STREET LIGHT REQUEST: A street light installation was requested by V. vafiedes, 270 Bradford St. on pole in front of his home. The Board voted that a durvey be made for the proper lighting. SANITARY DISTRICT APPOINTM~T: A letter from Town COUnSel inresponse to inquiry of the Board whose authority to appoint a representative from the Town to serve on the Gr. Law. Sanitary District Commission had been challenged stated that the matter had been resolved at the Special Town Meeting, Sept. 30, 1968, at which the town unanimously voted, under Art. 5 of the Warrant, to amend Art. 1~ of its General By-Lawsbyadding Section 13: "The Selectmen shall have the power and authority to appo~znt, by majority vote, members of the Greater Lawrence Sonitary District, established by Chapter 750 of the Acts of 1968." TGJN COUNSEL ON LAWRENCE AIrPORT INDUSTRIAL DEVELOPMENT: A letter from Town Counsel in answer th the Board's ~nquiry re the existence of legislation enabling the Lawrence Airport Commission to develop its properties in North Andover to certain "commercial, industrial or motel purposes." .... stated that there was no special legislation dealing with the Airport Commission butthat it had been established and presently operates under the provision of G.L.c. 90 P.51Dff .... as the owner of land in North Andover, the Airport Commission is subject to the provisions of th~local Zoning By-Law-as-is-am~ other ~andownar. Ten years ago a petition was filed b~ the Airport Commi~ien and another app~with the local Board of Appeals asking the latter's permission for the erection and maintenance of a MOTEL upon the Airport property, uder Section 4.5 of the zoning By-Law which permits the Board to all the maintenace of motels ',in any zoning district." WORK: letter from DPW in connection with abo~e-named work was referred to the Highway SurTeyo=. INSURANCE POLICY: ~n Automobile physical Damage policy for Town was received and referred to R. Lafond Ins. Agent ESSEX COUNTY ANNUAL BUDGET: ~ protest from City Councillor , Warren C. Frye, Haverhill, Nass. on the above-named budget was receiwed for study by the Board. NOTICES: Meeting of Gr. Law. 4-C Steering Committee re Community Child care. Invitat~on to attend Youth League Baseball BanQuet, sept. 11, Law. Voc. School; Selectman Finn- eran will represent the Board~ Nass. Civil Defense ~gency notice referred ~to John Farrell, C. D. Director. Invitation to attend designation of Homes in salem, Mass. as National Historic landmarks. MURPHY - DALE ST. DRAINAGE PR(BI~: The Dale Street drainage problem will be discussed by Selectman Finneran and Highway Surveyor for possible correction through Chapter 90 funds. DONOVAN- T~ASH CG~PLAINTS: A letter from Mrs. Donovan stated that trash was burned seven days a week in an open trash barrel"on property at 49 Patriot Street and the smoke was continually going through their windows. The Board voted to refer the problem to the Highway Surveyor and the Board of Health for investigation and report. RESERVE FUND: A letter from the TOWn Accountant amd TOwn Treasurer stated that the amount of the present funds allocated for the Reserve Fund for the Town was grossly inadequate...that the ,m~unt should be ~40,000. instead of $8,000. They listed other~owns~and cities and the amounts that were allocated by their advisory Boards. The Board received the report for further study amd willltake the matter up with the Adviory Boad on september 15, 1969. RT. ~ ~ h-12~ STUDY CG~ITTEE: A letter was received from Chafrman.Ar~thur Murphy requesting $%00. from Reserve Fund for expunses ~ compiling report. CC~FLICT- OF-~2~EST LAW: A letter from Town Counsel stated that sub-contractors under primary construction holding town committee membership w~ e ,.special Employees,, and should fill out ~orm 268A-20(1963~ The Board voted te have secretary send copy of Town COUnsel's letter t~ plumber Edward Welch and Electrician ~incent Landers with said Forms enclosed to be filled out and filed with Town Clerk after Board signs thom. NASS. AV~NUEACCEPTANCE: The Board received a letter from District Highway Engineer, J. D~ffy, Jr. presidln~ The Warrant was approved as submitted. James P. HA~dacre, 148 Waver.ly Rd and George S. Alekal, 74 Adams ~venue were drawn by the Board toserve at Salem, Octooer 14 sitting. NEARING: JOHN MATH~NS VIOLATI~: The Board conducted a second '~earing" on the junk car violation of John J. Mathews who stated that he hsd two, obsolete mail trucks which ha had painted green, stored on his property, to store equipment and tools in. When asked, he stated that they were inoperable with no engines. Mrs. Norms Haphey, one of the abutters notified of the hearing, stated that she did not enjoy looE-ing at said trucks. Mr. Mathews stated that she could not see trucks from her house. After considerable discussion, the matter was taken under advisement. A d~cision will be made at a later date. PETITION FORBURIED CABLe:' A petition from New England Tel. & Tel. CO. to install buried cable on Waverly Rd. was set for a hearing on September 29, at 7:30 P,M. A petition to install 2 ducts on Turnpike St. from the Mass. ElectrZc Co. was set for a hearing on September 29, .1969, at 7:35 P.M. pUBLIC WORKS: A copy of letter to J. Casey, New England Tel. & Tel. CO. from Board of public Works was received. It instructed the telephone company that prior to their installation, of ground telephone lines on Sd~ton and Main Streets, the public Works requested that the proposed work be laid out on the ground, particularly the manholes, to enable public · Works to locate their water and sewer lines and advise the telephoae company of. any changes of location that will be necessary. WOO~ORTH MOTORS WARNING: A letter from Wondworth Motors advised that eny town vehicles that were 1967 Chevolet Biscayne, Bel Air, Impala and caprice models should contact them because of a faulty condition that allows exhaust gases to enter the passenger compartments. Copies of the letter were distributed to the TO~m Departments. NOTICES RECEIV~: CHAPTER 90 funds set aside for to~n from State E~W; $23,000.00. Research Bureau from Town Accountant re Town costs.~ REPORTS RECEIVED: william McEvoy, Chairmen of Recreational Council, submitted a report on the summer activities for the Children of the Town. Tm*n Charter Study Committee submitted a report with recommendation to have the town kire an Executive Secretary. The Board accepted, and took recommendation under advisement. N~N GARAGE SITE: The Board agreed to request $500. to grade fill at the proposed garage site. DONOVAN TRASH C~PLAINT: A report received from the Highway Surveyor stated that this matter was not under his Jurisdiction; it was a Board of Health matter. MURPHY - DALE ST. DRAINAGE PR~LEM: The Board instructed Highway Surveyor to report to Mr. Murphy on corrective measureshe plans to employ on this drainage problem. N~N TG~N CLASSIFICATI~ CODE: The Town Accountant, David Roche, met with the Board advising of a new classification code operation he was setting u~ for tc~l~ blllin$ and requested the authority to do so. The Board voted unanimously .to give TOWn Accountant the required authority.
