HomeMy WebLinkAbout1990-04-25The North Andover Planning Board held a meeting on Wednesday evening, April 25, 1990, in the Town Hall, Selectmen's Meeting Room. The meeting was called to order at 8~10 p.m. by the Chairman, George Perna, Jr. Also present were John Simons, Clerk; Erich Nitzsche and John Draper. Jack Graham was absent. George Perna, Chairman told the Board members and those in the audience that the following items have been removed from the warrant and will be placed on a Special Town Meeting to be held in September. Section 4.135 - Watershed Protection District Village Commercial Dimensions, Table 2 Section 8.4 - Screening & Landscaping Section 8.1 - Off Street Parking Rezoning of Farnum Property VR to VC at Johnson Street and Route 114. Those items on the agenda that are affected by this change are the following: VR to VC - Route 114, Robert Dunn R-2 to VC - Forbes Property, Route 114 GB, R-2 & VR to VC - Angus Realty Corp, Route 114 and Sullivan Street Public Hearings Warrant Articles - Section 4.135 - Watershed Protection District A motion was made by John Simons to continue the public hearing on Section 4.135 - Watershed Protection District to July 19, 1990. The motion was seconded by John Draper and voted unanimously by those present, including the Chairman. Warrant Article - Village Commercial Dimensions, Table 2 Warrant Article - Section 8.4 - Screening and Landscaping Warrant Article - Section 8.1 - Off-Street Parking A motion was made by John Simons to continue the public hearings to the first meeting in June, June 7, 1990. The motion was seconded by John Draper and voted unanimously by those present. Warrant Article - Section 2 Definitions - Hazardous Materials A motion was made by Erich Nitzsche to make a FAVORABLE recommendation on this article. The motion was seconded by John Draper and voted unanimously by those present. Warrant Article - Rezone from VR to VC - Farnum Property, Route 114 and Johnson Street A motion was made by John Draper to continue the public hearing to the second meeting in June, June 21, 1990. The motion was seconded by John Simons and voted unanimously by those present. Warrant Article - Recommendation Only Grant Easement - 118-120 Second Street - David A. Morton, Petitioner Christian Huntress, Town Planner, updated the Board on what was requested at the last meeting. The Board wants the word "remove" taken out of the easement. A motion was made by Erich nitzsche to require the word "remove" be removed from the easement and make a FAVORABLE recommendation on this article. The motion was seconded by John Simons and voted unanimously by those present. Warrant Articles - Citizen Rezoninq R-2 to I-1 Flagship Drive - Petition of Robert Webster & Others George Perna, Chairman, stated that some of the Board members had visited the abutters on Marian Drive. At that time the lighting situation was not overwhelming. The noise factor of the mechanicals was hard to determine as it was after working hours. Peter Novello, Marian Drive, stated that the lighting was definitely different. John Simons said it would be a serious effect going from residential to industrial. George Perna spoke on rights as a land owner and abutter. Erich Nitzsche stated that this particular parcel is land locked as it is zoned residential, with a wetland that separates it from the residential area. Pat Cavanaugh, Marian Drive, stated that barriers (buffers) were placed in the zoning of the industrial land that surrounds the residential area. John Draper read from the Zoning Bylaw what was allowed in Industrial-1 Zoning Districts. John expressed his feelings that what exists presently is probably more intrusive than what would probably be proposed. George Perna stated that there is a 300 foot natural buffer that exists, that being the wetlands. Erich Nitzsche stated that the whole picture would be looked at. Christian Huntress, Town Planner, suggested contract zoning or that something be placed in the deed. George Perna stated the options that were available~ Contract zoning Disapprove this article John Simons stated that originally the parcel now zoned R-2 was zoned such to supply a buffer, between the Residential Zone and the Industrial Zone. Jim Bourgeois, representing Bayfield, spoke on Industrial-1 regulations being more Research and Development with an office mix. Michael Rice, Bayfield Company, stated that he would consider a deed. Pat Cavanaugh, Marian Drive, suggested that the Board visit the site during the late morning hours, 10:00 to 11:00 a.m. A motion was made by Erich Nitzsche to continue the public hearing to May 3, 1990. The motion was seconded by John Simons and voted unanimously by those present, including the Chairman. Rezone from B-4 to