Ford and Mr. George both stated that, because of their contract with Perini Corp, pay- ment could not be made in this way...it would be illegal. If Stop Order issued not only would many people be out of a Job, but the town would be open to damage suits from Perini. Under old Building Code, County's were exempt from building fees but under new law, effective January 1, 1975, leaves the matter of Regional fees up to locs.l Jurisdiction. After a long discussion the foliowing motion was made and seconded: Town Counsel and Atty. John Ford, acting Jointly, wm~ld seek a "Declaratory Judgment" resolving question, whether or not, fee for building permit should be paid by the Periui Corp. The Gr. Iaw. Sanitary District is to call a special meeting to vote the sum-of $15,000,with interest, to be placed Jointly in escrow by the T own of North Andover under the Jurisdiction of Town Treasurer, Jim De~hirst, and the Greater Lawrence Sanitary District. Clerk FEBRUARY 10, 197 The Board of Selectmen held their regular meeting on this date with two men= bets present,Selectman Joseph A. Guth~ie, Acting Chairman of the Licensing Board and Chairman of Board, John F. Coady, presiding. Selectman Kirk was absent. The Warrant and minutes were approved as submitted. _s VO T coWcIL: Letter recemved from Donald Zorn, Vice-President, of the Student Council concerned a propo.sed "Student-Town Government Day," Chairman Coady stated the stu.dents' attmtude.was great: that the proposed plan had worked well. · state-wmde. M~. Guthrme stated mt was a worth-while project and made mormon to have f. Willis contact theZStudent Council to discuss program. PUBLIC RECORDS: Letter received from Sec. of State, Paul Guzzi re availability of Public Records as per Public Records Act. Board voted to send copies to all town department s. ST. PATRICK'S DAY PARADE: · nvm~a~mon recemvec ~'or ~oard and town officials to participate in the 7th annual St. Patrick's Day Parade, March 16th. Chairman Coady and Selectman Guthrie will attend. Invitation sent ~o all departments. PEDESTRIAN O¥~-PA.SS: No~mce received from Lawrence Gas Co. that Bayer & Mingolla Industries, Inc. Worcester, Mass. sent their i~tention to excavate at the proposed Pedestrian Overpass & Construction on Chickering Road. Copies of notice sent to High- way Dept.,Board of Public Works and Police Dept. TOWN AUDIT: Letter from Town Accountant stated that a request should go to the Director of. Accounts re the annual Town audit of accounts. Board voted to instruct Mr. Roche to tske the necessary steps to expedite said request. SOLID WASTE: Letters received on Solid Waste Program submitted from the Highway Surveyor. Selectmen voted to endorse M~. Cyr's program who is to go before the Advisory Board. MAIN ST. -NO P AREING: Reques~ received from Andrew L. Bss, 354 Main St., to have "NO Parking" signs installed on both sides of Main Street, between Park Way and Davis St. The Board referred the request to Chief Lawlor for his recommendation by Feb. 27. WARRANT CLOSED-ARTICLES: warran~ c-os~'~ a~ D':b~ p.m. today. Board willY, take Articles submitted under advisement. Will refer them to Town Counsel for legality and wording, to be returned to the Board by March 3, 1975, at which time the Selectmen will number them. NEXT MEETING: Due to next Monday, meeting day, falling on G. Washington's Birthday, the Selectmen will hold their next meeting on Tuesday, February 18, 1975. It will be so posted on the bulletin Board. OUT-DOOR PAREING LICENSE: After discussion on application of C. Adam's application for an Out-Door license, Selectman Coady stated that there were facts for and against the granting of the license but made a motion that a license for Out-Door Parking be granted to Christopher Adams at 1519 0sgood Street with the stipulation that only 15 cars be parked, daily, and the license could not be transferred to another person or p,rsous at any time.
