This will complete the need for air conditioners in the building as every office now has one with the exception of Town Clerk's office who cannot have one because of his asthma. ~2~QUIRY- SELECTMAN DUFFY, JR.: Selectman Duffy, Jr. stated, in his opinion, the article addepted for inclusion in the Special Town Meeting warrant submitted by a citizens group was illegal. After considerable discussion, in which Chairman Finneran stated that when a warrant was opened, any article submitted with the proper 200 signatures, had to be accepted for inclusion in said warrant, no matter how it is worded. · If the wording is not correct, Town Counsel will revise said wording, but article must be accepted. Selectman Duffy disagreed. On Mr. Duffy's motion, the Board agreed to send a letter to Town Counsel, prepared by Mr. Duffy, requesting him to look into t facts tha Mr. Duffy wants to explore. Letarte, Secretary *~~~~Clerk LICENSING COMMISSIONERS ' %/-~ ~ ~ ~ An application to store an additional 4000 gals. of gasoline at the Atlantic-Richfield Service station on 167 Sutton Street was sent for a hearing on June 1, 1970, at ?:30 P.M. ~ The applica- tion was referred to Town Clerk for advertising and to Chief James P. Daw and Chief Lawlor for approval. The regular meeting of the Board of Selectmen was held on this date ~rith Selectman Arthur P.' Kirk and Chairman William A. Finneran present. Selectman William B. Duffy, Jr. was, absent because of other committments. The Warrant was approved as submitted. JUROR: George Norwood, Sr., of 22 Lorraine Avenue, was drawn for the June 15 sitting at La%~ence ~Superior Court. HEARINGS: Two petitions for joint pole locations on Moody Street were withdrawn ~lthout pre- by Jeremiah Casey, New England Tel. & Tel. Right of Way Agent. He stated he would another petition involving just one pole. HEARING: A petition was approved by the Board to store additiona 4000 gals. of gasoline underground at~'t67~t$7 Sutton Street. Approval was signified also by Chiefs Daw and Lawlor. TOWN BUILD. lNG REPAIR BIDS: · The above .n~med matter was tabled because of lack of bids. Building Inspecto~submit~ing bid,was 5 mmnutes late because of a Juiior League game and it was not accepted. GASOLINE APPLICATION: A hearing was set for June 15, 1970, at 7:30 P.M. for an application to store underground, ~ 5000 gals. of gasoline (additional) at Hollins Service Station, 17 Mass. Avenue. ~ 'APPOINTMENTS: Appointments to the Water and Air Pollution Committee were tabled until a full Board was present. NOTICE OF INTENT: A notice of intent was received for a Wildlife preservation and fire protection pond o~ Berry Street from Raymond G. Turcotte, Berry Street, North Andover. He stated on his notice that the Subdivision Control Law did not apply. A letter was directed to be sent to Mr. John Daniels, Dept. of Natural Resources, with a copy to Town Counsel, requesting the opinion of Mr. Daniels as to whether Mr. Turcotte's contention re the Subdivision Control Law was correct or no~. Mr. Daniels ~was also asked w~at further steps the ~oard should take in this matter. RECRIVED: Notices of Chapter 90 appropriations. Copies were given to the Highway Dept., Town Accountant and Town Treasurer. ~opy of letter re the Greater Lawrence Sanitary District. An amendmen~ has been passed by the General Court, signed by the Governor (Chapter 320 of the Acts of 1970) effective May 19, 1970. An implementation schedule is now possible. It is as follows: 1. Appropriation of funds for the acquisition of the site, final plans and const=uction,6-30-?O. 2. Acquisition of the site or initiation of action to acquire site by 7-31-70. 3. Submiesion of application for Sta~e planning advance by 8-15-70. 4. Completion of final plans by March 15, 1972. 5. Start of construction of Stage I by September 15, 1972. 6. Completion of construction of Stage 1 by March 15, 197~. 7. Start of construction of Stage 2 by March 15, 1974. 