HomeMy WebLinkAbout1990-04-05The North Andover Planning Board held a regular meeting on Thursday
evening, April 5, 1990, in the Town Hall, Selectmen's Meeting Room.
The meeting was called to order at 8:35 p.m. by the Chairman,
George Perna, Jr. Also present were John Simons, Clerk; Erich
Nitzsche and John Draper. Jack Graham was absent.
Public Hearinqs
318 Salem Street - Pickles, Special Permit - Watershed District
John Simons read the legal notice to open the public hearing. A
letter was read from Richard Doucette, Conservation Administrator
to Bob Nicetta, Building Inspector.
Howard Spiecer, Attorney, gave the Board some background on the
site. A Form A Plan was submitted February 23, 1987, during the
moratorium, building in the Watershed. The Form A gave use
protection. The applicant wants to build a single family home
only, with septic system. The septic system permit has been
issued. Grading would be within the non-discharge buffer zone.
The owner has gone to the Zoning Board of Appeals and was granted
a variance in 1989. The Zoning Board of Appeals conditioned the
variance with a dry sewer.
Charlie Foster, previous Building Inspector, was present and stated
that no grading would be done beyond 20 feet from the house.
The Board asked to see the septic system design· Erich Nitzsche
reviewed the plans.
Christian Huntress, Town Planner, gave the Board recommendations
that were received from the Technical Review Committee. The
recommendations were as follows~
1. Recommended that the applicant apply for a common
driveway permit through the Planning Board.
Recommended that a dry sewer be installed to the property
line for future hook up to a sewer.
Recommended by the Fire Department that residential
sprinklers be installed.
Charlie Foster objected to sprinklers being installed. Christian
Huntress gave the Board reasons why sprinklers were recommended.
The main reason was that the proposed house would be in back of the
existing house and sprinklers are required by the Fire Department
for that reason.
Christian Huntress was asked to check with Town Counsel to see if
this Special Permit could have a condition for a common driveway
without coming before the Board again.
The Board questioned if there was going to be a lawn. Mr. Giarusso
said there would be a lawn, all natural.
John Simons questioned why the lot lines were not configured
differently, jiggling front and back lines. Attorney Spiecer
stated that they could not move the lot lines, changes would be
substantial as to what is required at the present time.
Charlie Foster stated that the house would be beyond 1OO foot non-
disturbance buffer zone. Howard Spiecer stated that between O and
100 feet was the non-disturbance area and that from 1OO feet to 325
feet construction was allowed by Special Permit.
Christian Huntress was asked by the Board to check with the Board
of Health on their permits.
George Perna recapped the issues. The following issues remain:
Has the time elapsed, is it three years or 3 years from
the moratorium.
The common driveway Special Permit, does the applicant
need Special Permit or can this Special Permit be
conditioned requiring a common driveway.
The Fire Department's requirement of residential
sprinklers, are they needed.
4. Does the septic system meet Title V?
A motion was made by Erich Nitzsche to continue the public hearing
to April 19, 1990. The motion was seconded by John Draper and
voted unanimously by those present.
The Chairman, George Perna directed staff to draft conditions for
the Special Permit.
6 Woodberry Lane - Special Permit - Watershed District
For the record John Simons did not participate in the discussion
for 6 Woodberry Lane as the applicant's and the Simons are friends.
John Draper read the legal notice to open the public hearing.
Mr. Rennicke spoke to the Planning Board on the application before
them. He stated that the Conservation Commission will not monitor
the proposed construction of an addition. Hay bales will be placed
at the site. The applicant stated that they will be connecting to
the sewer on Marbleridge Road.
A motion was made by Erich Nitzsche to continue the public hearing
to April 19, 1990 and directed the Planner to draft conditions
including 1.) abandon the septic system and connect with the sewer
on Marbleridge Road; 2.) loam and seed construction road; 3.) Hay
bales will be placed; 4.) only if a variance is granted from the
Zoning Board of Appeals; 5.) all debris will be taken care of
around the site. The motion was seconded by John Draper and voted
unanimously by those present, including John Simons.
Bayfield Company, 2070 Turnpike Street - Site Plan Review Cont'd
Christian Huntress, Town Planner, told the Planning Board that he
has spoken with Town Counsel regarding the application citing W.B.
Kent as the possible tenant. It is of the opinion of Town Counsel
the original application stated the applicant as being Bayfield
Company and that it is alright to continue the public hearing.
Christian Huntress gave the Board members copies of a draft
decision.
Members of the Board expressed their
owner/applicant issue.
concerns of the
Thomas Neve, Thomas E. Neve Associates, told the Board that the
proposed building will be dropped 6 feet from a 30 foot high
building to a 24 foot high building.
Erich Nitzsche wants to go over the drainage concerns with Tom
Neve.
A discussion to place on adding conditions. The Board wants the
plans showing the front of the building as facing Berry Street.
