The Board of Selectmen met on this date with Chairman Finck and Philip Sutcliffe
present. Mr. Finneran did not attend as he is away on vacation. *
HEARING: Joint Pole Location
Upon motion of }ir. Sutcliffe, seconded by Mr. Finck, Merrimack- F~sex Elec~C~..
and the New Eng. Tel. & Tel. Co. were granted permission to re-locate certain
poles on Rea Street
Fuel Oil Bids
The following proposals were read by Mr. Ftnck on bids offered for the delivery
of 25000 gallons more or less, of fuel oil to be delivered as needed to the Town
Buildings, Town Shed Police and Fire Stations.

Upon mo.tion of Mr. Sutcliffe end seconded by Mr. Finck, bids were taken in to
consideration. Later in the evening the board voted to award the contract to
Cyr Oil Co., the low bid.
CC~PLAINT - Elaine Griffin
Mrs. Elaine Griffin of Chickering Road , appeared before the board in objection to
the display of Septic Tanks on the Mangano business prep~ty, Chickering Rom/.
Mrs Griffin stated, she fe~ls the advertisement constitu~s a nuisance. ~A~ir~n
Finck asked if it was ~nt an accessary use under the Zoning By-Law, Mrs Griffin
stated she h~d consulted the Department of Public Works on the matter and officials
agreed the situation was a nuisance. Chairman Finck suggested the matter be referred
to the Building Inspector to determine whether or not a nuisance exists. Mr~ Sutcliffe
mentioned Mr. Lawlor was in the Office Building and~hh.cell~ddiflnt0cexp!ain the. sit-
uation.--Mrs. Griffin then brought up the matter of her application to the Board
oS Appea~s for a variance of the Zoning By-Law to divide her land into two resid-
ental lots, which had been denied her her at the last meeting. She Stated it was
animosity on the part of the majority of members in rending such a decision. She further
stated objections to two members of the Planning Board serving as members to the
Board of Appeals. Chairman Finck advised Mrs. Griffin, that she was not before the
proper board with her argument. I~. Griffin asked what recourse did she now have.
Chairman Finck suggested the courts of Town Meeting acting asa remedy.
PETITTON - NORMAN 'SCOTT, Building Permit
Mr. Martin J. Lawlor, Building Inspector appeared before the board along with resid-
ents of Martin Avenue, who.petitioned the Selectmen in objection to the granting of a
building permit to Mr. Norman J. Scott, for the erection of a garage to store 6 or 7
motor:'vehicles on the street. Mr. Lawlor explained he has not yet acted on the applica-
tion by Mr. Scott as the garage constitutes a business and the land is zoned as
residental. Mr. Lawlor added that Mr. Scott is now in violation of the Zoning By-Law,
as 5 trucks are stored on the property. Mr. Norman Scott appeared before the board
and Chairman Finck re~read the petition.
Residents of the area, stated the garage would represent a nuisance end would decrease the
valuation of their homes. Mr. Scott stated ,he pays a large tax on his property and
fuel, he deserves a little consideratian.rhai~man Finck stated payment of taxes.not
the issue here but a zoning violation is. Mr. Finck asked Mr. Scott if he intends to
abate the present nuisance? Mr.. Scott stated he would move two of the vehicles to
his other property. Mr. Dubois mentioned Mr. Scott also has steel girders stored on
his property. ~. Scott also ~tated he intends to make use of the girders in build-
ing his' garage. Chairmsn Finck suggested the Building Inspector ~.0 investigate the
allegations end complaints end report to the board nex~ Neeting. Er. Scott stated if
the permit was denied that he wnuld apply for a variance from the Board of AppealsA
DEPARTNE~ GF PUBLIC WORES: Adams Avenue Drainage.
Chairman Finck read a letter from the Department of Public works relating to the drain-
age on Massachusetts Avenue between Ad,ms Avenue and Chickertng Road. The board accept-
ed the information from the Department that drainage conditions would be corrected.
NEETING: Harold Parker State Forest-Berry Pond
Mr. Parker E. Gilford of. Middleton, Supervisor of the Harold Parker State Forest,
Police Chief Joseph W. Lawlor and Fire Chief James Daw appeared before the board
to discuss safety conditions at Berry Pond the scene of a recent drowning accident.
Chairman Finck explained the feeling of Town Officials ~ms that since the area cross -
es within the boundaries of N.Andover an attempt should be made to insure proper
safety conditions. Mr. Gilford stated his pleasure in seeing a~seriousc complain
about the ridiculous situation as he hsd been complaining to his superiors for 2
years. He explained Berry Pond is a camping area during the week days and a picnic
area on weekends with no swimming allowed on weekends.

