The Board of Selectmen held their regular meeting on this date with all members present;
Selectmen John F. Coady, John P. Kirk with Chairman Joseph A. Guthrie presiding. The Warrant
and minutes were approved as submitted.
POLES AND DUCTS:
The Board approved petitions to install 2 poles on Fast Water St. and the installation of 3-3"
ducts on East Water St.
JURORS:
Judith M. Marcks, 61 Union St. was drawn for Jury duty at Lawrence, Sept. 17. James D. McCabe
6Water Street was drawn for Jury duty at Salem, Sept. 10.
POLES & DUCTS:
Hearings were set for Sept. 4, 1973, at 7:30 p.m. for petitions to install 2 poles and 2-6"
ducts on Charles Street.
TROOP 81 ASSOCIATES, INC.:
Affirmative references received on members of the above-names association from Chief Lawlor.
ELECTBXCAL FEES:
Charles Foster, Bldg. Inspector, appeared before the Bca rd to discuss the present electrical
fees.. He stated he had not had the opportunity ~o discuss very ful!ywith the Wiring Insp.
the complaint of town electricians that the mini~wa~mfee of $10. was too high. Foster stated
that Thomson sets and determines the fees on big Jobs. After a short discussion, it was
voted to have the Selectmen meet with Foster and Thompson on Sept. 10, to discuss electrical
fees to be charged.
MODULAR HOMES:
and
Andrew Alvino, Jr., Ch. of the Building Code Committee/Charles Foster met with the Board to
discuss modular home requirements proposed and drawn up by the Building Code Committee. Nm.
Scanlon, of the Board of Health, was also present to ask questions on the proposed procedures.
His chief concern was he feared an epidemic of modular homes installed in North Andoverwith
little variance in structure. Ail his questions were answered by M~r. Aivino, Foster andthe
Board very adequately. The result of the discussion: Ail applications for modular homes must
be recommended by the Building Inspector, the Building Code Committee to the Selectmen for
their approval. Kirk made a motion to accept the B.C. Committee's requirements drawn up for
the installation of modular homes with the exception of Sec. 4 which would have a minor alter-
ation. Motion was seconded by Coady, unanimous vote. They are as follows:

2) An independent Mass. professional engineer's stamp, and signature is required on the

3) Ail mechanical and electrical work shall conform tothe applicable Massachusetts codes.
4) An independent, certified inspection agency, recommended by the N. A. Bldg. Inspector
the Building Code Committee and approved by the Selectmen, shall perform the necessary
inspections required to insure compliance with all applicable codes for work performed
outside of the town of North Andover. The applicant sha~lbear the burden of such inspec.

