HomeMy WebLinkAbout1989-12-07The North Andover Planning Board held a regular meeting on Thursday
evening, December 7, 1989 in the Town Hall, Selectmen's Meeting
Room. The meeting was called at to order at approximately 8:10
p.m. by the Chairman, George Perna, Jr. Also present were John
Simons, Clerk and John Draper. Jack Graham and Erich Nitzsche were
absent.
On a roll call vote:

the Planning Board went into Executive Session to discuss the
stratiglty in the litigation of Butcher Boy, Angus Realty Trust.

the Planning Board came out of Executive Session at approximately
9:10 p.m.
Discussions
Tiffany Lane
Christian Huntress, Town Planner, gave the Board some backgound on
the situation at Tiffany Lane. The developer of the subdivision
has corrected the conditions. New hydrants have been installed.
French Farm
Christian Huntress, Town Planner, informed the Board on the
situation. The problem is drainage, were the common driveway meets
the road. There is puddling and the road is caving in within the
right-of-way which is owned by Benjamin Osgood. The lots were
purchased by Jay Philbin. The common driveways were created after
the lots were purchased. The issue has been going back and forth
between the developer of the subdivision, Ben Osgood and Jay
Philbin, who bought the lots.
The bond is with the developer, Ben Osgood, for the construction
of the road way.

bond for the French Farm Subdivision.

Articles for Town Meetinq
John Simons asked the Board what was anticipate for the next Town
Meeting and brought up Lou Kmiec's property on Route 114 at
Hillside Road.
Also discussed were other tracks of land along Route 114 that were
before the Planning Board for the last Town Meeting.
The Board further discussed looking at parcels suitable for the
SHARP Program. The Board directed Christian Huntress, Town Planner
to check with the Housing Authority on affordable housing and what
options were available through the Town or State.
The issue of the back portion of the Farnum property along Brook
Street was brought up and will be addressed at the next Town
Meeting.
Home Occupation was brought up. Christian Huntress stated that
there was no problem with what exists now in the Zoning Bylaw.
The members want the Site Plan Review Section of the Zoning Bylaw
cleaned up.
Bonds

George Perna asked if all easements have been received and
recorded. Christian Huntress is to review the files for those
documents.
Christian Huntress read a letter from Bill Hmurciak, D.P.W.

By John Draper to approve the release subsequent to
Christian Huntress reviewing the file for all easements
being recorded with the Registry of Deeds and that those
easements are shown and recorded on the plans.

Christian Huntress, Town Planner, read a letter from the applicant
requesting release of the performance bond.
The amount of the bond has not been established. The road was
constructed at the owners expense. The applicant has a bond for
erosion with the Conservation Commission.
The Chairman directed that D.P.W. be notified and an amount be
established.
