Verizon Wireless has entered into a lease agreement with the Trinitarian Congregational Church of North Andover to use the Site for this purpose. The proposed facility ("Facility")will include two (2)arrays of three(3)antennas each, for a total of six(6)antennas,together with associated remote radio heads,junction boxes,and cables, all inside the steeple of the Church. The Facility will also include communications equipment that will be located inside an existing out-building, an emergency power generator and HVAC condenser units that will be placed on the ground at the rear of the Church and screened with a fence,and an underground propane tank that will provide fuel to the emergency power generator. Enclosed with this letter is a copy of the latest set of construction plans dated 3/12/15. The Machine Shop Village Neighborhood Conservation District Commission granted a Certificate to Alter approving the proposed facility at the Site on June 26, 2014. Verizon Wireless is licensed by the Federal Communications Commission("FCC")to provide wireless services within the market area that includes the Town of North Andover. The proposed facility will be a personal wireless services facility within the meaning of the Telecommunications Act, 47 U.S.C. § 332 (c)(7)(C)(ii). The Site is already used to support wireless service facilities operated by two other wireless carriers, including antennas,equipment cabinets, cables,and HVAC condensers. The existing wireless service facilities are authorized by"Wireless Special Permits"that were approved by the Planning Board on March 3,2009 and August 4, 2009 respectively. The reasons for this are as explained below. Section 6409(a)of the federal Middle Class Tax Relief and Jobs Creation Act of 2412 (the "Spectrum Act")states, in pertinent part,"[n]otwithstanding section 704 of the Telecommunications Act of 1996 [codified as 47 U.S.C. § 332(c)(7)] or any other provision of law,a State or local government may not deny, and shall approve any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station." The Federal Communications Commission(FCC)has amended the Code of Federal Regulations to implement the Spectrum Act by adding Subpart CC to Part 1 of 47 C.F.R. These regulations take effect on April 8,2015, and until then are instructive as to how the FCC interprets the statutory provisions. The FCC regulations contain the following definitions of relevance to the Site and the proposed Verizon Wireless Facility. • An"Eligible facilities request"means"any request for modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station, involving... collocation of new transmission equipment." [47 C.F.R. § 1.40001(b)(3)] • A`Base station"is a structure, other than a tower,that supports or houses an antenna, transceiver, or other associated equipment at the time of the application. [47 C.F.R. § 1.40001(b)(1)] • The term"Transmission equipment"is defined to include not only antennas but also all "equipment that facilitates transmission"for a FCC-licensed or authorized wireless communication service, such as"radio transceivers,antennas, coaxial or fiber-optic cable, and regular and backup power supply." [47 C.F.R. § 1.40001(b)(8)] Because it was previously approved by the North Andover Planning Board for the installation and operation of wireless services facilities,the Church constitutes a"base station"under the Spectrum Act. In addition, because it involves the collocation of new"transmission equipment" in a manner that will not substantially change the physical dimensions of a"base station," namely the Church, the building permit application for the Verizon Wireless Facility constitutes an"eligible facilities request" under the Spectrum Act that the Town"may not deny, and shall approve." 4 i Robinson +Cole Jean Enright Interim Town Planner March 16,2015 Page 3 In determining whether a proposed facility would"substantially change the physical dimensions of... [a] base station,"the FCC regulations define a"substantial change"as one that meets any of the criteria established by 47 C.F.R. § 1,40001(b)(7). Specifically,a proposed modification of a base station would constitute a"substantial change"only if it: • "increases the height of the structure by more than 10%or more than ten feet,whichever is greater;" [47 C.F.R. § 1,40001(b)(7)(i)] Comment: The Verizon Wireless Facility will not increase the height of the Church. • "involves adding an appurtenance to the body of the structure that would protrude from the edge of the structure by more than six feet;" [47 C.F.R. § 1.40001(b)(7)(ii)] Comment: The Verizon Wireless Facility will not add any appurtenance that would protrude from the Church. • "involves installation of more than the standard number of new equipment cabinets for the technology involved, but not to exceed four cabinets;" [47 C.F.R. § 1.40001(b)(7)(iii)] Comment: The Verizon Wireless Facility does not involve the installation of more than four equipment cabinets. • "involves installation of any new equipment cabinets on the ground if there are no pre- existing ground cabinets associated with the structure,or else involves installation of ground cabinets that are more than 10%larger in height or overall volume than any other ground cabinets associated with the structure;" [47 C.F.R § 1.4000 1(b)(7)(iii)] Comment: The Verizon Wireless Facility