Also discussed were:
Loading docks on Berry Street side reduced, Board members
questioned the need for 6 loading docks.
2. Truck traffic signs will be a condition.
Tom Neve stated that septic system testing was being done. Berms
will be placed along Berry Street with no construction traffic on
Berry Street.
Kathleen Walsh-Murphy, an abutter, questioned if the proposed was
going to be a warehouse. Tom Neve said, "no."
The Board reminded the applicant the any other construction on the
site will need Site Plan Review.
The Board was told that all wetland areas will have a conservation
restriction easement, which will be provided before occupancy is
permitted. This conservation restriction easement will be on the
deed and is perpetual.
Sean Murphy asked about the H.V.A.C. units. George Perna stated
that there will be no mechanicals on the roof.
The Board requested that an additional condition be placed within
the draft decision. Adding that a Lighting Plan will be submitted
with lights casting down.
A lengthy discussion took place on the number of lots being one
address.
George Perna stated that the following issues had to be addressed:
1. common driveway, because their are three lots
2. Drainage.
A motion was made by Erich Nitzsche to continue the public hearing
to April 19, 1990 and add the items discussed to the draft
decision. The motion was seconded by John Draper and voted
unanimously by those present.
Olenio - Salem Street - Special Permit - Watershed District
Thomas Neve, Thomas E. Neve Associates, was present representing
the Olenios. The applicant has been before the Zoning Board of
Appeals and has received a variance back in February. The plan was
denied by the Conservation Commission for the lack of that
variance. Sewer will be connected to the house from Marbleridge
Road.
Robert Olenio spoke to the Board on the existing culverts.
Rene Fugere, 202 Marbleridge Road, told the Board that water goes
over Marbleridge Road causing flooding.
A lengthy discussion took place on the quantity and quality of
water, as well as mitigation.
The applicant is going before the Conservation Commission in two
weeks.
An extension is needed on this application.
A motion was made by Erich ~itzsche to continue the public hearing
to the first meeting after Town Meeting and accept an extension to
May 31, 1990. The motion was seconded by John Draper and voted
unanimously by those present.
Johnson Country Store - Site Plan Review Cont'd
John Simons read a letter from Christian Huntress, Town Planner to
the applicant.
A legal notice is needed for the repetitive petition.
Attorney David Bain was present along with Peter Richardson, of
Richard F. Kaminski Associates, and Donald Johnson, the applicant.
George Perna would like the applicant to see the presentation that
Christian Huntress gave the Planning Board on Village Commercial
Projects and see what is favorable for development in North
Andover.
The Board does not want to see strip malls along Route 114.
A discussion took place on reducing the number of parking spaces.
The Board requested that a legal notice be prepared for the may 17,
1990 meeting for the Repetitive Petition.
A motion was made by Erich Nitzsche to accept an extension to May
31, 1990 and advertise for the first meeting in May, May 17, 1990
for the Repetitive Petition. The motion was seconded by John
Draper and voted unanimously by those present.
South Bradford Street - Special Permit Cont'd
Christian Huntress went over the application before the Planning
Board. The deadline for this application is May 2, 1990.
Town Counsel is in the middle of settling issues with South
Bradford Street.
A motion was made by Erich Nitzsche to continue the public hearing
to April 19, 1990. The motion was seconded by John Draper and
voted unanimously by those present.
Approval Not Required Form A Plans (ANR)
Laconia Circle - Change Lot Lines
A motion was made by John Simons to approve the Form A Plan. The
motion was seconded by John Draper and voted unanimously by those
present.
Discussion
Campion Drive
Christian Huntress, Town Planner spoke to the Board on the bond for
Campion Drive.
John Simons read a letter from Bill Hmurciak, D.P.W. stating that
the amount needed to complete the subdivision is $60,000.
The Board requested that Mr. Philbin and Mr. Laudani appear before
the Planning Board to discuss the issue.
FY1990 Capital Improvements
Replacing 60-90 Year Old Unlined Cast Iron Pipes
A motion was made by Erich Nitzsche to make a Favorable
Recommendation to expend money to replace the existing unlined
pipes as recommended by the Division of Public Works. The motion
was seconded by John Simons and voted unanimously by those present.
Bonds
Sideri Place - Set Bond Amount
A recommendation of Bill Hmurciak, Division of Public Works, that
a bond in the amount of $18,000 be set for Sideri Place.
A motion was made by John Simons to set the bond in the amount of
$18,OOO for Sideri Place and in the proper form. The motion was
seconded by Erich Nitzsche and voted unanimously by those present.
Minutes
March 8, 1990
A motion was made by Erich nitzschs to accept the minutes of March
8, 1990 as written. The motion was seconded by John Simons and
voted unanimously by those present.
A motion was made by Erich Nitzsche to adjourn the meeting, the
motion was seconded by John Simons and voted unanimously by those
present.
The Planning Board adjourned at 12:15 p.m.