Chairman Finck stated.he has spoken to the Oommissioner, who has offered his.
cooperation in the matter. Chairmen Finck also mentioned Senator Rsnak is
connected with the Department of Nationul Resources. Chief Daw explained when the'camper5
are through for the week the equipment is removad from ths water with the except-
ion of the reft, which is en invitation to swim. He added there ere '~o Swimming"
signs posted in the area. Chief Daw recmmended the raft he takeai in end No swimming
allowed 'or be used as a swimming area with the proper protection. Chief Lawlor asked
Mr. Gilford if thez?~ area was'mt understeff. Mr. Gilford answered the camping area
has greatly increa, sed end he is now 5 men short of last y~er. Chief Lawlor asked how
many men ~ere neccessary to adequately cover the area and was assumed tho same number
as last y~ar cover do the Job. Chairmam Finck asked if state parks were not self-
sufficient. Mr. Gifford suggested the board contact a local representative on the
matter..Chsirman Finck stated the board would contact Raymond J, Keiming, Director
of Parks, end letters would be sent to the Commissions of the Depar~entef natural
Resources and Senator Renak requesting the raft be rm~o~ed~ono~eys pond supervised
at all time. Mr. Gifford was tharled for appearing before the board.
DEPARTMENT OF PUBLIC WORKS - Marblehead and Beverly Streets
Chairman Finck read a letter fz~m'~e Departmen~'of Public Works in ref. to traffic
conditions at the intersection of Narblehead end Middlesex Streets, end. Beverly and
~ddlasex Street. The Depertme~ advised the~board~,it is now the responsibilityof
a local~Palice Department to conduct the required traffic counts. T~o hours at
Beverly and Middlesex Streets end 8 hours at Marblehead end Middlesex Streets.
Sutcliffe mentioned the Police Department be instruct~ to perform the '-
.counts and the works-be completed , this week and' C~airmen Finck seconded 'the
Chairman Finck requested the Police D?.p. ar~ment, also conduct a traffic count,. 2 hours'
at Park Street end Osgood Street for hzs own use. Mr. Sutcliffe made this ~a motion,-
also seconded by Chairman Finck. The board alSO directed 40 :scale plens of .the
t~o former intersections be requested from Engineer Ralph Brasse~a and that.they also
b'e submitted the D.P.W. as .required. -.
D.P.U. '- Boston end Maine Railroad Petition
Chairman Finck' read a le.~ter from-the Department of PublTC~tilities. acknowledging
the receipt of a board letter' objecting to petition of the Bo'.~tom. amd I&~hne. Railroad
to curtail certain passenger trains in the area. The b~a~i was assured this letter .would
be considered when rendering a decision .on the petition.,
Upon motion-of l~r. 'Satcliffe seconded' by Mr. Finck the board voted to have'a street
2ight installed near the Joseph Houghton residence on ~oston Street, as recommended
in .the report of survey taken by the Merrimack - Essex Electric Compeny.

~Chairman Finck read application by the Ralph Richard Construction Co. De&bm, .fora

use at the Lawrence Nuniciple Airport~ Chairmen Finck suggested the application be with
held until such time as the commissione.~readers have a decision on the definite, re~
location of Clark Street a~d Board of Public Works request concerning the;.well field.
Mr. Sutcliffe stated he ~mmuld p=efer 'have Clark Street defined before taking action
on the application end.motioned a representation~of the airport commission attend;
a Selectman's Meeting of August 10, 1959 at §:00 P.M. to clarify the locationrzLf
Clark Street. Chairman Finck referred to:~equast 8f the commission to petiti0ff th~
County Commissioners to close off Clark Street which is still pending, before .the
board. Chairmen Finck suggested City Solicter James P. Kene also be requested
~o-attend the meeting. Mr. Sutcliffe indicated this' in his motions which was

Chsd_rman Finck read application by Merrimack College for above ground storage of 160
gs3_lens of ga~o2ine. Mr. Sutcliffe motioned a hearing on this application:be held
August 10, at 7:30 P.M., Mr. Finck seconded the motion.
LAI.~CE GAS CO. Request
Upon motion of Mr. Sutcliffe, seconded by Chairmen Fimck , permission was granted the
Lawrence Gas Co. to excavate on Salem Street to install gas service for Alfred DeFusco
and Edward Mallory

The board accepted from the Lawrence Gas Co., copies of la~ enacted by the State on
May 1~, 1959 rel. to excavation on public ways.