It was further noted that Section 12 of the Bldg. Code required the approval of the Selectmen
for any expert assistance that is necessary for the Building Inspector to perform the duties
his office.
Chairman Guthrie requested that the Bcard take action on the Bldg. Inspector's first appliCant
for a modular home and the certified inspector recommended by him and the Building Code Comm.
Mr. Kirk motioned that they approve the services of BuildingCertification Services, Jonathan
J. Woodman, Architect, subject to the approval of the Board of Health. It was so voted. Mr.
Guthrie also requested that they be notified when the first modular home is installed, or is
being installed so they could personally inspect the home.
ROADWAY HEARING:
Letter received from Jacob Berkover, District Highway Engineer, re annual P~adway hearing
scheduled for September 18, at 2 p.m., in Danvers DPW. The Board voted to refer the letter tv
the Highway Surveyor forhis reco~nendation on what streets should be earmarked for mainteuanc~
in 1974 and authorized the Chairman to then communicate with~ Dept. of Public Works.
DKIV~NAY:
Letter received from J. Berkover re Bixy & Co. driveway on Turnpike St. Board voted to send
copy to Chief lawlor and Bixby Co. with covering letter to Chief that he meet with the Bixby
Co. to work out a satisfactory solution to the matter. Chief Lawlor is to report the results
to the Selectmen.
496 SO.LIDWASTE DISPOSAL:
Letter recezved from R. J. Lippe, Alderman, Lawrence re Solid Waste Disposal meeting. The Board
voted to send copy to W. A. Cyr, Highway Surveyor and a letter to Lippe asking How, what, where
and when the meeting will be held.
MBTA:
Letter received from the MBTA advising the Board that, due to lack of action on the part of
the Legislature to appropriate funds, passenger service ope bing in North Andover will ter-
minate August 31, 1973. The Board voted to send a copy to mep. James Hurrell and Senator
Rurak requesting their support for continued service.
PRECINCT WORKERS:
The Selectmen met wit~ the Board of Registrars and the Wardens of 5 Precincts to discuss
workers of t~e precincts. It was agreed that steady, faithful workers should always be
called first and, if not available, substitutions could be made. The Selectmen requested
the Wardens to edit their lists when received and eliminate names that are not cooperative
and to add names of willing workers, advising the Selectmen accordingly. Letters will be
sent out to Chairmen of the Republican and Democratic Towu Committees for names of their
choice to be included on the list. Upon request of ~arden Frank Olms, Sr., the Board
voted to raise the salary of the Precinct Clerks to $3.50 per hr., minimum 6 hrs.
LAND-TAXING - Ped. Overpass:
Cha----trman Guthrie requested and it was voted, the authority to contact Town Co~unsel directiug
him to take the necessary steps to make the land-taking by eminent domain for the Pedestria:~
Overpass for the new High School. An appraisal has been made by R. Whipple for the purpgse.
SCHOOL GROUNDS:
Chairman Guthrie reported on the subject matter of the students or young adults using the
school grounds. He stated that he had not received a formal report fro~ Chief Lawlor to
date but stated the situation seemed to be better since permission had/~ted to the
students to use the grounds again.. He also noted that there were always a few whose actions
spoiled it for those who had respect for the rules and regulations set forth. However, he
hoped they would improve. Upon motion of Mr. Coady, the Board voted to request a written,
progress report from Chief Lawlor, Board of Public Works and the Highway Surveyor to be sub-
mitted prior to the Selectmen's meeting September 4. Their reports are to contain their
evaluation of the present situation.
PUBLIC WOBKS CAR:
Chairman Guthrie, with reluctance, brought up the matter of the second, unauthorized car the
Public Works Department was using. At last Town Meeting, the Public Works Dept. was voted

vious discussions, Supt. Borgesi agreed to turn in said car's registration and plates.
However, after three weeks, he failed to comply with the request and the Selectmen sent him
a letter requesting removal of the plates and to turn the registration over to Dick Lafond,
Town Insurance Chairman. After discussion, the Board voted on motion of J. Kirk, to request
Town Counsel to take the necessary steps to expedite the matter of turning over the plates
and registration if no action is taken by J. Borgesie by 5 p.m., August 21, 1973.
BIC~ITENNZAL COMMITTEE:
Rebert Doucette, member of the Civics Celecration Committee,presented a list of names to
serve on the Bicentennial Commission subject to the Board's approval. Three names are from
the Historical Commission...MarY Ellen Ostherr, Peter Ressiter, David Knepper...the remaining
three chosen from the Civic Celebration Committee: Barry Remach, Ernest Gauthier and Charles
Bazarian. The Board approved and voted to appoint the people on the list. Notion was to
accept the recommendations of the Joint committees and appoint same.
OUTSTANDING~JNICIPALEMPLOYEE:
John Nonteiro appeared before the Board to suggest that the name of John J. Lyons, Town Clerk,
be submitted to the Mass. League of Cities and Towns as their nomination for an outstanding
municipal employee. The Selectmen agreed with Nr. Monteiro and authorized the Chairman to
send the nomination, as suggested, for the League's award contest.
LICENSING COM~SSIONERS:
Auctioneer's one-day license was granted to Milton R. PoLlack, to sell cattle and farm
machinery on Aug~j~t 25, 1973.
