Mr. Kirk suggested that the board s end a le'tter to the Board of ~ealth to find ou~ what progress they have made to date, since their actionWas to have been taken by September 12, 1955 if Mrs. Chapin dld not comply'with the law. The board agreed unanimously to send this letter. ~ . · P~QUEST FOR SPECIAL TOWN ~ETING: William B. Duffy came before the board to reques~ that a special town meeting ',be called as soon as possible. The Kelport Corporation of Hampton, N.H. is building '- houses1 on Tarnpike Street and they are' willing to pay~ $2500~for the exten$imn~',of the water system easterly from Waverley ~oad and any umaxpended balance will be refunded to the Kelport Corporation. Mr. Duffy explained that he had taken this up with Re,man Dine and the~ only~.W~y it can be done-properly is.~for the town to'have a specialltOwn meeting ~o ancep~~. the $2500.which will then be used by the town for the work and uny balance wtll 'be returned to theCcrpcratiun. Mr. Dine recommended the articles and vote ~listed by Mr. Duffy. · e Board voted unanimously to accept the request and they will take the matter up later in the evening.. -No dmte was set for the special town meeting. ~ETiTION FOR CHAPTER 90 WO~K: ;2 petition signed by 51 residents of the ~own was received by the bcar~.~ Sydney C. ~ea/is the petitioner and they have asked that the ~-Board of Selectmsn~-give-honsst and . ~,sincere consideration to repair, and construct Dale Street in compliance with~ the ! ~ ~,laws, Chapter 90, highway ccns%ructiun., as they sincerely believe .this ,work~ is · in the~ best interests andwe~fare along with the protection of life a~ ~p~operty in our community.~ · ...... Mr. Finnsran ~uf0rmsd him that he had be~'n inf0r~%ha~' there were two pipes running down to the rive'r which could be used %o 'drain the w~ter but this would have to be checked first. Mr. Brasseur agreed to meet with Mr. Carry on October 4, .and ,check these · pipes before taking any further action. - ~obe·rt '$~nbern and ano%her neighbor cams in to talk with the board ab'out 'this matter and 'Mr. Fianeran explained to them about ~the~large pipes and the meeting between Mr. Brasseur and Mr.' carry and warn quite sure that 'the matter would be taken, care~ of in the near future. Mr. Carry had an article (#47) in the last annual town meeting to take care of this drainage and Mr. Finneran felt sure that if the large pi~es cannot be used, then Mr. ~che will give the ~ecessary easement to the town. Mr; Sanborn was quite agreeable to Wait~ as long as it would be taken care of soon. Mr. Kirk said he felt sure the board would have ,an answerf~cr next week. The Board had received a' letter from Atty. Arthur A. Thomson informing %hem ~that he has drawn up the necessary easement for the installation cf the drain on Waverley Road extending into and upon the land of Ja~es C. Roche but it is ~is understanding that · Mr. Roche does not intend to execute the easement and Mr. Thoms6n has informed Mr. Carry of this information that he may again consult with Mr. Roche. SULLIVAN & WORCESTER: ~he board received a letter stating that they assume the board has received notice of 'the contribution of J. P. Stevens & Co. for damage to the culvert on Stevens and that· the matter is now closed. No action taken.
