Ralph Finck suggested that the applications be sent to the Board of Appeals and
the Planning Board as soon as they are received and these b6ards will make it a
point to check them~ach Monday evening at the town building.
Mr. Kirk made a motion that the Building Inspector be notified that there is to
be a s even day waiting period between the time of application for a building permit
and the issuance of such permit; that the application be forwarded no the Board of ?.~?
Appesls and to the Planning Board (copies of original application) with the plot~
plan accomp~,ing the application and lot bounds to be shown on the plot. The two
above mentioned boards will check on the applications on Monday evenings and the
Building Inspector can pick up the plans and applications at the Selectmen's Office
on Tuesday mornings. The monion was seconded and declared to be a unanimous vote.
STREETS TO BE RECONSTRUCTED:-re CHAPTER 718-Acts of 1956
Mr. Finneran informed the board that he hadlearned that the money coming to the
town in the amount of $27,O24.15 which is a direct grant to the nown can be used
to reconstruct streets by having two layers of hot top put on. The money can also
be used as the town' s allotment on Chapter 90 work.
Mr. Finneranstated that it was his thought that the board select several streets
which need work on them and have Ralph Brasseur check to see if this work can be
done safely and in accordance with the grades of the streets. Re mentioned High
Street, Middlesex, Prescott, Second and Elm Streets. The board went along with
this suggestion and all agreed that a letter be sent to Mr. Brasseur andssk if
this reconstruction can be done on the streets ~entioned.
NOVEmbER 26, 1956:
The regular weekly meeting of the Board of Selectmen was held an 7:00 P.M. with
~11 members present. Weekly bills and payrolls were approved.
COUNTY COMMISSI0~RS:
A letter received and a petition to be signed by the board with a filing fee
of $5.00 payable to Philip A. Hennessey, Clerk of the Courts to protect the town's
allotment. The petition to the Commissioners of Essex County is as ~ollows:
The Selectmen of the town of North Andover in the County of Essex, Massachusetts,
thereto duly authorized,, repsectfully represent that the highway known as Dale
Street, from Salem Street to the Boxford town line is unsuited to the present re-
quirements of travel, and that common convenience and n$cessity require that the
said highway be widened and straightened and laid out, altered or relocated~ and
that specific repairs be made thereon. WHEREFORE, they pray that after dale no~ice
and a.hearing the County Commissioners may lay out, alter or relocate the said
highway, order specific repairs thereon, and discontinue any portion thereof which
by reason ~f their action may no longer be required, all as in their Judgment may

COI,~LAINT- RE PARKING AREA
£ letter was received from BenJamin.B. Kellner, 920 Turnpike Street relative to
information he has received that Mr. Perley Rea who resides ,~t Chestnut Street
near M~i Road and Turnpike Street is in the process of making a parking area for
trucks to be used.as a terminal for United Freight, Inc. Mr. Kellner states,, We
are opposed to permission being granted to this commercial enterprise as it is
in violation of the proposed zoning in this arm and together with the operation
of the gravel pit on Mill Road we feel that the families who have resided here
over a long period of time are being exploited to a degree that they will suffer.
Mr. Kirk in. formed those present that this letter should not have been sent to the
Selectmen but to the Board of Appeals. He made a motion that a copy of this letter
be sent to the Board of Appeals and ask that they meet with the board on Monday
evening next.
OPI~EON FROM ATTY. ARTHUR A. THO~0N RE OPEN DITCH:
A letter from Atty. Thomson relative ~o a previous complaint made about drainage
from Waverley Road and Mass. Ave. into 'Kenwood Street was received a~d the board
voted to accept the letter and take it under advisement. The complainants were
Anthony and Fortunata Bellia.
LAWRENCE ELECTRIC CO:
A letter fram George Frost with the follow~ug recommendations re:street lights.
He recommended 1000 }amen light on pole 1705 at the corner of South Bradford St.
and Great Pond Road. At Crockett Sanitorium, two 1000 lights on poles 1776 and
1823 because of the wide intersection and on pole 1977 at 27 Bradford Street, 1
1000 lumen light.
The board voted to accept the letter and table the matter since there is no money
available at this time for additional lights.
PLANNING BOARD: RE:LITTLE RED SCHOOLHOUSE:.
The Board sent a letter to the 'Planning Board with respect to the discussion held
recently on the matter of the addition to the Little Red Schoolhouse and informed
them that they would now consider the incident closed.