does not involve the installation of any equipment cabinets on the ground. ,All of the proposed equipment cabinets will be installed inside an existing out- building located behind the Church. "entails any excavation or deployment outside the current site;" [47 C.F.R. § 1.40001(b)(7)(iv)] Comment: The Verizon Wireless Facility does not involve any excavation or deployment outside the Site. A small amount of excavation will be required for the underground propane tank,but that excavation will occur on-Site and in close proximity to the Church. • "would defeat the concealment elements of the eligible support structure;" [47 C.F.R. § 1.40001(b)(7)(v)] Comment: The Verizon Wireless Facility will not defeat any concealment elements because the antennas will be installed inside the church steeple and will not be Robinson+Cole Jean Enright Interim Town Planner March 16, 2015 Page 4 visible from the exterior. The installation will require the removal of some existing spire material and horizontal boards, all of which will be replaced with fiberglass panels that will match the original material in color and appearance. • "does not comply with conditions associated with the siting approval of the construction or modification of the eligible support structure or base station equipment;" [47 C.F.R. § 1.40001(b)(7)(vi)] Comment: The Verizon Wireless Facility will not violate any of the "Special Conditions"established by the prior approvals associated with this Site, namely the March 3,2009"Wireless Special Permit"granted to MetroPCS Massachusetts,LLC & Trinitarian Congregational Church of North Andover,and the August 4,2009"Wireless Special Permit"granted to Omnipoint Communications, Inc. d/b/a/T-Mobile &Trinitarian Congregational Church of North Andover. Attached to this letter is a sound study performed by Modeling Specialties, Inc. certifying that the Facility will not produce sound that exceeds background levels by more than l OdBa. Because it does not fail any of the above criteria,the proposed Verizon Wireless Facility will not substantially change the physical dimensions of the existing"base station" on the Site. It therefore constitutes an"eligible facilities request"under Spectrum Act and 47 C.F.R.Part 1, Subpart CC that the Town"may not deny, and shall approve." Based on the foregoing, Verizon Wireless respectfully requests that you issue a determination that the Facility constitutes an"eligible facilities request"under the Spectrum Act and that Verizon Wireless may apply for a building permit to construct the Facility without obtaining a special permit or any other zoning relief. The assessment was commissioned by Verizon Wireless, whose project plans form the basis of this analysis. Baseline ambient sound levels were measured with standardized equipment.. Table 1: Measured Background Sound Levels at the Church Location Daytime L90 Nighttime Lvo Site Area 1:48 PM 40 dBA 12:15 AM 33 dBA There are two primary sources expected at the facility that will produce sounds that have the potential to be heard beyond the Site boundary. Most of the proposed equipment will produce no sound such as the antennas located in the steeple, cabling, fuel lines and possibly an underground propane tank. The supporting electronics to be installed in a section of an existing building will produce no environmental sound, but are environmentally sensitive, requiring condenser units to control the shelter environment. The sound expected from the condensers units is based on vendor data(76 dBA)and verified by field measurements at similar operating installations. Two units will be installed, but only one will operate at a time, allowing redundancy. The results of the study indicate that the sound from the proposed ground mount condenser will meet the DEP criteria at the receiving property line during even the quietest part of the night. The study also indicates that the equipment sound will be lower than the daytime criteria even during the generator's weekly half hour test. All results are rounded to units(dBA). An emergency generator will also support the proposed facility. The generator will only be routinely operated for short tests of about one half hour during daytime hours. Based on a combined condenser and generator sound, the equipment will produce sound levels of 48 dBA or less at the nearest receptors during its infrequent test. As a point of reference, a typical car traveling down the road produces sound levels well into the 50's dBA at residential setback. A truck or loud motorcycle,on the other hand,produce sound up to 70 dBA at the same distance. Figure 2 includes a Google Aerial view of the study area. I certify that the analysis of sound levels for this project is accurate and consistent with prediction methods that are common to the acoustic analysis of such sources. I am qualified to make this statement based on training and experience in conducting analyses of environmental sounds. I am a Certified Consulting Meteorologist with more than 25 years experience conducting numerical analysis (modeling) studies in the technical areas of air quality, noise, and visual aesthetics. I am a technical expert on the noise committee of Air & Waste Management Association headquartered in Pittsburgh, Pennsylvania. I have published many refereed papers on various aspects of environmental noise.
