Finneran The Board of Selectmen met on thi~ date with all members present and Chairman Ralph E. Finck presiding. The meeting comenced at ?:30 P.M. NEARING: UNDERGR0~D S~0RAGE - Nangano A hearing scheduled for this time was held by the board on application by Gaetano Mangeno for license to store underground 2,000 gallons of gasoline at 57~ Chickering Road. There were no objections to the granting of this license. Mr. Fieneran motioned the license he granted. Mr. Sutcliffe seconded this motion and the vote ~was unanimous. EEARING- Pole Location A hearing was held at this time on petition of Merrimack Essex Elecv,~ic Co. and New England Tel. & Tel. Co. for the location of 1 pole on Sutton Street. Mr. Jeremiah Casey of the telephone company was present. There were no objections to this request. Mr. Sutclif~e motioned permission be granted. Mr. Finneran seconded the motion and the vote was unanimous. ROUTE 110 Approximately 18 residents of the Middlesex street and.Mass. Avenue area appeared before the board to request the proposed ramps for the Route 110 access be e'liminated. Mr. Benjamin Hollins:voiced this request for those present. Chairman Fi~ck:"steted until such time as a definite location is ksowa it is difficult to make such a request. Chairman Finck further stated the bOard is natarally interest- id in saving as many homes and business establishments in the area as possible. Er. Finck added since the federal government is contributing 90% of the funds, final approval will stem from this faction. Er. Flnck then reed letter frem~ Senator Kennedy in reply to bOard request for assistance. Mr. Finck else mentioned other government officials had been contacted in reference to this matter. Er. Sutcliffe ahked Mr. Hellins if the plans he had viewed at the Department of Public Works included ramps at Mass. Ave. Mr. Hollins andwered they did,. but the plans were not considered final. Chairmsn Finck stated the line of taking has been esta~ lished on a number of plans b~t. no one plan ha- been accepted a s yet. A1 member of the group stated it seems odd that bids are. being accepted on the bridge .with no definite plan~. The bOard agreed but stated no definite information available yet. Mr. Sutcliffe suggested ~ those present write to the local representatives of the State and Federal Legislatures following up the Selectmen.s request fo~ definite information on the exact location of the route through tl~ Town of North And°Ver. Mrs. Didell asked what could 'be done about obtaining fair appraisals of the homes to be taken. Chairman Finck assured those present the bOard w~uld do everything possibl to .assist and protect the people effected. Mr. Finck suggested those present also write to the Bureau of Resds, Washington, D.C., as final approval of the plans wOuld _take place in this department. ~.toned his intention to visit t~e ......... Mr. Finck also - ~epsr~men~ ox' Public Works again this week. Those present agreed tothe suggestions of the board and thanked the Selectmen for their interest in the matter on their behalf. MASS AVENUE - 'Drainage Mr. and Mrs. Seyfferth cf 7~ Mass. Ave. inquired of the board if any infmmmtion had been received from the State astto their plans for correcting the drainage condition on lower Mass, Avenue. Mr. Finck stated the State Engineers hsd agreed the situation was the reaponisbilit¥ of the State and their intention to do something about it. Mr. Finck then suggestedaa letter be sent to the Department of Public Works requesting information as to what they intend to do on the matter. Chairman Finck referred to the possiblity of the reconstruct- ion of Mass. Avenue should the Town decide to take it over as a To~ Way. Mr. F~nck added this would not be considered until the drainage was first dcrrected. LAWRENCE GAS GI~PANy- Road Repair Mr. Gilbert Rea appeared before the board to complain on the condition of Rea Street since the Lawrence Gas Company mede their excavation several months ago. Chairman Finck stated Mr. McGuire of the Gas Company premised the area wOuld be repaired. Mr. Finck suggested the Gas Company be contacted to mee~ with Mr. Reaavailable Tuesday to afternoon do this. for an inspection of the area. John ~illis, Attorney for the North Andover Hous~gAuthority, requested the May 25, 1959 - continued: '465 Board of Selectmen call a Special Town Meeting for ~une 15 as the Housing Authority requests a rezoning of tho land for Housing for the Elderly. Chairman Finck stated his intention to call a Town Meeting some time in June but stated he w~ald prefer June 22 or June 29 to allow a sufficient amount of time for typing, printing and proof reading the Warrant. UNDERGRO~'D STORAGE -bFuel Oil - Heffnor ,Mr. Sutcliffe asked Mr. WiLLis if he had any information on the zoning of the Heffner Station on Chickering Road in relation to Mrs. Fournier's petition for underground storsge of fuel oil. Er. Willis referred to the provision of the ' By-Law which prohibits any accessive use to general use and claimed the fuel oil storage is accessive. Mr. Wi22is added convenience of abutters is to also be considered. Mr. Willis also referred to the enabling section of the By-Law which does not expressly state 't~ulk'r storage. ROUTS 220 ~hairman Finck read letters from Senator Kennedy and Congressman Lane which state& they.