~airman Finck suggested American Legion Commander John J. Lyons, and V.F.W. Command-
er Leonard Enaire be invited to nex~ meeting of the board on ~ougust 10 at 8:30 P.M.
to discuss plans for the Town Observance of Veterans Day.

Upon the motion of Mr. Sutcliffe, 2nd by Mr. Finck, Rev. Ernest A. Brown wms appointed
local U.N.Day chairman.
MASS.SELECTME~'S ASSOC. - Warrant
The board accepted a bulletin from the Mass. Selectmen's Assoc. stati~g~ the Warrant
insertion of articles for next annual meeting will be held open to August 10, 1~59
TOWN GARAGE
Chairman Finck reported the title on the proper~y acqaired for the improvement of
the Town Garage had been chan6ed from Rosemary and Philip T, Miller to the Town
of North Andover, and ~that the house will be renounced by Mr. Sounsan, wrecher, as
soon as a contract is devised.
SUTTON STREET -Speed Zone
Chairman Finck stated several complaints have been made of speeders~on Sutton Street
and suggested the street be posted as a 25 M.P.H. Speed Zone in order that the Police
Dept. can enforce violations. Mr. Sutc!iffe stated he felt 2~ M.P.H. was rather slow
for traffic along Sutton Stree~ and if the street is posted the law should be enforced
Mr. Sutcliffe then referred to speeders along Main Street, as a 25 M.P.H. zone, where
little enforcemen~ is carried out. Ch. Finck stated such an ~amendmant would required
public notice in order to amend the Town Traffic Rules and Order.
M~2LINO BOND - Town Counsel
Chairman Finck read letter from Atty. Arnold Salisbury, Town Counsel, relation to
fulfillment of requirement for the performance of work on Woodstock Street. Upon
motion of Mr.sutc~liffe, 2nd by ~. Finck, the board shall instruct the completion
of work on Woodstock Street a~. outlined in B.P.W. letters to the Selectman. The
hoard shall also advise Mr. Merino that work outlined in letter from Mr. Brasseur
toMr. Catty shall be completed by August 10, 1959 , or the estimated cost for such
· work will be deducted from his bank book on file with the Board of Selecunen. The
expense of work completed by the Bd. Public Works shall also deduct from the bank
book. Atty. Sherman, counsel for Mr. Merino, shall receive a copy of letter to Mr.
Merino. Both shell receive a copy of Mr. Brasseur's letter to Mr. Catty. Mr~ David
Anderson was present during this action of the Board and stated his pleasure at
having the above decision.
DEP~R~ENT GF PUBLIC WORKS - Traffic
I~. Sutcliffe referred to the hazardous traffic conditions at the intersection of
Greene St. and Mess. Ave. and several requests that stop sign be installed. Mr.
Sutcliffe then mentioned the Department of Public Works be requested to survey the
area for the purpose of installing stop signs. ~hairman Finck suggested the intersect -
ion .o~ Greene St. and Waverl~ Road also be considered in the survey. Mr. Sutcliffe
included this in his motion which was seconded by Mr. Finck.
SAMUE~ OSGOOD PC~TAGE ST~
Mr. Sutcliffe motioned a letter be sent to Congressman Lane to see what progress is
being made on the issurance of the postage stamp commenorating Samuel B. Osgoed
as first Postmaster General of~ the United States. It was agreed copies of this letter
should also be sent to greater Lawrence Postmaster Daniel F. Cahill , Senator
Salte~stall and Kennedy, Mr. ~inck seconded this motion
TCW~ BUILDING MAINTENANCE
The board agreed to obtain estimates on the cost of painting the Selectmen Office. The
estimates should be available by next meeting.
