Thomson appeared before the Board once again to discuss Adam's applicaticu for an Out-Door Parking license. Building Inspector was also present. Thomson is trying to establish that Adams has been parking cars since 1958, continuously, since 1958 therefore establishing a non-conforming use which would absolve the area from the present Industrial Zoning By-Law which prohibits Out-Door Parking licenses. Hr. Foster, Bldg. Insp. stated that there was no legal basis for allowing previous non=conforming use. Adams, with Farkes and Armstrong were denied Out-Door Par~ing licenses when applied for in 1968. If Adams had been parking cars since then for any reason other than his golf course business, he has been doing so illegally. If Adams has any complaint against the present Zoning By-Law, proper Board to present said complaint is the Board of Appeals and not the Selectmen. Chief Lawlor, also present, stated that the traffic hazard for pedestrians would be greatly if Adams granted license to park cars. If Adams granted license, Farhas and Service Station owned by Cyr would also have to be granted a license. Thirty cars, parked in each location with 3 Or h people, passengers in each car, would increase pedestrian traffic crossing Rt. 125 a day from Western Electric plant to parking areas to approximately 270 or 360 persons. Aftertwice a lengthy discussion, the Board stated they would write to Town Counsel for advice. Questions to be answered: What Board has the authority to determine if a non-conforming situa- tion exists? Letarte, Secretary ~.~ ~ January 24,1975 Upon permission from John Coady, a one-day beer permit was issued to James Greeley, Director of Student Activities, Merrimack College, in the cafeteria for January 24, 1975. JANUARY 27_ 197~5. The Board of Selectmen held their regular meeting on this date with two members present; Sel- ectman Joseph A. Guthrie with Chairman John F. Coady presiding. Tho warrant and minutes were approved as submitted. GR. LAW. SANITARY WASTE C0~rsSION - PEiINI The Selectmen met with Atty. John Ford~ to discuss the Perini Corp. building permit. Chas. Foster, Bldg. Inspector and Joseph Willis also present. Mr. Foster suggested that permit be applied for by the Waste Oo~m~ssicu and pay for it from the Perini Corp. ikumis held by the Commission. SCHOOL COMMITTEE APPOINTMENT: Selectmen John F. Coady and Joseph A. Guthrie mst with members of the School Committee to appoint a member to fill vacancy on the School Committee for short term remaining before the next election. After Chairman Ccady read the names of the four applicants, it was voted to have a Roll Call vote, recorded by Town Clerk, John J. Lyons. Five vetes were cast for Selectman Guthrie, former School Committeeman, to fill tho vacancy. Voting for Hr. Guthrie were John F. Coady, Richard G. Haltmaier, Richard J. Hillner, Charles W. Trombly,. Sr. and James P. Gordon. Mr. Guthr~e~bstained from voting; Selectman Eirk was absent. A unanimous vote,. Hr. Outhrie accepted and was sworn in by '::Town Clerk. TOWN ~EPORT BIDS: Five bids were received for printing of the Town Bepert. Bids received from Meter Services Lithe Color, Inc. Town Printing Co., Lawrence Eagle Tribune, ~(artin Printing Co. and Nairmn Press. Bids were opened by Chairman John F. Coady and recorded by Selectmn Guthrie. It was voted to refer all bids to the Town Report Committee to determine the lowest bidder. On Janu- ary 28, 1975, the bid was awarded to the Lawrence Eagle Tribune, the lowest bidder. GRAVES REGISTRATION APPT: Upon recommendation of the American Legion, the Selectmen appointed Edward Eardsley, 88 F~. to fill the unexpired term of James Sweensy, Graves P~gistration Officer. Mr. Bardsley had previously taken care of calls to his home re the flag decoration of veterans graves, in his capacity as Commander of the American Legion. POLE RELOCATION: The Board approved a petition to relocate a pole on Second St. Install 1 pole, remove 1 pole. WI~ER CArnIVAL: Douglas Howard, North Andover Jaycees, requested that Pleasant Street, £rem Stevens Street to Great Pond Road, be closed off during the Winter Carnival, February § and 9. TO~N ARCHIVIST: Letter received from Thomas Leavitt, Secretaryto the N. A. Nistoricsl Commission, ~no request- ed the Selectmen expedite the use of Public Service funds,recentlymade available to communit- ies, to hire a Town Archivist for the preservation of historic town records in conJuuotion~i~h the coming Bicentennial. The Board voted to accept letter for further study and will advise Mr. Leavitt of any future action on the matter.