~uld attempt to obtain definite information ss to the location of Rte. 110 thronghtthe Town of North Andovor. The letters were .accepted by the board. ~ SERTI CE ' Sample posters ~or exmmination to Police Entrance in the North Andover Police Department were submitted to ~he board for approval by the Division of Civil Service. The board exsmined the poster.. Mr. Sutcliffe motioned' the poster be approved. Mr. Finneran' seconded the motion and the vote was unanimous. Mr. Finck stated it was of no special circumstance at time the BY-L~W-was adopted and is not now. Nr. Finnsran stated he is'not impressed with the fact that special circumstances existed and motioned that snow removal and sanding operations ere not public e~ergencies on special circumstances and there- fore payment.of overtime to the Foremsm of the depmrtmant for such cannot be made. ~Mr. Finck,seconded the motion,and there was a majority wte with Mr. Sutcliffe~opposed-on grounds that explanation .by Atty. Sa2isbury is not clear and sue to 'his~own~ opinion that Special Circumstances d~exist~duriag snow rem~v~I ~and. sanding 1operations, Mr. Finck stated regardless of Town Counsel the situati6n do~s not constitute an e~ergancy especially since the foreman was awa~e of the duties involved in being foreman of ~the Highway Department. Mr.Finck suggested each individual case should he taken on its own merit in the futu~e~ Mr. Sutcliffe repeated his opinion that this case constituted a special circumstance. POLTCE DEPARtMEnT - Chief Lawlor Report Chsimun Finck reed report from Chief Joseph W. Lawlor relative to tr~fic conditions at Clarendon Street and Stevens Corner and recommendations for improvmnents. The Chief recommende, t Slow signs and figures of chinon, be painted-.on the road near the Aplin-Planground and that a Stop sign he installed on Park Street at Osgood St. Mr. Finneran motioned~ the recommendations be'accepted. Mr. Sutcliffe seconded the motion and the v~te was uaanimoue. RESIGNATT0~'- Crossing Guer~ Reserve ~fficor'Frank Dushsme, Safety Police ~fficer in charge of School Cross-lng Guards, reported resignation of Mrs. Ruth Armstrong, Reserve, as a School Crossing Guard. Mr. Sutcliffe motioned the resignation be accepted with regret. Mr. Finnorun seconded the motion and the vote was unanimous. Chsirman Finck suggested Lawrence City Hall be contacted to inquire if Lawrence Women Crossing Guards are insured under Workmens Compensation. May25, 19%9 - continued~ CONSERVATION COMMISSION - Article Chairman Finck read letter from Atty. Arnold H. Salisbury, Town Counsel, stating Mr. Oscar Root of Brooks School was interested in preserving the natursl resources of the Town and suggested sm article be inserted in the Warrant for next Special Town Meeting providing for the establishment of a conservation commission. The form of article was presented by Atty. Salisbury. Mr. Sutcliffe motioned the Board of Selectmen sponsor the article ss suggested by Atty. Salisbury. Mr. Finneran seconded the motion and the vote was unanimous. AIRPORT CG~MI$SION- Clark Street Chairman Finck stated he had attended the scheduled meeting at the Lawrence Airport this evening at 6:00 P.M. and viewed the site of the relocation of Clerk Street under the revised plan. INVITATION - Booster Club Chairman Finck rem~ invitation f~m the Booster Club to participate in the parade 'and festivit~es in honor of the opening of the Little League Season May 31, 1959. Upon motion of Mr. Finneran the hear~ voted unanimously to make every effort to attend. SPECEAL TG~N MEETING Chairman Finck suggested the Special Town Meeting be celled for June 22 at 8:00 P.M. in the High School auditorium. Mr. Finneran mede this a motion and that the Warrant be officially opened at this time. Mr. Sutcliffe seconded the motion and the vote was unanimous. It was directed the High School be contacted for use ' of the auditorium on this date. HOUSING AU~ORZTy - Federal Housing Project Mr. Sutcliffe stated he felt the heard should take steps to see that families to be evicted for the location of Route 110 are provided housing facilities in the Town of North Andover 'and suggested a meeting with the Housing Authority to discuss the possi~d.l.lty of an additional housing project in Town. He motioned a meeting be held on June 1, 1959 at 8:30 P.M. for this purpose. Er. Finck stated he felt the meeting ~ be purposeless without a representative from the State Emus~ggB~ard, to e~lain procedure and the availability of State and Federal aid. Mr. Finnoran seconded the motion and the vote was unanimous. Upon motion of Mr. Finneran seconded by ~r. Sutcliffe and voted unanimous the meeting adjourned at 10:00 p ~M. BIDS - Resurfacing of Streets Sealed proposals on the Selectmen ,s call for bids on the resurfacing of streets under Article 34, 1959 Annual Town Meeting were submitted bF Merrimack Paving Corp. and Essex Bituminous Concrete Corp. and were opened and read by Chairman Finck at ~._ 7:30 P.M. as b~d.~s~: $~,~00.00. Totsl bid ~tal bi_d by Merrimack Paving Corp. ReiLly representing the~ ~x ~zt~m~nons concrete Corp. was $6,436.00.~. Merrimack Paving Corp stated his objection to the specifications which did not specify the required amounm of Bit. Tack Coat or the number of Catch Basins to be adjusted. Mr. ~lfz~d Boeglin stated the bid would be awarded on the unit price and therefore was not necessary to specify nmmbers. Commissioner Abeam of the Essex Bituminous Concrete Corp. stated his company would assume the additional cost of catch basins if necessery. Mr. Flnmeran motioned the bids be taken under advisement. Mr. Sutcliffe seconded the motion and the vote was unanimous. DEPARTMENT ~F PUBLIC WOR~S b Osgoed Street Chairman Finck read letter from the Department of Public Works stating survey would be conducted on 0sgood Street between the Western E~ectric Plant to the intersection of Sutton Street based on beard recp~est to have the road widened in this area. Mr. Finck also read letter from the Western Electric Company stating the company had also written to the D.P.W. making this sm~e request.
