Tho Selectmen met on this date with all members presen~ and Chairman Ralph E.
Finck presiding. The ~eekly Warrant for payrolls and bills payable was approved
and signed by the board in the presence of To~m Treasurer James J. ~.~ker.
POLE LO~TIONS
Petition by New England Tel. & Tel. Co. and Merrimack-Essex Electric Co. for Joint
o~mership of an ezisting pole on the easterly side of Osgood Street, was unanimous-
ly approved by the board. Permission ~as unanimously granted for the removal of
one Joint pole on Chestnut Street.
SUP~ACE WATER DRAI~L~GE COMPLAINT
Mr. W. W. Broughton, 59 Appleton Street, North Andover, appeared before the board
to ~equest that he be allowed to employ a contractor to ~orrect the drainage
situation surrounding his property. Chairman Ftnck stated he wanted to determine
whether or not the town was a party to the situation before allo~ing Mr. Broughton
to handle the matter himself. Mr. Broughton mentioned he had contacted Atty.
Tomlinson and was advised to sssk permission from the Selectmen before proceeding
on his own. Mr. Finck suggested Mr. Broughton, Atty. Tomlinson, Mr. G. Titons and
representatives of the Merrimack-Essex Electric Company and North Andover Highway
DeDartment meetin the Selectmen's Office ne~ Monday evening at 8:00 P.M. to discuss
the situation. This was agreed to.
GASOLINE STOP, GE
In consideration of application by Mr. William Robinson, Robinson's ~xpress,
41 Second Street, North Andover, for license to store 2000 gallons of gasoline
underground, approved byFire Chief James P. Daw, the board voted unanimously
upon motion of Mr. Finneran seconded by Mr. Sutcliffe, that license be granted.

The board received a letter from County Engineer John O. Harmaala requesting
name of To~m Counsel, if any, and if not, requesting the County be given permiss-
ion to use their own counsel Atty. George Karelitz, in regard to claim for land
damage by the Evans family on Dale Street. Mr. Finck stated he did not fe~l Atty.
Karelitz was familia enough~,lththe situation and the matter ~ms tabled one week
for consideration.
CUMMXNGS CG~PLA!NT
A copy. of a letter to the Board of Public Works from James and Grace Cummings,
Stevens Street, was read b~Mr. Finck. Mr. and ~s.gCummings stated dissatisfact-
ion over condition of their grounds after sewer installation of last summer and
requested the Selectmen take action to remedy the situation. The board directed
a letter be sent the Board of Public Works requesting the matter receive their
immediate consideration.

Suggested proclamations for news release relative to "Crippled Childrens" Day by
the Bay State Society for ~rippled Childrmn, and 1958 Cancer Crusade by the American
Cancer Society was referred to news reporter Robert Finneran for publication.
SCOUTING EYe, BIT
The board accepted complimentary tickets to the scouting exhibit at Phillips Academy
March 29, 1958, from the North Essex Council, Bay Scouts of America.
JOHNSOHHIGHSCHOOL BUILDING
Mr. Finck mentioned the water conditions in the Johnson High School building and
suggested the water be pumped out after Town Meeting. It is hoped that the matter
of disposition of the building ~ll be reconsidered at Saturday session of Annual
Town Meeting. In the meantime, the board directed the Highway Departmwnt be reques~
ed to place snow fence around the water-filled w~ll entrance for the protection of
Childrdn.
DOG COMPLAINT
In reference to the James Montgomery co~plaint of a vicious barking dog owned by
Mr. Grigoli, 421 Massachusetts Avenue, Ncrth Ando~er, the board voted unanimously
to hold a public hearing on March 31, 1958 mt 7:30 P.M. to determine whether or
not said dog is a nuisance by reason of mxcessive barking or other disturbance.
The hearing is permissible under Chapter 14C, Section 157 of the General Laws.
POLICE ACTiON~UESTI~ED
Mr. Leo J. Oaleazsi, Middlesex Street, North Andover, a Reserve Officer in the
Police Department appeared before thc board ~o question Police Department use of
thc Reserve Officers Appropriation to pay regular patrolmen. He referred to an
item in the Annual Town Report where Sgt. Hilton and Officer lanni had received
such payment. The board stated thc amounts listed were f~ special police duty
at tho schools bnt advised Mr. Galeazzi they would look into the matter and
directed a letter be sent Tovm Accountant Mary T. Finn for her opinion on the

