DECEMBER 17, 1956: Mr. Marino-continued
Mr. Sherman informed the Board that Mr. Carry had ordered t ar, oil and sand and that
Mr. Marino had paid for it. ~hen Mr. Sherman heard that Mr. Marino was to pus in
catch basins and drainage and then seal them up for au indefinite time, that was too
much. Mr. Marino put 35 loads of gravel in one s~reet.
· ~tty. Sherman suggested the following action to be taken by the Selectmen:
Since the plan is not approved as required in the agreement, then the bank book should
not be held any longer, if the~ various departments will not be reasonable then they
(Mr. Marino.?and Atty. Sherman will have to bring suit but they wou~d rather not do this.
The Selectmen should discuss this matter ~ith the various hoards and if it can be cleared
up for a reasonable emount. ($500) then Mr. Marino would be willing to go slong with this.
Atty. Sherman assured the board that no action would be taken until the Selectmen
have had an opportunity ~o take this matter up with the various boards involved.
C0~PLAINT- SEPTIC TANK
M~.& Mrs. Pellegrino of 300 Pleasant Street came before the hoard to discuss the
problem they have with sewage, backing up. They have had ~r. Welch, Plumbing inspector
up there and he suggested that they have the tank pumped out. The cellar has water
init and they are unable.to use their bathroom~acilities, their washer, etc. and it
is a real problem. Mr. Ernest Romano has been up there twice and although he was
very considerate and understanding, their problem has not been solved. They bought the
property from a Mr. Boylan and they have talked with him but with no success.
Mr. Kirk wanted to ~new why they had not connected in with the sewer since the houses
on either side are connected and they didn't know why but they are willing to pay
the cost of having the sewer connected if. it can be done. They talked with william 'B.
Duffy and he mentioned having an article in the annual town w arrant to have this work
done.
The board voted to ask for a report from Mr. Romano and to ask Mr. Wm. B. Duff~
about the possibility of having an article to have the sewer connected. --'
ADVISORY BOARD APPROVAL:
The Advisory board approved the transfer of $i25.00 from the Reserve Fund to' the:
Garbage disposal appropriation to take' care of additional help.
LAWRENCE GAS CO:
A~proval given for permission to excavate 18 feet in street to install gash'service
for William Boutman, ~334 Osgood Street..Approved by Board of Public Works.
Approval given for permission to excavate 16 feet in street to install gas service
for John Aleska, 326 Osgood Street. Approved by Board of Public Works.

The. approved the petition of these companies for permission to abandon and ~re~ove .
poles .and~ fixtures along the following public way:
Salem Street, approximately 838 feet southeast of Boxford St. remove 1 pole. '
No hearing required.
DEPT. OF PUBLIC WORKS: Chapter 90.
Notice received that the Chapter 90 funds for the improvement of Dale Street ~
be carried over until next year(State $15,O00, To~n and County each $7,500) A
force account contract will be prepared for execution by this board in' order to
encumber these funds with the understanding that they will be combined with whatever
funds may be assigned next year and the work done under one advertised contract. '
JUROR DRAGON: ',
~rthur P. Kirk drew the name of Charles Fessenden, 3 William Street, to serve as
a Juror at Superior Court, Salem on January 7, 1956. Mr. Fessenden is a line
assigner for the N.E. T & T Co.
D~AGE CL~,IM:
A claim was presented in the form of a letter from Kenneth G. LOr, of Derry~ N.H.
in which he said his car went over a fire hose and a piece of metal went up into
the car causing dsmage to the extent of ~235.00. He asked if he could be reimbursed
for the cost of~ransportation to his work. while his carms tied'up for repairs.
The board~voted .to inform Mr. Lord that we have no insurance to cover this type of
claim and'also that they do not feel that he has a proper claim agsinst the to~.
PROPOSED PLAYGROUND:
Mr. Kirk had a plan of the proposed playground in Precinct T~o and informed the board
that he felt sure that Davis & Furber will be willing to give the toun a piece of land
in this area or at least for a~ry nominal fee. · ~t will be necessary to seek legal advice
and suggested that Attorney Arthur AJ Thomson be retained. It will also be necess~my
to have two articles dra~n up by an attorney and Mr. Thomson could slso take care of
this matte, r, and could act for both parties which is agreeable to Mr. Rock,ell.
The board voted unanimously to retain the services of'Atty. Thomson ~o ~ake care of
the legal negotiations.
