DEPT. OF PUBLIC UTILITIES:
The Selectmen received notice that during a recent inspection of the bridEes
carrying Sutton St. over the Cochichewick River in this town the following conditions
were noted. The adjacent retaining wall on the doE-river side which supports
the roadway is badly undermined. Several large stones in the footing of one abutment
have dropped down, leaving sizeable voids. Fer the safety of the bridge and roadway
these conditions should be remedied. The Department interest in the safety of the
Eastern Mass. Street Railway Company buses which use Sutton St. as a part of their
regular route.
The Board voted to refer this matter to the Highway Department and to send them
a copy of this letter.
REQUEST FOR REMOVAL OF TREE:
William P. Rockwell requests the removal of a tree on Water Street, about thirty
feet from Clarendon Street. The board voted to hold a hearing on this reques~
on November 19, 1956 at 7:30 P.M. and to instruct the tree warden to post the~ee.
LAWRENCE ELECTRIC CO. & N.E. TEL. & TEL. CO:
A petition for transfer of a location of an existing pole on the southerly side
of .Dale Street, at a point ~approximately lO feet westerly from Appleton Street,
i pole was received and the board voted unanimously to grant this petition. No
hearing required.
CHAPTER 718- Acts of 1956. $27,024.15 allocated to North Andover.
A reply received from' Atty. Arthur A. Thomson gi~-Lng his opinion as to the use of
this money and the method of allocation is based upon a .1939 road mileage figure
and the proportion of the property tax paid to the State in 1945. It should be
included by the Assessors as a receipt and is a direct grant ~o the town. It does
not have to be used in any one given year and is to be used for capital outlays only,
such as new construction. It may not be used for maintenance and there is a question
a~ this time as to whether or not resurfacing of a highway may be classified as a
capital outlay or a maintenance expense.
~t~e procedure to obtain the money is to first contact the District Engineer, ~o
whom projects shall be submitted by the town as new construction ~is determined, and
the cost of same. The projects are then submitted to the Dept. of Public Works ~nd
the Department would make application to the Governor and Council to borrow.requisite
money under the bond issue. Thereafter, a check would be ~sent to the mown by the
State Treasurer for the amount involved. Any part of the allocation to the Town
may be used as the Town' s proportion for Chapter 90 money and thus not necessitate
an appropriation.
~l~e first step will be to have a consultation with the Highway Surveyor to determine
whether or not any part of the allocatted amount shall be used for new donstruction
or reserved for use from time to t~,ae for the town, s share of ~hapter. 90 work.
Mr. Firmeran agreed to contact 'the District Engineer and also the Highway Surveyor
.and report back to the board.
RESERVE FUND 'TRANSFER:
Approval of the transfer of $250 from the Reserve Fund to the Police Reserves and
Specials appropriation was received on this day.
SCHOOL BUILDING COmmITTEE REPORT AND ARTICLE:
A letter informing the board that after a meeting with. the Advisory Board during
which time the three articles previously submitted for the special town meeting
warrant were discussed and 'reviewed it was the suggestion of the Advisory Board
that the Committee submit another article which is enclosed to provide an immediate
appropriation for a topographical survey and complete plans.
A copy of the School Building Committee report was also enclosed. "
S~ECIAL TOE MEETING TO BE HELD NOVEMBER 26, 1956;.
After a discussion with the Advisory Board early in the evening relative to the
school articles the Board of Selectmen voted unandmously to set e date for a special
town meeting to be held on November 26, 1956 at eight o'clock P. M. in the High
School Auditorium. The warrant will include nine articles, fourpetitioned by the
School Blding Committee, one by the Police Chief, one by Salvatore Ciarcia(sewer)
and three by the Selectmen.
