NcEvoy with Chairman Joseph A. Guthrie presiding. The minutes an~ warrant were approved as submitted. This will be the last meeting of this year that Mr. Guthrie will preside at. A reorganization of the Board, an annual event~ will take place at the next meeting. It is the custom that the Selectman that is running for o£fice in the wt~ be nominated Chairman of the Selectman. Er. Coady stated that it has been a privilege to serve under the Chairmanship of Er. Guthrie...he is an individual ~ho carried the respons- ibility of the Chair with great dignity. Mr. Guthrie~s 'administration adds to the integrity eft he Board. BOAPO OF APPEALS v HOUSING APPEALS COMMITTEE:. A group of Waverly Rd. residents appeared once again before the Board to request the Selectmen to appeal, offic~,-l!y, to the Supreme Court, the Housing Appeals decision on the Iow income housing project planned by the Archdiocese of Boston. A. Danahue, spokemm~ for the residents stated that they would pey ~]~ costs of said appeal hut Town Counsel would not represent the town unless the Selectman offic~-lly voted to do so. Nr. Guthrie stated that Town Counsel had advised him, verbally, that if the Selectmen voted to appeal at no cost to the town, cost to Be Borne by the citizens of North Andover, he would make the official appeal. Town also stated that there was little hope of appeal being successful. Mr. ¢oady wanted to know if Town Counsel's advice was in writing, is Town Counsel responsible to the Selectman or to the citizens of the to~n, was his answer more to the citizens or to the Board? Questions un- answered. Mr. Ooady said he would vehemently oppose any motion to appeal to the Supreme Court after being unsuccessful in two other cour~ appeals. · Er, Gnthrie asked Mr. McEvoy if he had an~ cmmments. Mr. McEvoy stated that he had said ~] he was going to say at the last meet~ ;...that he had consulted with many attorneys who had told h~ .the town would not be success- f~. ~ t~. ~..r appeal, if taken, to the S~preme Court. Nayor Buckley of Lawrence requested the Board's presence at a meeting at the Lawrevme Public Library, Tho~sday, 10 A.N. Dec. 30, on the above-named subject. Brian S. and J. Guthrie ~ attend. This plan had been suggested months ago by the Selec~m~ and. they agreed that such an Article should be su~/.tted by the Selectmen ~ FIREFIGHTERS: Letter received frem the Firefigh~er's Union requested the right to amend or delete fro~ their contract agenda for 1977-78, requesting a meeting before January 1, 1~??. The Board voted to notify the Firefighters that they do not comprehe~ "Personal Leave... It is the intent of the Hoard to propose a change in the "Perosnal Leave. Board authorized Chairman to set up a meeting with the firefighter's union representatives as soon as possible for negotiations. . . .. T~N GAUGE: Select_m~, Guth--ie advised Boo~d of severe leak at the town garage facility ~hich had been repaired. It ~as voted to have a meeting on January 20th to tie up loose ends ,~t problems of/~he ~ fac~.lity. Brian ~as requested to contact Town Counsel to he present at this im- portant meeting to answer any legal questions that would be brought up. If Salisbury can · ~ not attend, to notify the Board in time. : Selec~- Guthrie will also attend meeting of the Personnel Board. He will voice his obJections~ to the request for a salary raise of the Wiring Inspector. SOLID WASTE: 'The Selectmen ~oted to have an ,.Open" meeting on the town's proposal for the Regio~ Resottroe Facility to he located in North Andovor, hopefully. Date of meeting to be on January 13th, Niddle School and a large ad to be placed in the Tribune advising the public of the meeting. D~PART~NT HEAD MEETING: The need to meet with ,1~ the department heads was ~,cussed. future, A date ~ be set in the near the request of Civil Defense Director, John Coco, John J. Zaccari, 21 Patriot Street, wns appointed an AuxLliary/Specisl Police Officer. Appointment w~ be sent to Nr. ~.accari. It ~as brought 'to the attention of the Board that the hth of July Conmittee should be appointed for two reasons; ' a budget must be set up for their expenses and this is the time when theY . must contact the various bamis for participation in the parade, plus liming up entertainers. Appointment of the 4th of July Committee in the near future was discussed as · Budget must be set up for expenses and the hiring of bands and antertaimnent usns21y :begins at %his time. GULF OIL CONTRACT: Contract for delivery of gasoline to towa departments received. Board authorized the Chairman to execute three copies of said contract, one to he retained and two to be sent hack to Gulf Oil Company as requested.
