Request received from Airport Commuter Limousine Service, Inc. for permit or license to operate over town public ways for their scheduled limousine service to and from Logan Airport. The Board voted to send the request to Town Counsel for advice and recommendation whether they have the proper license to operate this service. Alice M. Guthrie with Chairman Kirk presiding. The warrant approved as submitted. LOCATION: Hearing: Pole relocation from Mass. Electric Co. approved. Petition for Joint polo relocation on Salem Turnpike, approved. EASEMENT HIGHTS: A letter from New England Power Service enclosed a check in the amount of $1.00 payable to the town of North Andover in full pa~vment, for the easement rights obtained across the town's land because of the relocation of their~ielectric lines in connection with the building of the town's new High School. PETITION-AMEND ZONING BY-LAWS: Joseph Migagliotta appea~ed' before the Board to present a p~_ti~tion to amend the aoning by-laws which would restrict duplex~ type homes being built in ~a~-~z~ned districts in Town. The Board referred hims! to the Planning Board and T own Clerk, for verification of the names on the ion. ST~ET LIGH~ REQUEST: A request for a street light was received from ~ichard Wysocki, 851 Forest St. to reques$ survey for same. The Board voted CHIEF LAWLOR REPORTS - AVI~TT COMPLAINT: The Chief of Police submitted the following recommendations re the Ers. Eugene A~rett complaint regarding dangerous traffic conditions and school children's safety in the vieinity of Andover and Osgood Streets: 1. On Andover And Osgood Street, installation of "Go Slow-Children" signs. 2. Recommmnd opening and conditioning of eide~ksthat have been neglected on Andover St. 3. Recommend yellow line on 0sgood St. at intersection with Andover St. 4- Relocation of l~le at Andover St. and Oak Ave. by telephone Company eliminating part of " - traffic hazard. . 5. Remove oVergrown bushes at intersection; The Board voted to refer Chief Lawlor's letter with its recommendations to proper departments; Highway, for sidewalk repa~s --Tree Dept. to cut down bushes--Police dept. for traffic signs. A letter was sent to telephone mgr., Charles Papalia, reminding him~of his promise to take down PRECINCT WORKERS: pole. The Board voted to fill the vacancies in Precinct 4; Natalie Forgetta was appointed Warden and Louise Fitzgerald, Clerk. BLUE CROSS-BLUE SHIELD: A BO-BS conference, scheduled for this time, was tabled until November 22, 1971. NBTA PASSENGER SERVICE: A letter from Massachusetts Bay Transportation Authority enclosed a bill for $200.82 represent- ing the net community cost of extended passenger train service provided by the Boston & Maine R.R. to the Town of North Andover for the period January 1, 1971 to June 30, 1971. The bill was processed. GAS EXCAVATIONS: ~Petitions to excavate to install and repair gas services was approved by the Board Bunkerhill i~St., Middlesex St.and on Rt. 125 for Trembly No~or coach Service. NETHUEN SELECTMEN REQUEST: A letter from the Methuru Selectmen requested a meeting with the Board to discuss a proposed merger of Lawrence, Andover, North Andover and Methuen. The Board voted to send a letter of polite refusal and stating the Lawrence Chamber of Co~eroe was programming a conference on the subject matter at Merrimack College. They fur"her stated in their letter to Nethuen that at this conference, perhaps some co .~structive reasons for the proposed merEer will be presented but until then, the North Andover Board preferred not to attend any official meeting on the matter. RESIGNAT ION: The Board was advised, by letter, that D omenic J. Bonanno, Lt. Ausiliary Police, was resigning from that position due to pressure of personal business. The Board voted to send a letter of appreciation for Mr. Bonanno's service to the towm and to send a copy of his letter to Civil Defense Director, John Coco. NEW ENGLAND PO~ER CO.: Arnold Salisbury sent a copy of letter from N. E. Power Cc. enclosing their check for $1.00 full payment of easement :~ights obtained across North Andover land to relocate electric lines as a result of the buil~ing of the New High School. A~eaN~ was held on the petition of the Massachusetts Electric Company for permission and locations for constructing, maintaining and operating transmission lines over and across certain public highways in the T own of North Andover for the transmission of electricity. The Board approved said petition and signed the petition, in duplicate and an Order, in duplicate. This petition and order were for the ~ranomission of electricity to the new High School. SUBPOENA: The Board of Selectmen were served a subpoena from Ben Osgood Company to prevent them from authorizing any change in the zoning By-Laws especially in rural .sections. A letter was sent to Town Counsel, Arnold Salisbury, as follows: "This will confirm our telephone con- versation of this date, November 2, 1971, in reference to a Rearing which is to be held at the Cou~tj~Reuse in Boston in the County of SUffolk, on November 4, at 10 A.M. The Board of Selectmen directed me to request that you appear in our behalf. ' I have, as you are aware, had delivered to you a copy of the subpoena that was served on us Monday, November 1, 1971, which refers to this subject matter." Letter sent by Arthur P. FANNIE REYNOLD'S GIFT TO TOWN: The Board of Selectmen and representatives of the Conservation Commission met with Atty. John J. Willis ih an execustive session on Nonday, November 1, 1971. to discuss the He~nolds matter. Atty. Willis outlined, verbally, the mos~ recent wishes of Mrs. Reynolds whish is familiar to Atty. Salisbury. The Board agreed that Atty. Willis should proceed in drawing up the necessary papers to get the gift cf land properly tramsferr&d. The Board voted to send aletter to this effect to Town Counsel requesting that he persue the subject matter with Atty. Willis. BEEXOVER-TRAFFIC CONTROL: A letter was sent ~o Jacob Rerkover, District~HighwaY Engineer, in reply to his letter to . the Board, dated October 17, 1971. It is as follows: 'He received a letter from.you under the datof October 17, 1971, which advised ns of your department's accomplishments in. regard to traffic control on Rt. 12%. Needless to say we are pleased t~.t this part of traffic control and safety on-Rt. 12% is now a reality. We enclose a copy of recc~mmndations made by our Chief cf Police in July. Would you please infc~aus of the progress, to this date, in reference to items 3 & 4. The safety of.cur school population is our prime concern~ we cannot over-emphasize the urgency in this matter? LICENSING CONMISSIONERS: Town Counsel replied to the Board with a letter on the petition of the Airport .Commmter Limousine Service, Inc. for a license to operate through certain par~s of the.town on daily scheduled stops to and from the Ai.rpcrt at Logan. He stated the governing statues, as follows: (G.L.-c 1%9a P. 1,2,4,and 7.) 1. No person shall operate any motor vehicle upon ay public way in any town for the carriage of passengers for hire without first obtaining a license for such operation from the Selectmen of such town, the fee for any such license shall ~not exceed $10.O0. 2. Every such license shall specify the route or routes over which the motor vehicles~may be operated and shall ~e on a form approved by the Dept. ~ Public Utilities~ 3. No person shall operate a motor vehicle under a license issued ac aforesaid unless he has also obtained a certificate from the Dept. of Public Utilities' declaring that public' convenience and necessity require such an operation The Board voted to send copy of Town Counsel's letter to the above-named Limousine Service. The Warrant was approved as submitted. JUROR DRAWN: George LaBelle, 69 Milk Street was drawn to serve at Superior Court, ~n S~m, December 6, 1971. GEN. Ab~0MOTIVE MECHANIC: The Board confirmed the E.E.A. appointment of Edward J. Morgan, 291 Winter Street, North Andcver, to the position of General Automotive Mechanic for the town departments except the Fire Dept. who has their own mechanic.