matter. Mr. Galeazzi criticized certain actions of the Police Chief regarding
use of reserve officers and stated the Chief had not called him once,this y~ar.
Mr. Sutcliffe stated perhaps that was due to the fact that Mr. Galeazzi was not
available when the Chief needed a reserve since he works days at the Western
Electric Co. Mr. Galleazi referred to certain reserve officers who received most
of the work. Mr. Finck stated perhaps these men were availabel when called and
therefore were rewarded with extra work. Mr. Galeazzi further stated Sgt. Fleming
was disturbed on many occasions when the Chief refused to call in reserves ~hen
regulars ~re sick or on vacation. Chairman Finck ~tated if Sgt. Fleming had any
complaints he knewwhere the Selectmen were and added that Mr. Galeazzi should
have his facts straight before presenting them to the board. Soon after Mr. Gal~azzi
left Sgt. Fleming appeardd before the board to state that he had no argument
with the Chief and that ~. Ga!eazzi's information must have been derived from
information he overheard in the station. Ngt. Fleming was advised to seek out
the Chief ~if he had any complaints and if them not satisfied, to contact the
Selectmen
BOARD OF ASSESSORS
Mr. Henry Lund and ~r. Ted Phelan, Assessors, met %~th the board to discuss payment
of-a bill submitted in 1958 but containing items for Nov. and Dec. o~ 1957. The
board suggested in the future they request bills for Nov. and Dec. be submitted
before January l0 of the new year.

PUBLIC ~.ARING - DOG CC~PLAINT
A.:.ssheduled .hea~g took place on the complaint of Mr. and Mrs. James Montgomery,
:.141~...NasSachmsESts Avenue, ~hat a dog owned by Mr.. Deward P. Grigoli of 421 Nass-
achusetts Avenue ~as vicious and created a disturbance by excessive barking. This
hearing was permissable un~l~r Chapter 140, Section 157, of the General Laws. Those
present were Mr. and Mrs. Neetgomery, Mr. and Mrs. Grigoli, Dog. Officer Deeinic
Giarusso, Mr;' and Mrs. Edward Eaton, Mrs. Kelley and Mr. Wilbur Lyons. Mr. Giarasso
stated_ he had received three different cemplaints on the dog, all entered by the
Nentgeeery's, but stated there ~as nothing he could do about a barking dog so
therefore referred the Mentgomery~s to the Board of Select,men. When questioned by
Chairman Finck, Mr. Grigoli'described~the dog as.being a female collie and was
r~ kept chained due to the heavy traffic in the area. That she was never let
loose, ~s wnnderfui with ,~, that she was not vicious 'but actually in many
instances shy of strangers. Mr. Eaton who resides two houses a~y free the Grigoli's
stated the dog was never a bother to anyone and did not feel the barking was excess-
lye. ~ Ne added that there are about a dozen dogs in the neighborhood and has heard of
no complaints until now. Mrs. Kelley mentioned her fear of all dogs hut that she
was not afraid' of the G~igoli dog as long ~s he was tied up. Mr. W~.lbur Lyons stated
'he w~rked nights, ~s'home all day, but could-find nothing wrong with the Grigoli dog.
Chairman FLuck asked~the Meetgomery~s to explain the reason for their complaint.
They ~stated the dog barks almost constantly at a short distance free their bedroom
~ed fre.qu?atly dts_turbs their sleep. That the. dog, Is chained in a location where
~would ~e more of a nuisance to the~ then to the. G~igoli 's. They explained their
'opinion that the dog is vicieea is'. due to the fact that he never misses an oportumity
to charge at, them, strainin$ a~?!~s chain and bariug his teeth., Mr. Montgomery stated
he w~ald.hate to gnesswhat might~happen if hewere loose. Mr. Sutcliffe asked if the
dog was out all day and was answmred no by, the Grigoli's. Mr. Finck asked~ the
Montgeeeryts .if~the¥ had a remedy to offer. Mr. Montgeeery stated that he did not
ha~eLa!re.m..edy.~t?ould certainly appreciate from the situation. Mr. Sutcliffe
as e~ ~' .~e cog~had ever bitten' anyone and.was told not to anyones knowledge. Mr.
Finneran made a motion that the matter be taken under consideration. Mr. ~utcliffe
seconded the motion and there was a unanimous vote.
TREE P~OVAL
At a hearing on the petition of Mr. Edward C. Seymour, 36 Linden Avenue, for the
removal of one tree, the board, upon reco~endatien of Tree Warden John J. Conners
that the tree be re~oved, voted unanimously in favor of the reco~ondation.
