Letarte, Secretary ~m~-~~ Clerk S~hool Buildi~uest for Special Town Meeting: Memberso~ the School and School Building Committee met with the two-man Board of Selectman (Selectman DufDy was absent) to discuss the above-captioned request. Selectman F inneran made a motion to deny the petition with Selectman Arthur P. Kirk seconding ~. the motion. A writtan statement of S electmen's stand was read by Mr. Finneran to the members~ Mr. Kirk suggested to the School Bldg. Committee to hold an open meeting to discuss the matter~ He said he was not in opposition to School B.C. but stand for benefit of people in North Andover- He was not opposed to the building of the new high school. That this is a large project and a most important undertaking and the people should be advised of all the facts at a meeting. Mr. Finneran repeated the reasons as given in the written statement,, ,that the Articles submitted were inconclusive, did not state cost of project and are minus all important factors regarding the taking of land for the school site, cost of land, cost of school. After considerable discussion, Superintendent Garofoli thanked the Board for their time and said the committee would submit other Articles that were conclusive at a la~er time. VIOLATIONS: Selectman Kirk asked Mr. Sweeney, who was present at the January 19, 1970 meeting, what he pro-' posed to do about his violations. Mr. Sweeney stated that if he had any violations, they would be corrected, but it takes time. He said he would take care of violations within mwo weeks (Feb. 2) Mr. Kirk made a motion to notify Charles Foster, Building Inspecmor, ~o con, acm Mr. Sweeney prior to Monday night and appear at the next Monday's Selec~men's meeting mo discuss each Sweeney violation with them. C~e calls for the Town to urge the Legislature to take"definite and affirmative', action by granting the TOWn special permission to take the steve- mas-coolidge land. The second Article asks the Town to ratify the School Building Committee:~s in asking our sta~e Representative to file legislation to this is submitted for the actual taking of the land. Such an Article requires a two/ thirds'vote; contains a specific sum appropriation; and, if favorably acted upma~ constitutes the required legal action by the Town for the taking. two Articles submitted require a 50% vote: are silent on the cost of acquiring the site; and do not constitute, in any manner, legally binding action by the TOwn. Moreover, there is so claim that there is any legal necessity for these Articles. And, finally, even given a favorable response to these two Articles, another Town Meeting will have to be held before the** is empowered to take the site. School Building Committee Justifies its request on the basis that it seeks an expression from the Town on the Stevens-Coolidge Site. We agree that this shou2d be sought time. But it is our position that the vote should be taken on the standard land taking ~ere a legal Committmant is sought and all the facts are before the voters. our J~dgment, Town Meetings are to Conduct the business of the Town and not for the purpose taking c~ obtaining votes of confidence. this rejection, we do*not seek to delay action on the new High School. ~ur days ago, we advised the School Building committee of our position. We are ready to act ex- upon any further requests of the School Building committee. We remain sympathetic their desires to have the issue of the taking of the Stevens-Coolidge land resolved prior ~o the March Town Meeting.
