The Board of Selectmen held their regular meeting on this date with Selectman Duffy, Jr. and
Chairman Guthrie present. Selectman Kirk was absent due to illness. The warrant was approved
as submitted.
EXCAVATION:
Notice received of intention to excavate on Charles and Sutton Streets. Police, Public Works
and Eighway Departments were so notified.
CE~2IFICATE OF INCO~PORATION:
Received for character verification and referred to Chief Lawlor.
ABM SITE ROAD:
A letter received from Commissioner Arthur W. BroWnell, Dept. of Natural Resources, advised
the Board that he had written a letter to Congressman. M. J. Harrington concerning the ABM
Site road the government has requested payment for. Mr. Browuell hoped he could be helpful
in transferring the road to the town without cost.
C~d~PION HALL:
A letter was received from the North Andover Improvement Society expressing their concern ever
the proposed sale of Campion Hall and surrounding land. They hoped the Selectmen would con-
sider the long term implications and consider available alternatives other than the sale of
land. The letter was received with Selectman Dully making a motion to authorize the Chairman
to send. a copy of said letter to the Jesuit order with a cover letter reflecting the Selec'
outlines.
SANTA CLAUS PARADE:
The Board received an invitation to participate in the annual Santa Claus Parade on Saturday,
November 25, at 2 P.M. which will start at the High School Parking lot. Bill McEvoy, Chairman
requested that no parking on Main Street, from Jefferson Square to Waverly Square be enforced
during the hours of the parade to prevent the very serious bottleneck that occurred last ysar..''
The Board will make every effort to attend and will refer the request to Chief Lawlor.
SNOW REMOVAL:
The Highway Surveyor, N..Nicetta, sent a letter re the proposed removal of Andover and 0sgood
Streets from the State's Snow and Ice Removal Program. He recommended that action be taken
by the Board to prevent the added burden to the town. Selectman Dmffy made a motion to take
matter under advisement and directed J. Erle to contact Nicetta to request a rationale of the
roads.
CHAP. 90:
A Nemorandum of Agreement presented to the Board for signatures was tabled until the following
week. J. Erle to investigate the Agreement. On Tuesday, the Agreement was signed, in dupli-
cate and sent to J. Berkover.
CYR ASSOCIATES:
The Board received a report of the armual outing held by Cyr Associates in Septmeber. Rec
totaled $265.00 which was donated to the Santa Claus Parade fund of North Andover.
PERSONNEL BY-LAW:
A letter received from Town Counsel in answer ~to the' Board's question...'whether statue con-
cerning collective bargaining over-rides the Personnel By-Law.~ Atty. Salisbury stated that
the statue provides, that in the event that any part of a contract agreed upon between the
bargaining agencies of the Town and the employees is in conflict with any by-law of the townj
such by-law shall prevail so long as such conflict remains. Chairman Guthrie said the Board
should seriously give thought to submitting an Article to the annual Town Meeting to change
the Personnel By-Law to enable the Selectmen to be the power authority. No action taken at
this time.
ADM.-ASST.
A letter received from Town Counsel re the %% cost of living raise for the Administrative.Assr
stated that, to date, he did not have at hand sufficient material upon which he could base an
answer to the matter.
SPECIAL TOWN MEETING:
Selectman Duffy made a motion, seconded by Chairman Guthrie, to take request for a Special
Town Meeting under advisement until the Board had contacted the Planning Board prior to next
week's meeting.
OUTDOOR ADVER2ISING:
· Received: Copy of a letter sent by the Building Inspector, Charles Poster, to the Outdoor
Advertising Division relative to the erection of a sign on Rt. 125, Chickering p~ed by Rich-
dale Dairy Stores, Inc. The decision: such a sign is not allowed under the provisions of the
Sign By-Law of the town of North Andover. Copy of the By-Law was also received.
LICENSING COMMISSIONERS:
Received: application for the storage of 10,000 gals. gasoline, underground, at 231 Sutton St
Hearing set for November 27, 1972, at 7:30 P.M. Chief Daw's recommendation also requested.
