N~hers Present:

Angles, Associate Member, Kathleen Bradley Colwell, Town Planner.
Alison Lescarbeau, Clerk arrived at 7:10 p.m. and Richard Nardella
arrived at 8:00 p.m. John Simons was absent.
The meeting was called to order at 7=14 p.m.
Minutes
on a motionbyMs. Lescarbeau, seconded by Mr. Angles, the minutes
of May 16, 1995 were approved.
Endorsement of Plans
East Pasture Estates - Subdivision
Ms. Colwell stated that all the paperwork was in order, and also
added that the applicant will build sidewalks in lieu of
contributing to the sidewalk fund.
The Board endorsed the plan and the covenant.
Bond Releases
Whippoorw~ll Park (Scott Circle) - Road Bond
Ms. Colwell stated that work on the road is complete, and the road
was accepted as a public way. Ail of the documents are in order,
therefore, the remaining bond funds should be released.
On a motion by Ms. Lescarbeau, seconded by Mr. Rowen, the Planning
Board voted to release the $1,000 road bond.
Cobblestone Crossing X - Site Opening Bond
On a motion by Ms. Lescarbeau, seconded by Mr. Angles, the Board
voted to release the $15,000 site opening bond.
Cobblestone Crossing II - Site Opening Bond
On a motion by Ms. Lescarbeau, seconded by Mr. Angles, the Board
voted to release the $5,000 site opening bond.
Foxwood - Site Opening Bond
On a motion by Ms. Lescarbeau,

Headowood III - Model Home Bond
On a motion by Ms. Lescarbeau, seconded by Mr.
voted to release the $10,000 model home bond.

1995 meeting.

Carriage Chase - Watershed Special Permit
Ms. Lescarbeau read the legal notice to open the public hearing.
Atty. Howard Speicher was present representing the Wilner's.
Ms. Colwell stated that there was concern over the drainage system
and where the water will flow. The applicant added a drainage
system to handle stormwater.
Awaiting certification that the plan addresses all issues regarding
quality of water entering the lake.
On a motion by Ms. Lescarbeau, seconded by Mr. Rowen, the Board
voted unanimously to close the public hearing.
Lot 5 Boston Street - ~ccess
Lot 5 an~ 6 Boston Street - Common Driveway
Ms. Lescarbeau read the legal notices to open the public hearings.
Scott Giles was present to present the plan.
Mr. Giles stated that the 25 foot no cut and 50 foot no build
Conservation buffer zones are shown on the plan. The driveway goes
over an easement on the lotting plan.
Some discussion of keeping as many trees as possible on the site.
Sprinkler systems will be required.
The driveway is to be 12 feet to each house.
Mr. Giles to provide a revised plan showing the driveway cross
section and profile.
On a motion by Mr. Rowen, seconded by Mr. Angles, the Board voted
unanimously to close the public hearings.
Haplevood ! - one lot subdivision
Ms. Lescarbeau read the legal notice to open the public hearing.
Tom Zaho~aiko was present to present the plan.
Ms. Colwell stated that usually the entire road is required to be
built, but in this case, it doesn't make since to construct a
street for just one lot. The town would have to maintain the
street.
Many neighbors present objecting to size of house proposed and more
traffic created on the street.
Mr. toady, abutter, asked whether Mr. Zahoruiko intends to clear
the lot all the way back to his fence?
Mr. Zahoruiko said "no", it was never his intention to do that.
Mr. Coady wondered whether there was wetlands.
Mr. Mahoney suggested that Mr. Cote talk to Conservation.
Ms. Colwell stated that Mike Howard was out there recently and no
wetlands exist.
Pat Longo, abutter, asked whether the house will be built for
speculation or if there was a buyer already.
Mr. Zahoruiko stated that he has no buyer yet.
Neighbors very concerned about size of house being proposed.
Mr. Zahoruiko willing to commit to a three bedroom, 1700 to 1900
square foot, two stall attached garage home.
DPW suggested the address be Rosedale Avenue so fire trucks could
easily locate it.
On a motion by Mr. Rowen, seconded by Ms. Lescarbeau, the Board
voted unanimously to close the public hearing and draft a decision
for the next meeting.
Jared Place IV - Subd~v~s~on/PRD
Ms. Colwell stated that the drainage calculations are not ready
yet. She will walk the site with the outside consultants on June
8th at 11:00 a.m.
Ms. Lescarbeau stated that she was confused regarding a piece of
the land labeled "unbuildable."
Ms. Colwell stated that when form A lots were created on Boxford
Street a piece was labeled "unbuildable" because it had no
frontage.
Mr. Nardella concerned about some recreation area.
Ms. Lescarbeau stated that some sort of recreation area adjacent to
lot 13/cul de sac area may be appropriate.
Mr. Mahoney suggested something on a small scale such as a "tot
lot" would be fine, but suggests to leave the rest alone.
Mr. Rowen would not be in favor of a full scale ball field, but
would be in favor of a small play area. Also, he would like to see
access from Sugarcane in to the open space area.
Mr. Nardella suggested that Bob Janusz look at what can be done in
the open space area for recreation.
Sidewalks are to be added to the plan.
On a motion by Ms. Lescarbeau, seconded by Mr. Rowen, the Board
voted unanimously to continue the public hearing until June 20th.
Evergreen
The Planning Board received a letter from the Health Department
regarding the septic issues.
The applicant has granted the Planning Board a 45 day extension for
the review of the subdivision application.
Ms. Colwell stated that all issues must be resolved by July 18th or
they will have to withdraw.
The public hearing was continued to July 18, 1995.
Carriage Chase - Watershed Speclal Permit
On a motion by Mr. Rowen, seconded by Ms. Lescarbeau, the Board
voted unanimously to approve the special permit as written and
amended.
Long Pasture - ]tmended Subdivision Plan
Ms. Colwell stated that this is an old subdivision that was brought
before the Board in the past. Applicants sued the Town because
the Planning Board determined that the subdivision approval had
lapsed due to the lack of an endorsed plan. The applicant must now
comply with two acre zoning. Applicants decided to comply; nothing
has changed as far as drainage calculations go. The Planning Board
previously approved the subdivision.
Discussion regarding the placement of a Conservation Restriction
over a portion of lots 1,2 and 3. Discussion about the limitation
on building on lot 2 until flooding conditions are resolved.
On a motion by Ms. Lescarbeau, seconded by Mr. Rowen, the Board
voted unanimously to approve the amendment to the Definitive
Subdivision conditional approval as amended and discussed, and to
authorize town counsel to settle case 94-2019 consistent with the
amended approval.
On a motion by Mr. Rowen, seconded by Ms. Lescarbeau, the meeting
adjourned at 10:00 p.m.
