onded the motion and there was a majority vote. Mr. Flnck stated he was in dis-
approval of the motion as he had already spoken to the Chief on the matter and
was told there is not enough money in their expense appropriation to take care of the
cost~ Mr. Finck further stated he felt the Selectme~ should p~rchase the set of
laws for the departmmnt. Mr. Ftnneran and Mr. Sutcliffe questiomes the ability of
the board to make this purchase as the Contingent Fund wss rurming very low.
At a special meeting of the Board of Selectmen, at which all members of the board
%~ere present, the following matters were acted upon:
APPGINTNENTS
Attorney Vinc~t Carcio ~as appointed legal counsel for the North Audever Highway
Department to obtain the necessary easements to effect the accomplishment of Article
30 of the 1958 Annual Town Warrant.
Attorney Anthony Randazzo was appointed legal counsel for the North Andover Planning
Board.'

APPGIN~MENT
The Board of Selectmen appointed Atty. w-~.old Morley, Jr. to represent the Town
of North Andover in the l~-d~damage case of Lewis vs County of Essex et al, Essex
County Superior Court #Ll759. A letter was directed to the County Commissioners
requesting they accept this choice of counsel and that they appoint him to rep-
resent .the county in this case.

The Board of Selectmen met on this date with all members present and Chairman Ralph
E. Finck presiding.
PUBLIC HEARING WAL~R DOG
Several residents from the Water Street area were present at the hearing scheduled
,for this time. Mr. Finck stated persons must testify under oath and swore in Mr
Heimann, petitioner,.wh% along with others contend Mr. Roland Walker's dog is
vicious and constitutes a public menace. It was Mr. Walker's dog who bit his
daughter and provoked this petition to the Selectmen for action. Mr. McCel]~on
mentioned he was attacked by this dog about a year ago, and would cross the street
~a~= than walk by the dog. Mr. O'Brien stated for the last year or sc the dog
has been chained and that his two boys are not afraid of the dog. Mrs. Hsimama
mentioned two of Mrs Barnes' children have been bitten by the dog. Mr. NcCallion
stated he would hate to she his mB~ ldren wander into the 2~rd. Mr. James Phelan
mentioned the dog has knocked down his teunants door several times. Mr. Walker,
owne~ of the dog stated the little Hsimann girl was playing with his dog in his
y~rd two weeks after having been bitten. Mr. Walker stated he had beon in an
automobile accident with his dog just previous to the child being bitten and that
possibly the. child.had touched the dogs head which had been quite bruised due to this
accident. Mr. Leo~d Windle of High Street asked to hear the police report
on this matter. Mr. Finck read the report which stated in general that many
neighbors had b~en questioned recently and contended ~that the dog is constantly
tied'up when outdoors. Mr. Wal~er asked if Mr. Leonard was a neighbor and Mr.
Windle answered no but that he was interested since his daughter walksd by that
house every day. Mr. GLirruso, Dog Officer, stated he had visited the immediate
neighbors to Mr. Walker who stated they have not seen the dog running loose since
Mr. Giarusso ordered the dog restrained immediate following the dog bite. Mrs.
Barnes when questioned by Mr. Giarruso would give no information relative to the
case. Mr. McC~llfon stated the dog was seen running loose two days after the child
had been bitten. Mr. Walker explained another dog in the neighborhood looks emactly
like his dog, even fools himself at a distance. He added his dog had not been let
loose since the accident. Er. Leonard asked the bcar~ several questions relative to
legal proceedure on this matter. Atty Finck quoted the law pertaining to complaints
on dogs. Mr. L. Windle stated he feels this dog has a history previous to this first
public.complaint. Mr. Giarusso stated when asked byMr. Sutcliffe that one former
complaint on this dog was in regard to a fight with another dog. Discussion followed
on statutary laws in regard to dog bite and rabies. Mr. Heim-~u stated she did not
feel. proper precaution had been taken in regard to rabies. Chairman Finck asked Mrs.
Heimanu if she was speaking of malfeasance on the part of the authorities. Mr. Windle
asked what length of restraining order might be imposed by the Selectmen and was
told anrestraint could be ordered for as long as may be deemed necessary. Mr. Harold
Windle stated he ~ms always fond of dogs but Walker dog has always fought with other
dogs. Mr. Ftnneran motioned the matter be taken under advisement, seconded by Mr.
Sutcliffe and put to a unanimous vote.