8. Completion of construction of Stage 2 by March 15, 1976. Facilities required - construction of Stages 1 and 2 essentially as shown in the 1965 engineering report by Camp, Dresser & McKee. JUNE 1, 1970 (continued) NOTICES RECEIVED: (continued) Notice from Mass. Selectmen's Association. Minutes of meeting of Voc School. Invitations: Voc School Graduation. Centennial Celebration, Haverhill, June 10th to 14th. Andover Chamber of Commerce Annual Dinner meeting, June 16th. CENTRAL CATHOLIC HIGH SCHOOL: A thank you letter of appreciation was received by the Board from Brother James Gaffney, Dir- ector of CCHS CYA for the permission granted to them to conduct a Tag Day, May 29 and 30. FLAG POLE PAINTING: The Nerrimac Valley Chapter of the Painting and Decorating Committee of America advised the Board, by letter, that they had selected the town of North Andover for their charity project this year. They will paint all public Flag Poles in the Town. The Board voted to send a letter of thanks and appreciation for their civic-minded offer. MEMORIAL DAY CONMITTEE: Chairman William A. Finneran made amotion to send a letter of commendation to the Memorial Day Committee for the fine program they conducted on May 25th. Selectman Kirk seconded the motion. SPECIAL TOWN MEETING WARRANT: The Warrant was opened at 8:10 P.M. to insert the Precinct 7 Article and closed at 8:llP.M. The motion was made to have the Warrant posted. No. 7 article was approved and filed with Town Cl. Letter from Town Counsel re articles was also received by the Hoard. PLAYGROUND INSTR~CTORE: A list of playground instructors was submitted to the Hoard for approval. NORTH ANEOVER BLOOD DONOR DAY: Chairman Finneram proclaimed June 12, 1970 as North Andover Blood Donor Day. It will be con- ducted at St. Paul's Episcopal Church between the hours of l:OO P.M. to 6:45 P.M, A special notice was sent out by Secretary Letarte to all Town Personnel. ADAMS PIPE: Attorney Morley and Mr. Adams was present to discuss the matter of ~600. worth of piping that was agreed by the town to be purchased and installed by the Highway Surveyor. The Board said that they would take the proper steps to finalize the matter. As soon as the Advisory Board approves the Board's request for $5000. to be transferred from the Reserve Fund to the Land Damage fund, the pipe could be purchased. RAIEIGH TAVERN ESTATES: (Copy of letter sent to W. Chepulis, Planning Board Chairman) A letter submitted at 4:45 P.M. on Monday, by~.th~ Highway Surveyor, stated that he had made inspections, though not requested, at the above-named development. He found water mains, surface mains, catch basins and trenches not being installed according to proper specifications and concluded that unless these conditlon were not corrected soon it would be impossible for his department to make rubbish collections because of the treacherous condition of these settlements. This is Planning Board matter and the rubbish collections are Highway Dept. matter - not Board of Selectmen. The letter was received by the Board. HEARING NOTICE: Another hearing will be conducted on June 23, at 1:115 P.M. on the Chapter 90 - Salem St. reconstruction as announced by the County Commissioners. ~~~0 Alice M. Letarte, Secretary ~ lerk LICENSING COMMISSIONERS: An affirmative recommendation was received from Chief Lawlor on the Junk license application of Robert Dalton, Andover, Mass. Chairman Finneran approved ~rith the stipulation that no junk be stored on trucks in North Andover at any time. The license was approved, subject to payment of fee. Taxi -(2) Edward Provissia. 1681 Os~ood St. AML ~' ~ ~ lerk JUNE l, 1970 (continued) STREET LIGHTING: Street light surveys received for the corner of Longwood Avenue and Chestnut Street and the corner of Chestnut Street and Milk Street, pole 1224 were tabled until Mr. Kirk discussed them with John Pare, Mass. Electric Co. Street light surveys for Clark Rd. (Borden's Chemical Plant) and 26 Harwood Street were by the Board.