COMPLAINT- BUILDING PEPJ~IT:
Mr. Maurice Sergi, 41 Putnam Road and Martin Lawlor, Building Inspector me~ with
the board to discuss the permit issued to Mr. Sergi. He explained to the board
that he had intended to buildla breezeway and garage and his permit called for that
but he had built the house and now the building inspector informed him that he could
not build a breezeway and garage ss there would be a violations f the building laws
in as much as he would no~ have the required number of feet in the rear.
He went to the Board ef Appeals but his request was denied. He had asked for a var-
iance of five feet. It had been his understanding that he could have 15' back in
rear and hewas positive that Mr. Lawlor had told him that.

Mr. Kirk inquired if he had given a plan to Mr. Lawlor and he said that he had.
Mr. Lawlor said he gave the plan back ~o him when he wen~ to the Board of Appeals
and that he issued the permit with the understan&Lng that he would keep thirty feet
in the rear. ..
Mr. Kirk made it clear ~o Mr. Lawlor that he will have ~o demand a plan before he issueg
any permit and the plan must show whether the application is within the law or not.
There was further discussion by Mr. Sergi who stated that he went around Mifflin Drive
and found a number of places where there was not compliance with the building laws and
he couldn, t understand why he couldn, m have gotten a ~zriance from the Board of Appeals.
.~tty. Ralph Finck was present and he informed Mr. Sergi that now he is grieved by the
building inspector's action and he has a right to go before the Board of Appeals
and have another hearing and that perhaps some action which is favorable might be
given. Re agreed to notify Mr. Sergi when the next meeting is to be held so that he
might be present.
MEETING TO BE HELD NOVEMBER 9, 1956;
Because of the holiday on Monday next, the Bo~d of Selectmen voted to meet on
Friday, November 9, 1956 at five o'clock to sign the~arrant and approve bills.
PROPOSED PLAYGROUND: PRECINCT TWO:
William B. Dully, James Naker and Philip Sutcliffe met with the Selectmen to discuss
the proposed playground in Precinct Two. They discussed various matters relative to
wha~ could be used at the playground and it,s felt that it is not large enough for
a soft ball field. They discussed the possibility of obtaining more land in the area
and Mr. Kirk agreed to go before the Village Land Company, if necessary.
The board suggested that Mr. Duffy prepare articles to grade the field and to get
equipment Iswings and slides) so that it could be started and later the other plans
could be worked out.
.Mr. Kirk felt that this was an e~cellent location for a playground as there are many
children in this locality and that it should get .under way as soon as possible.
The group will meet again at a later date.
Mr. Maker informed those present tha~ the land had been taken by the ~own under Land
Court.
.Mr. Duffy felt that this was a good place for small playground.
Mr. Thorton and Mr. Kelner came before the board to discuss the matter of the gravel
pit on Mill Road where they are twelve .trucks loading up with gravel every morning.
They went to the Planning Board and were referred to the Selectmen. They suggested
that perhaps the Selectmen coulddeclare this to be a nuisance or perhaps close the
road. They inquired if a permit was granted by the Selectmen.
Mr. Kirk stated that no permit has been issued by the Selectmen but he felt that
hey could limit the loads and in this way they would not be able to operatm.
The board voted to con~act Atty. Arthur A. Thomson to determine if this could be
thedeclaredroad.a nuisance and if the selectmen could limit the loads and perhaps close
Mr. Thomson was contacted and he informed the hoard that they must have a public
hearing after ten days 'notice has beengiven by inserting a legal notice in the
newspaper. The board voted to hold a public hearing on November 26, 1956 at 7:3G P.M.
on the following matter: "To limit the vehicles passing over Mill Road in its entirety
to a~ight of not more than five tons.,, This is in connection with Chapter 500 Acts
of 1956.
TC~N BUILDI~B CLOSED:
The Board vomed to close the town building on Monday, November 12, 1956 which ts a
legal holiday.
PRECINCT WORKEP~SALARY:
The Board voted to set the salaries for the Precinct Workers for the national election
~o $20.00 for the~arden, $18.00 for the clerk and $16.00 for other workers. Notice ~
be given to the Board of Registrars.~