The Board voted to request $500 from the Reserve Fund to take care of a new burner
and they invited bids from three ~ocal oil burner men so that the matter could
be taken care of at once as they consider this an emergency.
APPROVAL BYADVISORY BOARD:
The Advisory Board approved the transfer of $500 from the Reserve Fund to the
Town Building appropriation and the board voted to award the contract to Joseph
Lebel on his low bid of $445.00. The work will be started at once.

the year~ This request made because of the extra expenditures not forseen when
the appropriationwas figured.
HEARING-TO LIMIT VEHICLES TO A WEIGHT OF NOT MORE THAN FIVE TONS-MILL STREET.
A hearing was held at 7:30 P.M. on theabove matter as a result of many complaints
made to the Selectmen.
Mr. Finneran opened the meeting and suggested that anyone who wished to be heard
would please give their name and address before starting ~o talk.
Bernard aellner, 920 TrunpikeStreetstatedth~t he is.opposed to a gravel pit
and is in favor of an~ action takenby the board in. opposing this commercial use.
He said he has resided in this areafor some time and it is a residential farmarea
but it is being used commercially and they are taking gravel ~nd fill out.and
changing the scenic view of the place.
Benjamin Kellner said the gravel pit is a nuisance and he is opposed ~o it. The
hill there is beautiful and the landscape is now changing because of trees being
removed and the steam shoveli~ there all day long.
Edward Phelan, 1031 Turnpike Street is opposed to this. He said the same situation
has been bumped around in Andover and every community and he would like to see
something done to stop this procedure.
George Reastated that he.was born in.this area and there has always been a pit there
and conditions are no worse to-day than they werefiftyyears ago. Mr. Cyr is wideningle
the road and it will be one of the best in-town. He believes that to limit the
weight of vehicles to five tons is unreasonable.
Mr. Kelluer said he differs with Mr. Rea's opinion and he wanted to know who staked
out the road.
Ralph Brasseur was present and said he had been hired by Ira D. Carry to staked o~t
the road in accordance with the layout. He said there are plans onfile to support
his stakes. He said that Mr. Carty has a duty to any citizen to show lines -
and where bounds are laid out by stonewalls they control the wideth of the ~road, If
they have been knocked down they will be replaced.
Mr. Kellner had complained that his~stonewall has been there for over 200 years
and it is now broken down.
Wilfred Cyr explained that there were pockets where the water is retained and
the stones will be put back in their original position. He said they were interested
in scenic appearance and some day they may. have house lots in this area. ~hey'don't
intend to unde~aineanyland and have no intention of making a cliff. They have
contracts with ~ll the people going in there and there are restrictions.
Edward Cregg, Arty and representative for the Oyr Trust Co. said he understood that
this has been a clay pit priorto the adoption of the zoning laws and the new ~oning
law would not apply to any existing non-conforming use..Tneaction of this board is
to limit the weight of vehicles using Mill. Road. He wen~ on toexplainhowm~chMr.
Oyr has spent on this road to rebuild it and it has been widened to the limit, indica-
ted by the engineer. The cost will be about $4,000 to }~. Cyr and that should be
evidence of his good faith. Thaywillbe willing to give an'agreementinwriting
to the town and thcywill maintain the road as long as he uses the pit. They will
make an individual contract and set up certain restrictions if necessary but he
feels that trucks should use Mill Street. They propose to have 'a circular drive
and they are open to suggestions to-make ar~ changes which will benefit the town
and are willing to be pu~ on probation if necessary.
Mr. Phelanstated that this land has changed hands m any times and it is not a going
out affair.
Mr. Charles Thornton said his house is on Mill road and all this talk about not being
mess like it was before is no% true. It looks like Niagara Falls after a rainstorm. He
called ~. Carry to-s~y to look at the situation and he doesn't believe they have any
right to change the water course.
Mrs. Edward Phelan said there is considerable noise there and she would like to
have it stopped..
There was considerable discussion but the Selectmen had to attend the special'frown