B-2 - Route 125 and Route 114 Fellowship Bible Property Rich Rubino, Rubino Development Company, gave the Board a brief presentation on the proposed. Photos of what exists along with an architects renderings of what could be developed were shown. John Simons commented on the proposed~ B-4 to B-2 would be less intense good example of what is likely to be presented Rick Rubino stated that he has done a title search and no liquor or restaurants are all'owed on the parcel. The Planning Board requested a copy of the deed with restrictions. Mr. Dalton, possible owner, spoke to the Board on the proposed. He has been in the area for some time and has been the Town Moderator in Andover as well as on the Board of Selectmen and the Planning Board. George Perna recapped what was needed~ 1. A copy of the restriction on the deed. 2. Copy of the Purchase and Sale Agreement 3. A letter of Intent. A motion was made by John Simons to close the public hearing and make a FAVORABLE recommendation on this article subject to a copy of the restrictions on the deed, a copy of the Purchase and Sale Agreement and a Letter of Intent being supplied to the Board. Paul Rokos, Johnson Street, asked if Merrimack College had any objection. The motion was seconded by Erich Nitzsche and voted unanimously by those present, including the Chairman. Rezone from VR to VC - Route 114 - Petition of Robert Dunn & Others Christian Huntress, Town Planner, told the Board that Mr. Dunn is under a time restraint on this parcel. John Simons spoke on the size of the lot and could not justify the zoning because of the size. A motion was made by Erich Nitzsche to make an UNFAVORABLE recommendation on this article because VC is not on the warrant. The motion was seconded by John Simons and voted unanimously by those present. Rezone from R-4 to B-2 - 164 Massachusetts Avenue - Petition of Joseph Hahoney & Others Richard Kaminski of Richard F. Kaminski & Associates was presenting representing Robert Cipro. Aerials of the area were shown. John Simons stated that the lot was too small. Richard Kaminski said that this was a unique situation. George Perna stated that it was an appropriate use. John Simons asked if the applicant could acquire 5,000 sq.ft, from the abutting property. Dr. Cipro is just doing his "thing". Erich Nitzsche wants to see copies of the deed. Two separate entities. Joseph Mahoney stated that the former Glennies Property is now held in a condominium. Dr. Cipro is the single owner of the property before the Board. Christian Huntress stated that the proposed has been before the Technical Review Committee. The parcel contains 20,000 sq.ft. The requirement for lot size is 25,000 sq.ft. Members of the Board were in agreement that the following issues need to be addressed: 1. Lot size 2. Technical Review Committee issues. A motion was made by John Simons to continue the public hearing to May 3, 1990. The motion was seconded by John Draper and voted unanimously by those present. Rezone from R-2 to VC - Forbes Property, Route 114 The site contains approximately 13 acres. There are(or will be) deed restrictions, forever. John Simons stated that the size of the lot was not an issue. Paul Rokos, Johnson Street had a few items he wanted addressed~ 1. Would like a barrier around the area. 2. The land should be reforested. 3. Wanted to know the effects the building would have on the wetlands. 4. Questioned the traffic on Route 114 and Johnson Street. 5. What type of business would be established in the development? John Draper read the Village Commercial District from the Zoning Bylaw. Keith Lansalotte, an abutter, wanted to know the height of the building. John Draper read the dimensional requirements. Mr. Lansalotte stated that there was a large pond on the property and does not want it increased. Greg Thomas, an abutter, asked about loading docks and asked for a true buffer. The Board requested a site visit for Friday, April 26, 1990 between 4:30 and 5:00p.m. A motion was made by John Simons to continue the public hearing to May 3, 1990. The motion was seconded by John Draper and voted unanimously by those present, including the Chairman. Rezone from GB, R-2, & VR to VC - Route 114 & Sullivan Street - Anqus Realty Corp. Jim Bourgeois, ECD, was present. The parcel before the Board for rezoning contains 5.5 acres. George Perna summarized the Village Commercial Site Plan Review. He likes the concept. A motion was made by John Simons to continue the public hearing to May 3, 1990. The motion was seconded by John Draper and voted unanimously by those present, including the Chairman. A motion was made by Erich Nitzsche to adjourn the meeting. The motion was seconded by John Simons and voted unanimously by those present.
