Oayton 0s~ood appeared before the Board to discuss the report Just completed entitled, ,North
Andover Growth Policy." State Planninrj Board has informed Oayton that North AD. dover's report
was considered by the State to be one of three reports submitted to be "outstanding." The
State has chosen North Andover's report as an example for other communities. The Board voted
to write letter of congratulations and appreciation to Oayton and his committee for a Jobe
well done.
TOWN GA.~AGE:
Bud Cyr discussed with the Selectmen the problem of the fence 'installed by Brookside to~n
houses which has not yet been removed. The Selectmen stated that a communication in the
Spring from ~ass. Dept. of Public Works had advised that they had ordered owner of BrooksiHe
to remove fence (which is on state property) or they would remove fence and chars~e labor to
Brookside. Cyr's objection is that he cannot properly remove snow from the sidewalk with
the fence. He slso requested again that the row of Willow trees be removed..stated roots
would p~ay havoc with sewer and drainage piping underground. Selectmen had been told by
the State that they would not remove the trees which are also on State property. Cyr also
stated that he had a proper drainage plan from ~ark Street to Lexington St. Letter to Town
Counsel on the Dr. Ceplikas's objections to the drainage installation. Dr. Ceplikas has
no~ answered letter to him from the Selectmen, also. Cy~· also complained abou~ items in
the town garage not completed. Selectmen advised him ~o call a garage committee meeting
to have them write to the insurance bonding company to complete items. Cyr also stated
he could reduce the heat bill by closing in company room ducts which would cost approximate-
ly ~1000. The Selectmen requested an estimate of cost.
POLICE PERSONNEL : IAGASSE and NICOSIA
For conduct unbecoming police officers, the Board of Selectmen voted to send letters to
Police officers, Walter E. Lagasse and Charles A. Nicosia, advising them they would be
given a full hearing on Wednesday, October 6, 1976, at 7:30 p.m. in the Selectmen's Office,
Town Building, to determine whether ,they should be discharged, removed or suspended for a
period of more than five days, from their office as Police Officers, for the specific
reasons, as follows:
1. In that they did, during a time when they were on duty as Police Officers, in the early
morning hours of August 14, 1976, for:ibly cor~fine against her will and did kidnap one Ellen
M. Patterson, of 731 Johnson St., North Andover, Mass.
2. In that they did, during a time when they were on duty as Police Officers, in the early
morning hours of August 14, 1976, commit an assault and battery upon the said ~ll em M.
son.
3 In that they did, during a time when they were on duty as Police Officers, in the early
morning hours of August 14, 1976, accost with offensive and disorderly act or Ianguage the
said ~len M. Patterson, a person of the opposite sex.
This hearing is called in accordance with the provisions of Chapter 31, Section 43(a) of
the General La~s of the Commonwealth of Massachusetts, as amended.
Letters were delivered to the above-named police officers on Thursday, September 30, 1976
by Constable ;.xelred.
LICENSING:
Hearing: Approved: Application for Class It license, 3 car limit, for Andrew F. Cashman,
to be used on premises at 4 Main Street, North Andover, Mass.
Received: Notices from ABC on renewal of liquor licenses.
Decision on violation of The Bard Door, Inc. d/b/a as Joey's; Commission found
they violated C. 138, Sec. 23, sales of alcoholic beverages purchased from other
than a licensee under Sec. 18 Or 19. License wt~3 be suspended 2 days commencing
Monday, November 1, 1976, terminating November 2, 1976. License to be surrendered
to Zicensing Board by 9 A.M., Nov. 1, 1976 and it ~ he returned to you Nov. 3,
1976, at 9 A.M.
