The. Board received a letter from Middleton selectmen informing them that they would
meet with them on October 8, at 2:00 P.M. at Three Pines Inn parking area to check
the bounds. The Board suggested that Leo Murphy .be notified as he had expressed a
desire to go along with the selectmen.
They will meet with the Andover Selectmen at Peters Street, Bound on October 8, at
9:00 A.M.
The board then voted to notify Lawrence, Haverhill and Boxford that they would like
to meet with them 6n October 15, 1955 at 9:00 A.M. with La~rence, 'Haverhill· at 2~00
P.M. and Boxford at 4:00 P.M. and each place .to name the meeting plaice, if the date
is convenient.

A letter from Atty. Salmsbury informing the board that. a self explanatory!ette, r
was included which he h4d written to the pllnnihg Board, concerning the action
brought in the Superior Court of Suffolk County againat~ the~ Planning by Arthu~rB.
Colgate. T#enty days must expire from the date of~the decision before ,a final~ de.cree
can be entered so that the plaintiff may have an opportunity ~o appeal therefrom to
the Supreme Judicial Court if he should decide to do,so. At the end of twenty days,
Mr~. Salisbury will take the necessary steps to have a final decree entered in this
matter which will then be completely terminated.
I~EQUEST FOR TRANSFER FROM E~SERVE FUND: ~ .
John J. Connors requested the transfer of $700 from the Reserve Fund to the Dutch
Elm Disease' appropriation to take care of salaries for the. remainder ~of..the. year.
He had to hire extra men during the hurricane and~ 25 trees with Dutch Elm Disease
Were held over from last year and he has more than seventy this year. ~he Board
voted to refer this matter to the Advisory board for~ action

The Board 'of selectmen signed duplicate copies of the M~morandum cf Agreement for
the improvement of a section cf road in the to~n under the provisions of Section 3~
Chapter 90 of the G. L4 which the Commissioners submitted for the board's considera-
'ti~.n.~ Both copies.wil~l be returned to the Commissioners for their signatures.
BOAND OF HEAL~: .... -
· The BoArd ~recei~ed a letter from Dr. Julius K~y, ~hairmen of~ the~Board of HesXth
relative to the complaint of Mrs. G~iffin.against Mrs. ~er~ld Chapin. He stated
· that he had been in communication with Atty. Thomson in reference to the legal phases
.' .'.~ of the alleged vi61ation and it was agreed that the Board of Health would prosecute
on the basis of a health menace. He.went on to describe what he found at the Prescott
Street (farm) and came aw~y with the questiqn unanswered as to '~hat is the specific
complaint"? He further stated that he had reneged his decision ~o prosecute this
case as a Board of Health violation. He can find no rule or 'regulation note medical
'reason that these animals are .impeding the. health of a North .Andover citizen.
On August 31, of this year, Mr. Thomson was contacted and he has agreed to prosecute
' this case on the innocuous basis of a zoning violation.
The Board was not entirely pleased with the type of.letter received and no action
was taken, since a copy of the letter was sent to Atty. Arthur. A. T~omson.
SPECIAL TO~ MEETING:
The Board voted unanimously to calIa sp~qial town meeting on. October 19, 1955 at
8:00 P.M..in the Court Room. ~he ~rant was declared opened at 8:49 P.M. and
four articles were included in the warrant and the w~zrant was ~voted closed at
8:51 P.M .....
FIFTH ARTICLE:
~he Board voted to re-open the warrant to include article 5, petit~onsd b~ the
Highway Surveyor to transfer $77.80 ~rom the Insurance Account tc the Highway Dept.
so that a bill may be paid for ~ep~s to the tractor which was d~maged by fire. ~The
check, from the Insurance Co. was made out tothe Town of North Andover and could not
be used by the High,ray Dept. except through a vote at a special tow~ meeting. ~ather
than have an outstanding bill a~ the end of the year, the board opened the warrant
and closed it immediately, so that there will no~ be five articles.
