TOWN BUILDING
The board considered an estimate from Wiring Inspector John Thompson in the amount
of $95.00 for improved lighting in the Treasurers Offices. Mr. Ftnneran motioned
the estimate be adopted. Mr. Sutcllffe seconded the motion and the vo~e was unan-
BUILDING INSPECTOR - Marine
Mr. Martin Lawlor appeared before the board to state Mr. Carmelo Marine had
started to build a house on Beverly Street without a building permit and that a
building permit could not be granted for this location since the lot does not
have the required 12,000 sq. ft. Mr. Marine was present and stated he went
ahead with his building because he was under the impression the Board of Appeals
was in approval of his plans. Mr. Lawlor stated he should not have started to
build without a building permit and that he ~ad advised Mr. Marine previous to
his building there that he could not issue a permit for this location. Mr. Finck
advised Mr. Marine that Mr. Lawlor cannot issue a permit if the Board of Appeals
states the matter in strict violation.
WEEKLy WARRANT
The weekly warrant forppayrolls and bills payable was approved and signed in
the presence of James Maker, Town Treasurer.
DEPARTMENT OF. PUBLIC'UTILITIES - Boston & Maine
Mr. Sutcliffe motioned a letter be sent to the Department of Public Utilities
protesting the curtailment of more train~ and station stops in this area. Mr.
Finneran seconded the motion and the Vote was unanimous with Mr. Finck stating
the board make a point of being present at the time of the hearing.on this
matter. .
EASTERN MASS. ST. RA~
Mr. Sut~t~_ffe motioned letters be sent to the Eastern Massachusetts Stree~ Railway,
the Amalgamated Street and Electric Railway, Local 261, Representatives Giles,
Longworth and Williams requesting that action be taken to effect an early settle-

Mr. Ralph Brasseur, Engineer appeared before the board to request information on
z~he land taking for sewerage on Woodlane. Chairman Finck stated he would speak
to Atty. McCarthy on the matter and semrch the records for the information re-
quested. Plan dates back to 1909.
(~APTER 80 - Mifflin Drive Assessments
The board discussed application for abatement of Chapter 80 Tax Assessment by
Alfred J. Fleischmann of 84 Putnam Road, North Andover. Mr. Finck stated it
may be necessary to petition the legislature for a validating act on all the
assessments in town. Mr. Finneran stated he had already made a decision on this
matter when as former member of the Board of Selectmen he voted &o adopt the legal
opinion ~f Atty. Arthur Thmmson in respect to this matter. He will therefore
stick with the assessment of the town. Mr. Fleischmann then appeared before the
board and Mr. Finck ashed him if the abatement had been filed within the six
months requ~rsment. Mr. Flei~chmann stated no and added he feels on equal grounds
with the town as far as violations are concerned. Mr. Finck asked Mr. Fleischmann
if he would consider a partial abatement. Mr. Fleischman stated he wouldn_~t
protest a token fee providing the amoun~ was satisfactory. Mr. Finck asked if he
had a specific figure in mind and was told $5.00. Chairman Ficnk stated that
amount would hardly be sufficient and asked Mr. Fleischmann if he would consider
a 50% abatement. Mr- Fleischmann'asked on what basis Mr. Finck figured 50%. Mr.
Finck stated he did not feel the town responsible for this amount and it ~s his
personal 'feeling that Mr. Fleischman should be compensated in part. Mr. Fleisch-
man stated he feels it entirely the fault of the town and that 50% is Just too
high. Mr. Finck stated it wo~ld cost more to take the matter to court. Mr.
Fleischman stated he feels this a most unfair compromise. Chairman Finck stated
his opinion that 50% abatement is suitable to this situation and added that Atty.
Trembly is willing to comprmmlse, on his sister's behalf, on this same basis.
Mr. Finck suggested Mr. Fleischmann speak to Atty. Trm~bly on the matter. Mr.
Sutcliffe stated his willingness to go along with Mr. Finck on this matter. It
was a majority vote of the board to grant Mr. Fleischman a 50% abatement on this
assessment. Mr. Finneran stayed with his previous decision on the matter.
Abatement forms were signed by Mr. Sutcl~_ffe and Mr. Finck granting andabate-
ment of 50% of the original assessments to Alfred J. and Louise G. Fleischmann
and to Joseph V. and Rita H. Markey. 'It was directed that the Bcard of Assessors
and Tax Collector be so notified.
TRANSFER FR~ RESERVE FUND
The board voted unanimously to request a transfer of $850.00 from the Reserve
Fund to cover the additional e~oenses to the Street lighting appropriation.
